'INANCE AND PERSONNEL COD INANCE AND PERSONNEL CONMITTEE I MISCELLANEOUS RESOLUTION #96232 BY: Public Services Committee, Shelley Taub, Chairperson RE: Adoption of the Oakland County Well Protection and Education Policy TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Chairperson, Ladies and Gentlemen: WHEREAS, the supply of safe potable water is fundamental to individual public and community health; and WHEREAS, on October 30, 1995, the Chairperson of the Board of Commissioners announced the formation of the Residential Water Task Force for the purpose of investigating current well water policies; and WHEREAS, the Residential Water Task Force, appointed on November 9, 1995, consisting of three commissioners, one representative of the Human Services Department, two registered well drillers, two township supervisors, one township code official, one realtor, one environmentalist and one citizen with well contamination, was charged with three primary tasks: 1. To review all statutes and county policies allowing and/or requiring county and local municipality responsibilities to protect, test or inspect single family home well installations and the water they provide, and to determine what the private sector requires for their participation 2. To identify and record substantiated problems, the type and number of documented occurrences, and the resulting problems they caused. 3. To evaluate what is currently being provided and make recommendations for improvements, establishing methods of evaluation for existing and recommended changes to guarantee accountability and quality assurance. WHEREAS, the Task Force's final recommendations passed the Public Services Committee and Board of Commissioners as part of Miscellaneous Resolution 96096 which directed the Oakland County Health Division to utilize the Final Recommendations of the Residential Water Task Force and report back to Public Services Committee on or before June 4, 1996; and WHEREAS, the Board of Commissioners has not been given the status of a number of the recommendations the Task Force made; and WHEREAS, municipalities have certified inspectors under the BOCA or State Building Code and some are currently performing well inspections, and/or requiring water samples to be taken on new homes; and Public Servic Committee WHEREAS, the Oakland County Board of Commissioners desires to help safeguard public health by working with local municipalities without usurping local power or authority and without government duplication. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approves the adoption of the attached "Oakland County Well Protection and Education Policy". Chairperson, on behalf of the Public Services Committee, I move adoption of the foregoing resolution. Oakland County Well Protection & Education Policy The following policies are to help protect the health and safety of the residents and future residents of Oakland County who rely on individual sources of potable water supply. SECTION 1 - Definitions Well - an opening in the surface of the earth for the purpose of removing fresh water or a test well, recharge well, waste disposal well, or a well used temporarily for dewatering purposes drilling construction. Extensive Charges or Repairs - Replacing the entire casing, removing a casing from the ground, changing aquifers, or replacing or drilling a new well. SECTION 2 - Well Education Packet Required Oakland County shall produce an educational packet and map of suspected contaminants by geographical area, general information on well drilling, maintenance, a list of licensed well inspectors and a list of pertinent phone numbers to assist persons requiring a new yell or extensive repairs. The Educational Packet shall be made available to Cities, Villages, Tovmships, and well drillers thr the purpose of distribution to interested citizens. It shall be a violation for any person or governmental entity to construct, or extensively change or repair, without first obtaining the education packet, including a map of suspected contaminants, and a list of licensed well drillers. 1•' SECTION 3 - Well Inspections by Local Code Enforcement Officials The Oakland County Health Division shall work with any city, village or township governments that have been approved by the State of Michigan to administer and enforce the building codes that are in effect in the State of Michigan. Test results required to substantiate the code requirements have been met (such as water tests) shell be conducted by state-certified laboratories or firms licensed by the state to carry out such work. Inspection reports of any suspected water or construction problems to be turned over to the Oakland County Health Division in a timely manner. Inspection documents shall be made available to Oakland County Health Division upon request. The Oakland County Health Division shall provide the city, village, and township municipalities with well abandonment forms and a procedure for notification to Oakland County. SECTION 4 - Advisory Committee An advisory committee shall be created composed of the following nine Oakland County citizens: There shall be four members that are well drillers that are registered and licensed by the State of Michigan. At least two of the tour well drillers shall be nominated from an extensive list provided by the local Well Drillers Association. One builder, licensed by the State of Michigan; an employee of the Oakland County Health Division, selected by the director; an employee of the Oakland County Drain Commissioner, selected by the Drain Commissioner; a non-elected appointee of the Board of Commissioners; one building official from communities which rely on well water for drinking, nominated by the Code Official Association and appointed by the County Executive, with the advice and consent of the Board of Commissioners. There shall be a three-year staggered term. The fist committee shall be appointed as follows: 3 for one-year term, 3 for a two-year term and 3 for a three-year term. The first term of office shall be considered to begin on January 1 1997. Duties The members of the Advisory Committee shall, as soon as appointed and once each year thereafter, organize and select a chairperson and vice chairperson from among their members. A recording secretary shall be assigned from the county government. The Advisory Committee shall meet no less than twice each year for the necessary conduct of business. Additional meetings may be called by the chairman or any three members of the Advisory Committee. The first meeting shall take place no more than 40 days after the enabling resolution passes the Oakland County Board of Commissioners to assist in consultation for implementing the Sanitary Code Well Protection & Education Policy. Five members shall constitute a quorum in order to conduct business. All meeting of the Advisory Committee shall be public in compliance with Act 267, P.A. 1976, as amended. The Oakland County Health Division, with the advice of the advisory committee, shall promulgate rules, materials, plans and procedures and administrative rules and update the educational packet annually. The Oakland County Board of Commissioners shall, by resolution, approve the rules, materials or administrative rules. SECTION 5 - Local Distribution In communities who have been approved by the State of Michigan to administer and enforce the building codes, the Oakland County Health Division shall work with cities, townships or village in distribution of well education packets or other activities within their jurisdictions. SECTION 6 - Special Studies Where evidence exists that indicates a need for special studies which relate to the contamination of private potable water supply, the Oakland County Health Division may participate upon the written request of the local building official(s) or affected property owner(s) and/or the advisory board may make recommendations on areas of Special Studies. SECTION 7- Fees The Oakland County Board of Commissioners may determine a fee to cover the cost for the well education packet. The Oakland County Health Division may otter the option of well inspections for new and previously owned homes for a fee. These fees shall be reviewed by the Board of Commissioners and established by resolution. SECTION 8 - Appeals Appeals of these articles or other articles of the Oakland County Sanitary Code which may pertain to the Well Protection & Education Policy may be made to the Oakland County Health Division staff and then to the Oakland County Sanitary Code Appeals Board or the Advisory Board. SECTION 8 - Effective Date This article shall take effect on . Allen, County Clerk VETO MESSAGE MR #96232 OAKLAND COUNTY WELL PROTECTION AND EDUCATION POLICY I have vetoed the "Oakland County Well Protection and Education Policy" because it fails to provide any protection for the hundreds of thousands of Oakland County residents who rely upon wells for their household and drinking water needs. At a time when actual events clearly demonstrate that strong medicine in the form of a proactive well inspection program is needed to protect our residential water supplies, MR 96232 offers an ineffectual placebo. It provides the illusion of action while in reality maintaining a flawed status quo. The problem is this. Prior to the Administration's September 19, 1996 decision to utilize existing resources to initiate a limited well inspection program (limited due to lack of resources,) few, if any, residential wells were inspected to insure compliance with either state law or local code. This problem exists at a time when decades of booming residential and industrial development have combined to create a county with both a substantial dependence on private wells and a small, but serious, groundwater contamination problem. Against this backdrop came the lesson and warning of the Twin Lakes Subdivision. Developed in 1993, Twin Lakes is located in Oxford Township, an area known to have isolated pockets of serious groundwater contamination. It has 74 homes on individual water supplies (wells). N Ultimately, over 58 requests for well inspections were received. ffi Investigation revealed that 57 of 58 wells, built by six different 1 contractors, had been improperly constructed. In many instanced -13 improper grouting (sealing) had allowed impurities to leech into water supply, exposing a neighborhood and aquifer to avoidable nd f) unnecessary risk. The dreams of Twin Lakes homeowners couldeasily have become never-ending nightmares. The potential for disaster is clear. Improper construction of wells has subjected our citizens to potentially serious health risks and imperiled A rn r— cal > fri X "Z E:3 -71 X Tc - 1 millions of dollars worth of new construction. County government cannot afford to ignore this warning. The Administration has not and will not ignore the warning. In 1994 and 1995, acting pursuant to our legislative mandate to prevent and control environmental health hazards, the Oakland County Health Division developed and proposed local health code regulations providing for the inspection of wells. The Division's proposal was rejected by the Board of Commissioners as too comprehensive, too intrusive in "local" affairs and too expensive. (Interestingly enough, the rejected plan became the blueprint for local well regulations adopted by the Macomb County Board of Commissioners. Those regulations, virtually identical to those the Health Division proposed, are in place today protecting Macomb County residents.) Recognizing the continuing need, and ever mindful of the warning of Twin Lakes, the Health Division developed and attempted to propose a leaner, more economical well protection program. This program contemplated local cities, villages and townships would inspect wells under their own codes, as long as those codes met minimum requirements imposed by state law. Developed as amendments to the Oakland County Sanitary Code, the Health Division's proactive proposal does four things: 1) requires well owners to notify the Health Division of the intent to construct, extensively repair or abandon a well; (This would allow the County to know where to inspect, to map well locations and enable an inventory of wells to be constructed.); 2) requires persons constructing, repairing or abandoning wells to obtain a educational packet. (This packet explains significant state well code requirements and contains other helpful information.); 3) requires the Health Division to either conduct well inspections or, in an attempt to avoid duplicating services that could be performed at the local level, to accept reports of inspection made by local officials pursuant to codes meeting minimum state requirements; and 4) creates a 9 member Oakland County Well Advisory Committee. Modeled after the state statute creating the state well advisory committee, this committee would be appointed by the 2 County Executive and confirmed by the Board of Commissioners. Unfortunately, this plan, developed by public health professionals with input from the Board's Residential Water Task Force, was not even allowed on any Board committee's agenda. This is an insult to professionals working in the Health Division. Instead, MR #96232 was moved and adopted. What does it do to protect? Essentially nothing. Not even purporting to be an amendment to the Sanitary Code, it attaches to nothing. It's main affirmative step is to make it a "violation" (of what is not clear), for a person to construct, extensively change or repair (presumably a well), without first obtaining a well education packet. No penalties for the "violation" are established. What doesn't MR #96232 do? The vetoed resolution does not require what is needed most: well inspections. "Twin Lakes" can certainly happen again. Chemical contamination can and undoubtedly will, go undetected. No inspections are required. .And note the attached surveys from representative Oakland County cities, villages and townships. They clearly indicate that those local units have no intention of inspecting wells. MR #96232 fails in other areas. It does not require notice of well construction, repair or abandonment. It does not contain the elements required by the State of Michigan under the Public Health Code that would allow the County to qualify for cost sharing. As a result, county taxpayers are denied the ability to recoup a substantial part of the costs of any well inspection program. Further, the vetoed resolution purports to give to the Board of Commissioners and an advisory committee dominated by special interests, (well drillers and builders), duties the Michigan Public Health Code assigns to local public health officials. MR #96232 even fails to set forth an effective date. I have vetoed MR #96232 because it is flawed technically, legally and practically. It ignores the lesson and the warning of the Twin Lakes Subdivision. It is an illusion of protection. It does not protect our citizens. It does not protect our water resources. It does not address the public health risks our county faces. Our citizens need effective well protection. MR #96232 does not provide it and should not become law. L.
