HomeMy WebLinkAboutResolutions - 1998.06.11 - 25389MISCELLANEOUS RESOLUTION #98148 BY: Commissioner John McCulloch, District #22; Donald Jensen, District 415; Gilda Jacobs, District #23 and Eugene Kaczmar, District 4 24 IN RE: INFRASTRUCTURE FUND To the Oakland County Board of Commissioners Chairperson, Ladies, and Gentlemen: WHEREAS Oakland County has experienced tremendous growth in industrial, commercial and residential development during the past ten years; and WHEREAS the population in Oakland County has increased from 396,000 in 1950 to 1.2 million in 1998, and is projected to be 1.3 million in 2020; and WHEREAS from 1991 to 1997, Oakland County added an average of 22,400 jobs per year; and WHEREAS this phenomenal growth in population and employment has placed a strain on existing infrastructure and created a need for improvements to old infrastructure and construction of new infrastructure; and WHEREAS our expansion has unfortunately contributed to traffic congestion, increasing numbers of motor vehicle accidents, combined sewer and drain overflows, flooded basements and potentially hazardous conditions affecting public safety, health and the environment; and WHEREAS the Road Commission of Oakland County estimates that County roads alone need $1.5 billion dollars of improvements in the next ten year and the needs of each community are even greater; and WHEREAS the County will continue work with the Federal and State governments to increase our share of transportation dollars, we need to do more to help local communities address their road needs; and WHEREAS municipalities are also faced with a tremendous cost for replacing and expanding water and sewer systems, drains, dams and bridges; and WHEREAS the National Association of Counties estimates that cities, villages and townships will be required to spend $138 billion dollars over the next 20 years to comply with the 1997 amendments to the Safe Drinking Water Act; and WHEREAS the County cannot continue to grow without addressing our infrastructure needs; and WHEREAS Oakland County is able to use its financial resources to assist the communities in the County with their infrastructure needs without diminishing the outstanding level of service County residents require. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners establish an Infrastructure Fund for local cities and townships to apply for infrastructure grants in proportion to the 1998 taxable value paid by their communities (per the attached schedule); and BE IT FURTHER RESOLVED that the millage rate remain at 4.3505 mills, and .1605 be placed in an Infrastructure Fund for communities to apply for infrastructure grants; and BE IT FURTHER RESOLVED that $5 million dollars in interest earnings from the Delinquent Tax Revolving Fund also be placed in the Infrastructure Fund annually. BE IT FURTHER RESOLVED that the Department of Community and Economic Development administer the Infrastructure Fund in accordance with the attached policies adopted by the Oakland County Board of Commissioners. Chairperson, I move adoption of the foregoing resolution. etel 7Ø2 ck" z t, 17,1T/' C 104tivo POLICY FOR INFRASTRUCTURE FUND The Infrastructure Fund is established and shall be set up and maintained by the Fiscal Services Division as a separate fund for the purpose of enhancing the County's ability to compete in an international economy, serving as a catalyst for economic growth of the County and to improve the quality of life in the rural and urban areas of the County. Sec.1 As used in this Policy: Infrastructure means: roads, water and sewer systems, drains, dams and bridges. Sec.2 (1) Each fiscal year following the fiscal year in which the fund is created, the Board of Commissioners may appropriate by an ordinance or resolution adopted by a majority of the members elected and serving, tax revenue generated by up to .1605 mills and up to $5 million dollars of interest earnings from the Delinquent Tax Revolving Fund. (2) Limitations on fund. The amount of money in the fund shall not exceed 30% of the County's total taxable value for any one year. (3) Investment of fund. The money in the fund may be invested as provided by law and the earnings of the fund are to be returned to the Infrastructure Fund. (4) Disposition of excess in fund. If the money in the fund exceeds that permitted in subsection (2), the excess money shall be appropriated:in the County's next general fund budget, but shall not be appropriated to the fund. Sec. 3 (1) Money in the Infrastructure Fund may be appropriated by a resolution adopted by the Board of Commissioners, after review and recommendation by the Department of Community and Economic Development, for the following purposes: (a) Meet a particular infrastructure need that is shown to exist. (b) Have an immediate positive impact on the local community. (c from the Infrastructure Fund) Contribute to the economic development and redevelopment or areas having experienced or having potential for job loss. (d) Improve the safety or health of residents in the community. (e) Clean up a potential source of environmental contamination. (f) An immediate, nonspeculative opportunity for permanent job creation or retention and an increase in the tax base of the local area. (g) Negotiations between an appropriate public agency and a developer or business regarding a location or retention decision is in process at the time of application. (2) Monies from the Infrastructure Fund cannot be used for personnel or operations expenses. Sec.4 (1) An applicant shall submit an application for funding on a form approved by the Department of Community and Economic Development. (2) A city or township may submit an application. Two or more cities, townships, or county road or county drain agency or a combination of 2 or more of these units may jointly submit an application. (3) The applicant shall attach a copy of a resolution of support from the appropriate local unit of government. (4) Each city or township cannot receive a percentage from the fund which is greater than their proportionate share of total county taxable value. (5) The project shall relate to one or more of the categories described in section 3. (6) A municipality is given 2 years after the end of the period in which the application was made to actually expend the funds.
