HomeMy WebLinkAboutResolutions - 1997.03.06 - 25105• MISCELLANEOUS RESOLUTION #97043 BY: Public Services Committee, Shelley Taub, Chairperson IN RE: PROSECUTING ATTORNEY - ACCEPTANCE OF STOP VIOLENCE AGAINST WOMEN GRANT FROM HAVEN (HELP AGAINST VIOLENT ENCOUNTERS NOW) TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Chairperson, Ladies and Gentlemen: WHEREAS HAVEN (Help Against Violent Encounters Now) has received a 1996- 1997 Federal Stop Violence Against Women grant; and WHEREAS included in the grant is $40,000 to fund Oakland County Prosecutor's office services for case prosecution, police training, coordination, statistical research and other services; and WHEREAS HAVEN has presented a proposal to award the County of Oakland $40,000 for these services; and WHEREAS the Prosecuting Attorney has agreed to provide these services; and WHEREAS one (1) additional Assistant Prosecutor II will be required to provide these services effective March 15, 1997; and WHEREAS acceptance of this agreement does not obligate the County to any future commitment; and WHEREAS the contract has been approved by the County Executive's Contract Review Process. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners accepts the funding for the Stop Violence Against Women program in the amount of $40,000 for the period October 1, 1996 through September 30, 1997, as detailed in the attached Memorandum of Understanding. BE IT FURTHER RESOLVED that one (1) full-time, special revenue funded, Assistant Prosecutor II position be created in the Prosecuting Attorney Litigation Division. BE IT FURTHER RESOLVED that the level of service, including personnel, be contingent upon continued grant funding. O'Brien II Prosecuting Attorney Chief Assistant PrOSeCutur County of Oakland MEMORANDUM OF UNDERSTANDING ADDENDUM This agreement is between the Oakland County Prosecutor's Office and HAVEN, Oakland County's domestic violence, sexual assault, and child abuse agency. As partners in the STOP THE VIOLENCE PROJECT, both parties agree to the following: Oakland County Prosecutor's responsibilities: 1. Prosecuting felony and misdemeanor domestic violence cases. 2. Conducting regular and frequent trainings for district court assistant prosecutors concerning prosecution of domestic violence cases. 3. Preparing a domestic violence prosecution manual for district and circuit court prosecutors. 4. Conducting regular and frequent police trainings concerning domestic violence laws and prosecution in conjunction with HAVEN staff. 5. Reviewing and coordinating district court compliance with requirements for reporting to Michigan State Police central records, deferrals of adjudications of guilt (MCL 769.4a) in domestic violence cases. 6. Reviewing and coordinating court procedures for tracking dispositions of domestic. violence cases (e.g., tracking domestic violence convictions, including those under city ordinance for enhancement purposes; tracking recidivism when domestic violence - offenders are sentenced to various batterer intervention programs). 7. Reviewing and coordinating court procedures for domestic violence bond conditions/violations (e.g., LEIN entry). 8. Oakland County Prosecuting Attorney, David G. HAVEN staff will jointly conduct regular and frequent police trainings with the prosecutor. 3. HAVEN staff will work with the prosecutor in the training of district court prosecutors and city attorneys. 4. HAVEN staff will provide ongoing support to victims of domestic violence throughout the criminal proceedings. 5. HAVEN agrees to provide $40,000.00 to fund the Oakland County Prosecutor's Office for Domestic Violence Case Prosecuting, Training, Coordination, Statistical Research, etc. 6. HAVEN agrees to adopt the Stop The Violence Project with the Oakland County Prosecuting Attorney Office. Date r •-c. FISCAL NOTE BY: FINANCE AND PERSONNEL COMMITTEE, SUE ANN DOUGLAS, CHAIRPERSON IN RE: PROSECUTING ATTORNEY - ACCEPTANCE OF STOP VIOLENCE AGAINST WOMEN GRANT FROM HAVEN (HELP AGAINST VIOLENT ENCOUNTERS NOW) TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Chairperson, Ladies and Gentlemen: Pursuant to Rule XII-F of this Board, the Finance and Personnel Committee has reviewed the above referenced resolution and finds: 1. The resolution authorizes acceptance of a $40,000 grant from HAVEN (Help Against Violent Encounters Now) for the provision of services associated with a Federal Stop Violence Against Women Grant by the Prosecuting Attorney's office. 2. The resolution also authorizes one (1)additional full-time special revenue funded Assistant Prosecutor II position to perform these duties at a total cost of $36,271 in salaries and fringe benefits for the remainder of FY1997. 3. Should the grant be renewed in FY1998 without an increase in funding, a grant match in the amount of $27,361 (at 1997 rates) would be required to fully fund the position. 4. The resolution does not oblige the County to any future commitment and the level of service, including personnel, is contingent upon continued funding. 6.
