MISCELLANEOUS RESOLUTION #00325

IN RE: FIFTY-SECOND DISTRICT COURT - APPROVAL OF MAGISTRATE DANIEL A.
O'BRIEN
To the Oakland County Board of Commissioners
Chairperson, Ladies and Gentlemen:
WHEREAS the Oakland County Board of Commissioners has provided for
magistrates for the Fifty-Second District Court; and
WHEREAS the Judges of the Fifty-Second District Court have appointed
Daniel A. O'Brien to serve as a magistrate for the Fifty-Second District
Court; and
WHEREAS MCL 600.8501(1) provides that magistrate appointments be
approved by the County Board of Commissioners.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of
Commissioners hereby approves the appointment of Daniel A. O'Brien to act as
a magistrate for the Fifty-Second District Court.
Chairperson, I move the adoption of the foregoing resolution.

At present, I am engaged in criminal and civil trial litigation, as well as legal writing at the
trial and appellate court levels. Early in my legal career, I was exclusively engaged in
appellate writing as a research attorney and judicial clerk in the Michigan Court of Appeals.
I followed this with five years as an assistant prosecutor conducting felony and misdemeanor
trials, plus six months in the Prosecutor's appellate division. I also have an undergraduate
degree and four years work experience as an electrical engineer.

Primarily civil litigation defending property owners in personal injury lawsuits. Responsible
for entire defense of the lawsuit, including conducting discovery, settlement negotiations,
trial, and any appellate activity following conclusion of the litigation at the trial court level.
Criminal defense, primarily in misdemeanor cases.

Clerk to the Honorable Myron H. Wahls - 1989/90: Assisted with legal research and writing
of appellate decisions on appeals from circuit courts and probate courts of the state,
including all areas of criminal, civil and probate litigation, constitutional and statutory
analysis, and civil and criminal procedure.
Research attorney, prehearing division - 1988/89: Reviewed appeals as they entered the
appellate court system, and prepared detailed analysis and opinion report of each case
