IN RE: PERSONNEL DEPARTMENT -CHANGE TO MERIT RULE 5.4 - ELIMINATE RETAKES FOR
CONTINUOUS EXAMINATIONS
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Chairperson, Ladies and Gentlemen:
WHEREAS Merit Rule 5.4.1.4 currently allows candidates to ". . .retake a
continuous examination, either in an attempt to pass an examination previously
failed or to improve their score . . "; and
WHEREAS Merit Rule 5.4.1.4.4 enables applicants to " . review any
portion(s) of the examination prior to retaking that portion of the examination
. .", thereby permitting candidates to review and retake the same test to
better their score and resultant position on the eligible list; and
WHEREAS the enforcement of the aforementioned Merit Rules compromises the
validity of inferences drawn from selection test scores; and
WHEREAS it has become desirable to make changes in the wording of Rule 5.4
to eliminate retakes for continuous examinations as spelled out in the
attachments to this resolution, including the current and proposed wording; and
WHEREAS Section IV, Subsection A of the Merit System Resolution requires
that all changes in the rules and regulations of the Merit System shall be
submitted to the Board of Commissioners at a regular meeting of the Board and
shall become effective thirty (30) days after such meeting unless objection is
received in writing by the Chairperson of the Board of Commissioners, in which
case the objection shall become a matter of business at the next meeting of the
Board.
NOW THEREFORE BE IT RESOLVED that the reading and distribution of this
notice and the attached copies of proposed changes to Merit Rule 5.4, to all
commissioners present and absent, is considered as the official submission to the
Board of Commissioners of the described changes in Rule 5.4.
Chairperson, on behalf of the finance and Personnel Committee, I move the
adoption of the foregoing resolution.

PRESENT WORDING
5.4.1 Examinations may be announced as CONTINUOUS
EXAMINATIONS with applications being accepted until further
notice.
5.4.1.1 The statement that applications will be accepted until
further notice shall be clearly stated on the official
examination anntamcement and in the °Mend newspaper
announcements of the examination. Mere will he no
newspaper announcement for promotional examinations
5.4.1.2 Continuous examinations shall be administered
whenever sufficient applications have been received and as
the needs of the County Service dictate.
5.4.1.3 Successful candidates on continuous examinations
shall be added to the eligible list resulting from that
examination in meter of their total examination score,
regardless of when they took the examination, 'Me

5.4.1.4 A candidate may retake a continuous examination.

list. Candidates wishing to retake a portion or portions of an
examination must make a request in the Personnel
Department. An examination may be retaken only if the
examination is still open at the time of the request. A portion
or portions of an examination may only be retaken once.
5.4.1.4.1 A period of 30 calendar days must elapse
between the date any portion of the examination is
taken in the original attempt and the date that part is
taken again in the second attempt.
5.4.1.4.2 If the request for a second attempt is made
before 90 calendar days from the date of the original
attempt, the candidate may retake only a portion, or
portions, of the examination and use the higher of
the stoves on these sections to arrive at a new total
examination score.
5.4.1.4.3 If the request for a second attempt ii made
after 90 calendar days from the date of the original
attempt, the candidate must retake the entire
examination,
5.4.1,4.4 A candidate who chooses to review any
portion(s) of the examination results prior to
retaking that portion of the examination shall then
be required to wait a period of 30 calendar days
from the date of the exam review.
5.4.2 Continuous examinations shall be closed by the posting of a
fonnal notice, signed by the Personnel Director, on the official bulletin
board in the County Personnel Department, at least seven calendar
days in advance of the last dale for filing applications.
