Pemick IN RE: COMMUNITY MENTAL HEALTH CODE APPOINTMENT OF DIRECTOR TO: Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS, the State of Michigan's Mental Health Code, Act 258 of 1974, as amended, prescribes the powers and duties of certain state and local agencies and officials and certain private agencies and individuals to regulate agencies and facilities providing mental health services, and WHEREAS, Chapter 2 of the Mental Health Code provides that the "procedures and policies for a county community mental health agency shall be set by the board of commissioners" and that "the county board of commissioners shall determine the procedures and policies that shall be applicable to the agency," and WHEREAS, the Mental Health Code under Article 330.1226, Section 226(3) provides that "in the case of a county community mental health agency, the initial appointment by the board of an individual as executive director is effective unless rejected by a two-thirds vote of the county board of commissioners within 15 calendar days," and WHEREAS, the Oakland County Board of Commissioners feels that the public interest will be better served if the Board of Commissioners has an opportunity to either accept or reject both the appointment and re-appointment of the Executive Director of the County Community Mental Health agency. NOW, THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners supports an amendment to Article 330.1226, Section 226(3) of the Michigan Mental Health code deleting the word "initial" from line one and making the section read as follows: (3) In the case of a county community mental health agency, the appointment by the board of an individual as executive director is effective unless rejected by a 2/3 vote of the county board of commissioners within 15 calendar days. BE IT FURTHER RESOLVED that copies of this resolution be forward to the Michigan Department of Community Health, the Governor, the Michigan Legislature, the Michigan Association of Counties, the Michigan Association of Community Mental Health Boards and to Oakland County's legislative agents.
