IN RE: SHERIFF'S DEPARTMENT - Request for Oniformed Deputy presence at 48th District Court-Bloomfield Township To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS the Courthouse Security program, under the direction of the Sheriff was instituted in late 1992 at the Circuit COurt; and WHEREAS since 1992 this program has expanded to include security for the District Courts in Rochester Hills and Clarkston as Novi already had Court Security; and WHEREAS in 1996 the Friend of Court Division requested and received Court Security; and WHEREAS the 48th District Court in Bloomfield Township has requested that the Sheriff provide security to the Court with PTNE Court Security Deputies. WHEREAS a uniformed law enforcement preence would provide the ability to quickly respond to and control situations, minimizing the risk to both the public and District Court staff; and WHEREAS the Sheriff, under request from the 48th District Court, will require staff to provide security at their lOcation; and WHEREAS a contract to reimburse the 'County for this service will be necessary (see attached contract and Schedulq A); and WHEREAS the Sheriff requests that two 1 (2) PTNE Deputy positions will be necessary to provide adequate coverage at the 48th District Court location. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners authorize the creation of two (2) PTNE 1,000 hrs/yr Court Deputy positions in the Sheriff/Corrective Services-Satellites/Court Detention Unit (43412). BE IT FURTHER RESOLVED that the Chairperson of the Board be authorized to enter into a contract with the 48th District Court for this service. BE IT FURTHER RESOLVED that one portable hand held radio be added. Chairperson, we move the adoption of the foregoing resolution. Dan Devine, Districe*14, Thomas Law, District # 13 SCHEDULE A Sheriff Department Cost for Uniformed PTNE Deputies at 48th District Court Salaries & Fringes CoSt 2-PTNE Court Deputies positions (double fill=4 officers) 1,000 ea. at $11.44 per hr. $22,880 Fringes on PTNE (9.7%) 2,219 sub-total $25,099 Operating Portable radio ($46.73 per month) $ 561 Uniforms (4 @ $546 per yr.) 2,184 Deputy Supplies (4 @ $596) 2,384 Liability Insurance 1,947 sub-total $ t076 Total 14,115 CONTRACT TO PROVIDE COURTHOUSE SECURITY THIS CONTRACT entered into on the day of , 1998, between the COUNTY OF OAKLAND, a IVjichigan Municipal and Constitutional Corporation, 1200 North Telegraph Road, Pontiac, Michigan 48341 (hereinafter "COUNTY"), and the 48TH DISTRICT COURT, 4280 Telegraph Road, Bloomfield Hills, Michigan 48302-3200 (hereinafter "COURT"), for the purpose of providing Courthouse security for the 48th District Court pursuant to the following terms and conditions; and, WHEREAS, the Oakland County Sheriff is required to provide Courthouse security when requested by the District Courts of the Third Class; and, WHEREAS, the District Courts of the Third Class are required to pay for the Courthouse security so provided; and, WHEREAS, the 48th District Court has requested that the Oakland County Sheriff provide a part time non-eligible Deputy Sheriff for Courthouse security; NOW, THEREFORE, in consideration of the mutual convenants and agreements contained herein and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the COUNTY and the COURT agree as follows: (1) The Oakland County Sheriff will provide a certified part time non-eligible Deputy Sheriff for Courthouse security at the 48th District Court during normal COURT business hours; and, (2) The COURT will pay the COUNTY for the Deputy Sheriff at the rate of $12.55 per hour, which amount includes the hourly rate and required fringe benefits. The COURT will also pay a monthly operating fee of $589.66 to cover the cost of the Deputy Sheriffs uniforms, supplies, liability insurance, and portable radio, all of which are associated with the maintenance of the Deputy Sheriff provided to the COURT. Payments by the COURT to the COUNTY shall be made within 10 days of receipt of an invoice from the COUNTY for the hours worked, fringe benefits and operating costs of the Deputy Sheriff. (3) The term of this Contract shall be from the date first signed above until September 30, 1998. It is intended that this Contract will be renewed at the beginning of each fiscal year of the COUNTY, and that the hourly rate, fringe benefit rate and the monthly operating rate will be adjusted at that time by the COUNTY to reflect any increased cost to the COUNTY for providing a Deputy Sheriff to the COURT. The parties, through their representatives, warrant that they have full and complete authority to enter into, execute and perform this Contract. FISCAL NOTE (M.R. #98020) March 5, 1998 BY: FINANCE COMMITTEE, SUE ANN DOUGLAS, CHAIRPERSON IN RE: SHERIFF'S DEPARTMENT - REQUEST FOR UNIFORMED DEPUTY PRESENCE AT 48TH DISTRICT COURT-BLOOMFIELD HILLS TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Chairperson, Ladies and Gentlemen: Pursuant to Rule XII-F of this Board, the Finance Committee has reviewed the above referenced resolution and finds: 1. The 48th District Court in Bloomfield Hills has requested that the Sheriff provide security to the Court with PTNE Court Security Deputies. 2. The Sheriff Department recommends, with the concurrence of the Personnel Committee and the Public Services Committee, the creation of two (2) part-time non-eligible Court Deputy positions to cover the 48th District Court needs. 3. The Sheriff also recommends, with the Public Services Committee concurrence, that the Chairperson of the Board enter into a contract with the 48th District Court to reimburse Oakland County the personnel costs and operating costs incurred for providing this service. 4. For the balance of FY 1998 the personnel costs and operating costs equal $17,643; the costs for FY 1999 equal $32,175. 5. One-time capital cost for the related radio equipment equals $2,066. This will come from the contingency account. 6. The FY 1998 and FY 1999 budgets for the Sheriff's Department, Corrective Services Satellite Division - Court Detention Unit should be amended, as specified on the attached schedule. A sufficient majority having voted therefor, the reports were accepted. Moved by Millard supported by Obrecht the resolution be amended by adding a BE IT FURTHER RESOLVED paragraph, to read as follows: BE IT FURTHER RESOLVED that any future requests for courthouse security, after the 48th District Court in Bloomfield Township and 52nd-4th in Troy requests, be for full time positions only. Discussion followed. The Chairperson stated a 'YES' vote will add the paragraph to the resolution and a 'NO' vote will not.
