NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approves the projects submitted by Waterford Township as eligible for reimbursement from the Environmental Infrastructure Fund. BE IT FURTHER RESOLVED that the Board authorizes an FY 1999 appropriation in the amount of $262,893.19, and an FY 2000 appropriation in the amount of $262,893.19, from the Environmental Infrastructure Fund (Account #90-263229-41000-3.985) to repay Waterford Township for expenses incurred in connection with environmental remediation or improvement projects, once proper invoices are presented. Telegraph Road Pontiac, MI 48341 RE: Environmental Infrastructure Fund Reimbursement Program Dear Mr. Ott: Pursuant to the Oakland County Board of Commissioners Miscellaneous Resolution (MR) 99093, the Charter Township of Waterford (Township) hereby requests reimbursement under the Oakland County Environmental Infrastructure Fund Program for expenses incurred in connection with eligible remediation or improvement projects undertaken by our Township. Per the program outline, it is our understanding the Township is eligible to receive approximately $262,894 per year from 1999 to 2003. Accordingly, funds available for 2000 should include the 1999 allocation and the Township should be eligible for approximately $525,788. •: 2_ :7? Projects currently being undertaken by the Township to receive funds are as follows: 1. McDowell Drive Sanitary Sewer Extension. This project will extend sanitary sewer along McDowell Drive from McCormick Drive to approximately 750 feet south and provide service for six (6) existing residences located on McDowell Drive. McDowell Drive extends along a peninsula surrounded by Scott Lake and its' adjacent wetland. The existing residences are served by septic systems that are subject to submergence by fluctuations in the elevation of Scott Lake. The As Bid cost for this project is $120,470 and does not include engineering and inspection costs which will be added to the final cost. 2. Lochaven Road Sanitary Sewer Extension. This project will provide sanitary sewer for three (3) existing residences located on Lochaven Road south of Cooley Lake Road. The existing septic systems currently serving these residences are located in wetlands and one of these systems has already failed. The project is being included with an existing sanitary sewer project on Lochaven Road north of Cooley Lake Road and has been contracted to cost S50,000 by the existing Contractor, Mago, Incorporated. This does not include engineering and inspection costs which will be added to the final cost. 3. Williams Lake Road Sanitary Sewer Extension. This project will provide sanitary sewer service for five (5) existing commercial properties located along Williams Lake Road between Pontiac Lake Road and M-59. These properties are partially in wetlands that are hydraulically connected to Pontiac Lake. The commercial businesses located on these properties are currently served by septic systems that are subject to submergence by changes in the water level of the wetland. The estimated construction cost cost of this project is $178,900 and does not include engineering and inspection costs which will be added to the final cost. 4. Lochaven Road Water Main Extension. This project will provide Water main for three (3) existing residences located on Lochaven Road south of Cooley Lake Road. The existing private wells currently serving these residences are failing and need to be replaced. The project is being included with an existing sanitary sewer project on Lochaven Road north of Cooley Lake Road and has been contracted to cost $41,000 by the existing Contractor, Mago, Incorporated. This does not include engineering and inspection costs which will be added to the final cost. Attachment A contains copies of the Township Board resolutions authorizing reimbursement for the above projects for your reference. Attachment B contains expense invoices for the above projects that the Township is seeking to be reimbursed on. As mentioned in the descriptions above, these projects are under construction or design and additional costs will be submitted for them as milestones are reached. The Township understands the review and processing of this reimbursement request will be governed by the provisions of MR 99093, and certifies that all expenses submitted for reimbursement were inclined in connection with a qualifying remediation or improvement project. e 4 el As such, the Township is seeking for reimbursement in the amount of $25;679.02 at this /-* time. The run will begin at Civic Center Drive and continue on Crescent, Tubbs, Hatchery and Jones Roads. All requirements had been met. Supervisor Innes presented Julieann with a plaque and offered congratulations. W.T. Board Meeting Minutes, May 8, 2000 3 The Waterford Police Benevolent Fund Association had applied to the Clerk for a Carnival License and all requirements had been met. Moved by Fortino, Supported by O'Shea, RESOLVED, to approve a Carnival License for the Waterford Police Benevolent Fund Association, June 6 through June 11, 2000 at 5481 Airport Road and direct the Clerk to issue the license. Motion carried unanimously. The following memo was received from Building and Engineering Director Doug Bradley and DPW Director Terry Biederman regarding the Oakland County Environmental Infrastructure Fund and the Lochaven Road Watermain Extension from Cooley Lake Road to South: The Oakland County Board of Commissioners established the Environmental Infrastructure Fund to assist local communities (Cities, Villages and Townships), throughout Oakland County, with water and sewer projects. The County Board of Commissioners has committed to providing this fund with $5,000,000.00 per year for each of fiscal years 1999, 2000, 2001, 2002 and 2003. The fund is allocated to individual local communities based on a formula involving the population and taxable base for each community. Waterford Township's share of the Environmental Infrastructure Fund is approximately $262,900.00 for each year of the program. The County Board of Commissioners has given the local units of government discretion in determining what projects will be eligible for reimbursement under this program. Once the local community has determined that a project is to be completed using the Environmental Infrastructure Fund a description of the project is submitted to the Oakland County Board of Commissioners for authorization. After authorization by the County Board, the local community will be reimbursed for the actual cost of the project based on invoiced amounts paid by the local community. The Waterford Township Board previously authorized use of the Environmental Infrastructure Fund for several projects including the installation of sanitary sewers along Lochaven Road from Cooley Lake Road to the southerly Township line. During the design phase of this project staff became aware that several of the existing private wells serving homes in the area were failing and would soon need replacement. Bradley/Biederman Memo continued In addition it was found that the existing private wells in the area are shallow in depth and therefore susceptible to contamination from the existing septic systems and other surface water sources. To address this situation and eliminate future concerns over contamination of drinking water at these homes the Engineering Department and the Department of W.T. Board Meeting Minutes, May 8, 2000 4 Public Works are recommending that an 8" diameter watermain be installed along Lochaven Road from Cooley Lake Road to the southerly Township line. Funds currently available through the Oakland County Environmental Infrastructure Fund will be utilized to cover the estimated $41,000.00 cost of this proposed watermain extension. In anticipation of the Township Board concurring with the above project recommendation, we have prepared the attached Resolution initiating the projects and authorizing Terry E. Biederman, DPW Director, as agent for Waterford Township as the responsible party for submitting reimbursement requests to the Oakland County Board of Commissioners. Waterford Township currently has a contract with Mago Construction for the installation of watermains along Lochaven Road, north of Cooley Lake Road. It is anticipated that Maga Construction will complete this work early this summer. To expedite the proposed project and to eliminate the costs associated with preparing bid documents, staff would recommend that a Change Order be issued, as part of this contract, for the extension of the watermain along Lochaven Road from Cooley Lake Road to the southerly Township line... The resolution follows here: RESOLUTION AUTHORIZING ENVIRONMENTAL INFRASTRUCTURE FUND REIMBURSEMENT REQUEST FOR LOCHAVEN ROAD WATERMAIN EXTENSION WHEREAS, upon the recommendation of the Oakland County Executive, the Oakland County Board of Commissioners has established an Environmental Infrastructure Fund Program to assist Oakland County cities, villages and townships in addressing clean water and storm water needs; and WHEREAS Oakland County's Environmental Infrastructure Fund Program authorizes Oakland County cities, villages and townships to apply for reimbursement of eligible expenses incurred in connection with environmental remediations or improvements relating to ground and/or surface water, water supply, sewer and/or drainage systems and/or water pollution control efforts incurred as part of a city, village or township road project; and WHEREAS the Charter Township of Waterford, Oakland County, Michigan will incur expenses in connection with the Lochaven Road Watermain Infrastructure Resolution Continued Extension Project, a project believed to be eligible for reimbursement under Oakland County's Environmental Infrastructure Fund Program. NOW THEREFORE BE IT RESOLVED that the Charter Township of Waterford Board authorizes and directs Terry E. Motion carried unanimously. ------- 6tv D The following memo was received from Supervisor Katherine Innes: As you know, long time resident and member of the Waterford Historical Commission, Shirley Richards, passed away last month. Her term on the Waterford Historical Commission did not expire until November of 2001. Chairperson Dorothy White has recommended Wendy Nolan for appointment to fill Shirley's term on the Commission. Wendy is very willing to serve out this term and will be an asset to the Commission. Based on the recommendation of Mrs. White, I am respectfully requesting that the Township Board approve the appointment of Wendy Nolan to the Waterford Historical Commission to complete the term of Shirley Richards, that term to expire November 15, 2001... The Supervisor presented the following resolution: RESOLUTION TO AMEND COURT EQUITY FUND DISTRIBUTION FORMULA WHEREAS: The Court Equity Fund was established by the statute (MCL 600.151b), and became effective October 1, 1996. Numerous court fees are deposited into the State Court Fund, with a majority of that revenue flowing through the Court Equity Fund. The Court Equity Fund also receives some additional sources of court revenue and a significant amount of state general fund dollars; and, W.T. Board Meeting Minutes, May 8, 2000 WHEREAS: Oakland County's District Courts contribute to the Court Equity Fund in two ways: (1) direct contributions to the Court Equity Fund from the $4.25 that is collected on every criminal and civil judgement, and (2) contributions to the State Court Fund, wherein 80% of these contributions are passed through the Court Equity Fund; and, WHEREAS: The State of Michigan's District Courts are divided into three classifications: 1st Class District Courts that consist of one or more counties in which each county is responsible for funding the district court; 2nd Class District Courts that consist of a group of political subdivisions within the county and the county is responsible for funding the district court; and 3rd Class District Courts that consist of one or more political subdivisions within the county and each political subdivision is responsible for funding the district court; and, WHEREAS: The complex statutory formula for distribution of the Court Equity Fund involves two factors: The caseload activity of the local Circuit and Probate Courts and the number of circuit, probate and district court judgeships allocated to each county; and, WHEREAS: Oakland County includes the 3'd Class District Court judgeships for purposes of receiving Court Equity Funds, but excludes 3r d Class District Courts from the distribution of those funds; and, WHEREAS: Oakland County has only 2"d and 3rd Class District Courts. rd Class District Courts were initially located in areas wtth low-density populations and were therefore unable to support their own courts due to smaller caseloads from which little revenue was generated. These 2"d Class District courts have now grown and currently are located in the developed communities of Clarkston, Novi, Rochester and Troy; and, WHEREAS: Oakland County's 2"d Class 52" District Courts have the added advantage of receiving funding from the Oakland County General Fund and the Court Equity Fund, to subsidize their court operations; and, WHEREAS: The local communities of the 52" District Courts receive revenue generated from their local District Courts and have no responsibility to contribute any revenue to court operating costs; and, District Court Resolution continued WHEREAS: Oakland County's 3' Class non-52" District Courts, located in Berkley, Bloomfield Township, Farmington, Ferndale, Hazel Park, Madison Heights, Oak Park, Pontiac, Royal Oak, Southfield, and Waterford Township, also contribute to the Court Equity Fund; and, WHEREAS: In Fiscal Year 1998/1999, Oakland County District Courts contributed $2.5 million to the Court Equity Fund of which $1.57 million (63%) was contributed by non-52 0d District Courts and $927,686 (37%) was contributed by the 52' District Courts; and, 7 W.T. Board Meeting Minikes, May 8, 2000 WHEREAS; WHEREAS: WHEREAS: WHEREAS: Oakland County receives nearly $6.5 million annually from the Court Equity Fund, none of which is made available to fund non-52"d District Courts. The burden of operating the non-52"d District Courts falls exclusively upon the local taxpayers; and, A serious inequity occurs when the non-52" District Courts do not benefit from receiving Court Equity Fund disbursements. The taxpayers within the non-52' District Court communities are adversely affected; and, There is no legal impediment to prevent Oakland County from disbursing a portion of the Court Equity Fund to the 3'd Class communities; and, Alternative distribution formulas must be explored that would at least minimize the inequity that the present method of funding courts has upon the residents, courts, and communities serviced by Oakland County's non-52" District Courts. NOW, THEREFORE, BE IT HEREBY RESOLVED: That the Charter Township of Waterford, Oakland County, State of Michigan, does hereby support a Court Equity Fund distribution formula that incorporates funding for the Oakland County 3rd Class District Courts; and, BE IT FURTHER RESOLVED; That a copy of this Resolution be sent to the Oakland County Board of Commissioners, State Representative Michael KowaII, and Senator Mat Dunaskiss. This Resolution made and adopted by the Waterford Township Board of Trustees on May 8, 2000. The following excerpts are from a memo received from Fire Chief Dave Yarber: We have reviewed the bids submitted (based on the architects drawing and items shown on the approved plans) and listened to the presentations given by the companies bidding on the furnishings for the new Fire, Police and DPW facilities. The facilities of the top two companies, Interior Dynamics, Inc. and Interior Systems Contract Group, were visited and references checked. All aspects of each company were considered in the final decision making process... After thoroughly reviewing the bids, we are recommending the Board award the contract for furnishings to Interior Systems Contract Group (ISCG). We are committed to working with Interior Systems Contract Group to stay within the costs estimates provided for these projects. Board meeting 4 The following resolution was presented; RESOLUTION SUPPORTING RESTORATION OF LOW POWER FM RADIO BROADCASTING WHEREAS, the Federal Communications Commission (FCC) is receiving public comments concerning a proposal to re-establish low power broadcasting services; and WHEREAS, allowing low power FM radio to return to airwaves will promote communications that better reflect the character needs to the local communities, NOW, THEREFORE, BE IT RESOLVED, that the Charter Township of Waterford encourages the FCC to restore approval of low power FM radio broadcasting, and BE IT FURTHER RESOLVED that copies of this resolution be transmitted to the Federal Communications Commission. The Oakland County Board of Commissioners recently established an Environmental Infrastructure Fund. This is a fund to assist local communities throughout Oakland County with water and sewer projects. The only restriction is the project must have a direct relation to the protection of ground water or surface water systems from contamination. Environmental Infrastructure Fund The County Board has committed to providing $5,000,000 per year, 1999-2003. Waterford's share of the fund for fiscal year 1999 is $262,893.19 and the same amount is expected in following years until the program is terminated. Township Engineer Doug Bradley and DPW Director Terry Biederman identified several projects for 1999, including McDowell Drive, Lochaven Road and Williams Lake Road sanitary sewer extensions. They requested the Board establish a line item for this fund under the General Fund Budget, with funding set at a minimum of $262,000 per year through 2003. July 26, 1999 W.T. The following memo was received from Fiscal and Human Resources Director Rob Seeterlin: Attached is a memo from Police Chief Paul Vallad requesting that the Community Service Officer (CSO) position be converted to a Dispatcher. Over the past several months I have worked with both Chief Vallad and Captain 8 July 26, 1999 W.T. Board meeting Wolf on this issue and the requested change is merited. The department no longer needs the Community Service Officer position. On the other hand, increased staffing of the emergency dispatch for Police, Fire and EMS is a crucial need. We are experiencing a high level of overtime in the dispatch area due to one vacancy and increased demands caused by the transfer of dispatch duties from the Fire Department and other operational changes. This overtime in many instances is being forced on employees and is creating additional stress and moral problems amongst the dispatchers. Chief Vallad and his staff are continuing to study the causes and possible solutions to the dispatch staffing and overtime problem. In the meantime the conversion of this one CSO position to a Dispatcher will help to provide adequate staffing and reduce the amount of overtime employees are being forced to work. In his memo Chief Vallad identifies the additional costs associated with this change. Due to delays in hiring employees in the Police Department and anticipated reductions in dispatcher overtime costs no budget amendment is necessary to make this change. A 0 FISCAL REPORT (M.R. #00313) December 14, 2000 BY: FINANCE COMMITTEE, SUE ANN DOUGLAS, CHAIRPERSON IN RE: ENVIRONMENTAL INFRASTRUCTURE FUND REIMBURSEMENT FOR PROJECT IN THE CHARTER TOWNSHIP OF WATERFORD - FY 1999 AND FY 2000 ALLOCATION TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Chairperson, Ladies and Gentlemen: The Finance Committee, having reviewed the above referenced resolution, reports as follows: 1. $262,893.19 annually is available in the Environmental Infrastructure Fund for FY 1999 and FY 2000, to reimburse Waterford Township for this project; no additional appropriation is required. 2.
