HomeMy WebLinkAboutResolutions - 1998.05.07 - 25454111 MISCELLANEOUS RESOLUTION #98104 May 7, 1998 BY: FINANCE COMMITTEE, SUE ANN DOUGLAS, CHAIRPERSON IN RE: FACILITIES MANAGEMENT - FACILITIES ENGINEERING DIVISION - AWARD OF CONTRACT -SERVICE CENTER ROADWAY IMPROVEMENT PROJECT To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS, on October 28, 1997, the Planning & Building Committee approved the County Executive's Facilities Engineering Division to receive bids from the Oakland County Road Commission for improving the County Service Center roads, including 1.)Jail Service Loop, 2.)Service Drive to Courthouse, 3.)Public Works Drive and 4.)Campus Drive north at Credit Union; and WHEREAS in accordance with bidding procedures, bids for this project were received and opened by the Road Commission on March 31, 1998; and WHEREAS the Oakland County Road Commission has reviewed all bids submitted and has recommended to Oakland County's Department of Facilities Management that the lowest responsible bidder, ABC Paving Company be awarded a contract in the amount of $329,705 to complete all phases of the project with the exception of lighting, irrigation and landscaping; and WHEREAS it is agreed by the Road Commission and Facilities Engineering that the excepted projects listed above should not be done until the road work is complete and will be bid by Facilities Engineering; and WHEREAS the total project cost for the 1998 County Service Center Road Improvements Project is estimated to be $556,000 which includes the road construction, parking lot lighting, lawn irrigation, landscaping and contingency amounts; and WHEREAS funding in the amount of $556,000 is available from the 1998 Capital Improvements Program Utility Section; and WHEREAS the Department of Facilities Management recommends that the County enter into a Cost Participation Agreement with the Road Commission of Oakland County for $362,700 which includes contingency and that the total cost of $556,000 be appropriated at this time. NOW THEREFORE BE IT RESOLVED AS FOLLOWS: 1) The Oakland County Board of Commissioners authorizes the transfer of $556,000 from the Capital Improvement Program Fund #401 to the Project Work Order Fund #404 to establish the 1998 Service Center Road Improvements Project. 2) The contract proposal of ABC Paving Company, in the amount of $329,705 be accepted through the Road Commission and the contract awarded in concurrence with Planning and Building Committee recommendations. 3) Funds be provided in the amount of $226,295 to cover the remaining project costs including contingency. 4) The Chairperson of the Board of Commissioners is hereby authorized and directed to execute an interagency agreement with the Oakland County Road Commission in accordance with the terms of the attached Cost Participation Agreement. APR-21-98 11:08AM FROM-RCOC PURCHASING 248-645-0452 1-011 P02/04 F-917 COST PARTICIPATION AGREEMENT COUNTY CAMPUS 1998 TOWNSHIP OF WATERFORD RCOC Project No. 44852 This agreement made and entered into this day of „ by and between the Board of Road Commissioners for the County of Oakland, Michigan, hereafter referred to as the Board, and the Oakland County Board of Commissioners for the County of Oakland, Michigan, hereafter referred to as the County, provides as follows . WIIEREAS, the Board and the County have programmed a project for the improvement and resurfacing of roads within the County Campus (See Exhibit "A"), hereafter referred to as the Project; and WHEREAS, the Board has assumed responsibility for all engineering and traffic costs of the Project; and WHEREAS, the County has authorized receipt of bids for the Projects; and WHEREAS, the County has requested individual review and approval over any cost increases greater than 10% of the bid price prior to authorization; and WHEREAS, the Board and the County have reached an understanding with each other regarding the Project and desire to commit that understanding to writing in this agreement; and WHEREAS, in the opinion of the Board and the County, such agreement is in the best interest of the public. NOW, THEREFORE, in consideration of the mutual covenants set forth herein and in conformity with applicable law, it is hereby agreed as follows: 1. The Board will undertake and complete Road Commission for Oakland County Project No. 44852 in conformance with plans and specifications prepared by the Board. 2. The County hereby approves the Project and the plans and specifications therefor . 3. The Board will be responsible for all engineering Costs 4. The County will be responsible for all contractor payments and contingency COSTS. 5 Cost increases greater than 10% of the bid price will be individually reviewed and approved by the Board and theCounty before authorization to proceed. 4PR-21-98 11:08AM FROM4C0C PURCHASING 248-645-0452 1-011 P 03/04 F-917 6. The total Project cost estimate is $432,100. 7 Upon execution of this agreement, and acceptance of the low bid ($329,705.10), the Board will invoice the County for 75% of their portion of the low bid (estimated at $247,279.00). 8. Upon completion of the Project, and final cost audits, the Board will invoice the County for the remainder of its portion of Project costs. 9. Upon receipt of said invoices, the County will pay to the Board the full amount thereof, within thirty (30) days of such receipt. The Committee further recommends funding the total project cost of $556,000 including contingency, be approved. Additionally, the Planning & Building Committee supports the attached Finance Committee resolution.
