JENSEN, DISTRICT #15 IN RE; ENVIRONMENTAL INFRASTRUCTURE FUND REIMBURSEMENT FOR PROJECT IN THE CITY OF BIRMINGHAM TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Chairperson, Ladies and Gentlemen: WHEREAS the Oakland County Board of Commissioners established an Environmental Infrastructure Funds and Disbursement Policy per Miscellaneous Resolution #99093 in an effort to increase the share of dollars flowing into infrastructure projects for the County and its cities, villages and townships (CVT's); and WHEREAS pursuant to the Disbursement Policy, City of Birmingham has submitted a resolution of authorization to the County for reimbursement of expenses incurred in connection with an eligible environment remediation of improvement project; and WHEREAS the City of Birmingham is requesting reimbursement for work related to improving the combined sewer systems connected to the Ridgedale Ave. and Chester St. Paving Project, hopefully reducing basement back-ups; and WHEREAS the City of Birmingham has requested reimbursement from the County in the amount of $118,027.36 for this particular project; and WHEREAS the current authorized amount of funding for the City of Birmingham is $118,027.36 from the Environmental Infrastructure Fund as repayment to the City of Birmingham for expenses incurred in connection with environmental remediation or improvement projects. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approves the improving the combined sewer systems connected to the Ridgedale Ave. and Chester St. Paving Project as eligible for reimbursement from the Environmental Infrastructure Fund. BE IT FURTHER RESOLVED that the Board authorizes the release of funds in the amount of $118,027.36 from the Environmental Infrastructure Fund (Account 4#90-263234-41000-3985)as repayment to the City of Birmingham for expenses incurred in connection with environmental remediation or improvement projects. Pontiac, MI 48341 RE: Environmental Infrastructure Fund Reimbursement Request Our Contract #3-99(P) Dear Mr. Ott, Pursuant to Oakland County Board of Commissioners Miscellaneous Resolution (MR) 99093, the City of Birmingham hereby requests reimbursement under Oakland County's Environmental Infrastructure Fund Program for expenses incurred in connection with an eligible environmental remediation or improvement project undertaken by our City. The project is known as the Ridgedale Ave. and Chester St. Paving Project, Contract #3-99(P). Essentially, all of Ridgedale Ave. and one block of Chester St. had their pavements improved as a special assessment district, at the request of the adjacent residents. The improvement entailed installing a permanent pavement in place of the original gravel and chip sealed road. As we routinely do, the City chose to improve the combined sewer systems on both streets to accommodate the 10-year storm design criteria. On Ridgedale Ave., 8" dia. combined sewers were replaced with 15" or 18" dia. sewers. On Chester St., a 36" dia. sewer supplemented an existing 15" combined sewer. In both areas, existing buildings in the adjacent and upstream areas will be significantly less prone to basement backup issues as a result of these improvements. Attached you will find the itemized pay estimate for this project, detailing different costs that have been incurred to date. Item Numbers 22, 23, and 24 demonstrate expenses incurred by the City in excess of our allotment. S118.027.36. Note that the City's sewer fund was scheduled to pay for these sewer expenses, not the special assessment district. Also attached is a copy of the applicable resolution passed by our City Commission. The City of Birmingham understands that the review and processing of this reimbursement request will be governed by the provisions of MR99093, and certifies that all expenses submitted for reimbursement were incurred with a qualifying environmental remediation or improvement project. Assistant Director of Engineering The following motion was adopted by the Birmingham City Commission on November 15. 1999 MOTION: Motion by Wooley, seconded by Chafetz: WHEREAS, upon the recommendation of the Oakland County Executive, the Oakland County Board of Commissioners has established an Environmental Infrastructure Fund Program to assist Oakland County cities, villages and townships in addressing clean water and storm water needs, and WHEREAS, Oakland County's Environmental Infrastructure Fund Program authorizes Oakland County cities, villages and townships to apply for reimbursement of eligible expenses incurred in connection with environmental remediations or improvements relating to ground and/or surface water, water supply, sewer and/or drainage systems and/or water pollution control efforts incurred as part of a city, village or township road project; and WHEREAS, THE City of Birmingham, Oakland County, Michigan has incurred expenses in connection with an environmental remediation or improvement project believed to be eligible for reimbursement under Oakland County's Environmental Infrastructure Fund Program. NOW, THEREFORE, BE IT RESOLVED that this commission authorizes and directs its city manager, as agent for the City of Birmingham, in the manner and to the extent provided for under Oakland County Board of Commissioners miscellaneous resolution 99093, to request reimbursement of $118,027.36 under Oakland County's Environmental Infrastructure Fund Program.
