MISCELLANEOUS RESOLUTION #98255

IN RE: (Support) HB5903, Increase Court Transcript Fees
To the Oakland County Board of Commissioners
Chairperson, Ladies and Gentlemen:
WHEREAS HB 5903, currently before the House Judiciary
Committee, seeks to amend the Revised Judicature Act by
increasing the fee paid to circuit court reporters or recorders
for court transcripts, and
WHEREAS HE 5903 would raise the fee for the original page
from $1.75 to $3.00 and subsequent pages from $.30 to $.50 per
page, and
WHEREAS, it has been 12 years since the current page rate
for transcripts was established.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board
of Commissioners does support the passage of HE 5903, and directs
the County Clerk to send certified copies of this resolution to
all of Oakland County's state legislators and legislative agents.
Chairperson, I move the adoption of the foregoing
resolution.

A SUMMARY OF HOUSE BILL 5903 AS INTRODUCED 6-2-98
The bill would amend the Revised Judicature Act to increase the fee paid to circuit court
reporters or recorders for court transcripts. Currently, the fee is set at $1.75 per original page
and 30 cents per page for each copy; the bill would increase these amounts to $3.00 per original
page and 50 cents per page for copies.

HOUSE BILL No. 5903

A bill to amend 1961 PA 236, entitled
"Revised judicature act of 1961,"
by amending section 2543 (MCL 600.2543), as amended by 1986 PA
308.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 2543. (1) The circuit court reporters or recorders
2 shall be entitled to demand and receive per page for a transcript
3 ordered by any person the sum of $1.75 $3.00 per original page
4 and -ae- 50 cents per page for each copy, unless a lower rate is
5 agreed upon. For a transcript ordered by the circuit judge,
6 reporters or recorders shall be entitled to receive from the
7 county the same compensation.
8 (2) Only if the transcript is desired for the purpose of
9 moving for a new trial or preparing a record for appeal shall the
10 amount of reporters' or recorders' fees paid for the transcript

1 be recovered as a part of the taxable costs of the prevailing
2 party in the motion, in the court of appeals or the supreme
3 court.
