HomeMy WebLinkAboutResolutions - 1998.02.12 - 25352MISCELLANEOUS RESOLUTION #98005 February 12, 1998 BY: FINANCE COMMITTEE, SUE ANN DOUGLAS, CHAIRPERSON IN RE: FACILITIES MANAGEMENT - FACILITIES ENGINEERING - AWARD OF CONTRACT - CONSTRUCTION OF 52-4 DISTRICT COURT - TROY To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS, Miscellaneous Resolution #96263 transferred funds in the amount of $4,700,000 for the design services and renovation of the new 52-4 District Court; and WHEREAS, in accordance with City of Troy bidding procedures, bids for the construction contract were received and opened by the City of Troy on November 6, 1997; and WHEREAS, the Facilities Engineering Division and the City of Troy staffs have reviewed all bids submitted and recommend that the lowest responsible bidder, Bell Company of Fraser, Michigan be awarded the construction contract in the amount of $4,125,000; and WHEREAS, the total project cost for the 1998 52-4 Troy District Court is estimated to be $5,500,000 which includes contingency amounts; and WHEREAS, remaining project costs included in the total project cost of $5,500,000, such as furniture, landscaping, and other miscellaneous costs will be bid through approved Purchasing Division procedures; and WHEREAS, funding in the amount of $4,200,000 for the project was included in the 1998 Capital Improvement Program. NOW THEREFORE BE IT RESOLVED AS FOLLOWS: 1) The construction contract proposal of Bell Company, in the amount of $4,125,000 be accepted through the City of Troy and the contract awarded in concurrence with Planning and Building Committee recommendations. 2) Funds be provided in the amount of $1,375,000 to cover the remaining project costs including Contingency. 3) Funds in the amount of $800,000 to supplement the $4,700,000 previously transferred per MR #96263 are available in the 1998 Capital Improvement Program to be transferred from the Building Improvement Fund (401) to the Major Projects Fund (406) for the 52-4 Troy District Court Project. FINMNCE COMMITTEE a Maw February 12, 1998 REPORT (Misc. #98005) BY: Planning and Building Committee, Charles Palmer, Chairperson RE: Construction of 52-4 District Court - Troy TO: THE OAKLAND COUNTY FINANCE COMMITTEE Chairperson, Ladies and Gentlemen: The Planning and Building Committee, having reviewed the need for new District Court space in Troy, recommends approval of the project as outlined in the Facilities Management Report dated January 27, 1998. The Committee further recommends an additional $800,000 in funding be provided to increase the project funding from $4,700,000 to $5,500,000. Also, the Committee further supports the recommendation for the City of Troy to award a construction contract in the amount of $4,125,000 to the Bell Company. Additionally, the Planning and Building Committee supports the attached Finance Committee Resolution. Chairperson, on behalf of the Planning and Building Committee, I submit the foregoing report. PLANNING AND BUILDING COMMITTEE 7d, 77, OAKLAND COUNTY EXECUTIVE DEPARTMENT OF FACILITIES MANAGEMENT FACILITIES ENGINEERING DIVISION Recommendation to Approve Award of Contract by City of Troy for Construction of 52-4 District Court - Troy Project 95-17 January 27, 1998 Background The 1998 Capital Improvement Program identifies the 52-4 District Court, Troy, as priority 2 of the Building Section. This project will provide a new facility for the Court through adaptive reuse and expansion of an existing building on the Troy Civic Center which formerly housed the Community Center. The court has outgrown the 10,089 square feet it occupies in City Hall, and 1,800 square feet leased for the Probation Unit in a building located about one mile away. The new 33,500 square foot facility will consolidate operations and provide the court with space sufficient to conduct business for the next 15 - 20 years. Room for future expansion exists. In March 1997, the Board of Commissioners passed Miscellaneous Resolution #97049 which provided $4,700,000 advanced funding for the project. Design was completed and the project let out for bids in October 1997. Bidding Construction bids were received by the City of Troy on November 6, 1997. Even though the City had prequalified twelve (12) bidders that indicated they would be bidding on the project, only four (4) bids were received. The low bid of $4,125,000 was received by the Bell Company. The bids are summarized in attachment "A." The bids were reviewed by the City of Troy, Oakland County, and the Architect and all parties are satisfied the Bell Company is the low responsible bidder. The Bell Company is holding its bid until February 19, 1998. Project Budget: In anticipation of the project exceeding the $4,700,000 funding, additional funding was requested and budgeted for in the 1998 Capital Improvement Program (C.I.P.). The total project costs after receipt of bids is now $5,500,000 which is $800,000 (17%) over the original project budget. CPASOATAFAC-PAGMTP&EMSOIP88624CONTAA0 ea` Page 2 The reasons for the project exceeding the original budget can be previously attributed to the following considerati6ns: 1. The original preliminary $4,700,000 budget for the project was established in the last quarter of 1996 and anticipated a 1997 construction schedule. The schedule is nearly a year behind and inflation in the construction industry has since risen an estimated 8.0%. 2. During the project design phase, the programmed space needs increased from 32,000 to 33,500 square feet which is a 4.7% increase. The increases were necessary to accommodate the following unforseen needs: a. Sizing one courtroom to accommodate a fourteen-member jury and a few additional spectator seats b. Increasing the jury assembly room to accommodate a larger jury call in order to seat the fourteen-member jury c. Increasing the entrance lobby to provide for future security screening equipment d. Additional modifications to all toilet rooms as required by ADA guidelines and Michigan Barrier Free requirements 3. Receipt of only four (4) bids clearly indicates construction activity remains high, with numerous major projects currently underway or ready for bidding in Southeast Michigan. This extraordinary level of construction usually results in providing contractors with numerous choices of projects to bid which results in reduced competition and higher bids. Recommendation It is the Department of Facilities Management's recommendation the Committee support our request to provide an additional $800,000 in funding for this project and, additionally, to support the recommendation for the City of Troy to award a construction contract in the amount of $4,125,000 to the Bell Company. Attached, for your review, is a draft report to the Finance Committee and the recommended Finance Committee resolution.
