MISCELLANEOUS RESOLUTION #00023

IN RE: SUPPORT OF HOUSE BILL 4752, SUPPORT REGULATION OF INTERNET
ALCOHOL SALE
To the Oakland County Board of Commissioners
Chairperson, Ladies and Gentlemen:
WHEREAS, despite a statewide ban on sellin g alcohol to minors, some
underage drinkers are circumventing this law throu gh the purchase of alcoholic
beverage via the Internet or through catalo gs, and
WHEREAS, such sales of alcohol, even to persons of le gal age, constitute
a violation of the Michi gan Li quor Control Code which re quires licensed
suppliers, wholesalers and retailers, and circumvents the tax structure on
alcoholic bevera ges, and
WHEREAS, HB4752, would specif y that the sale, deliver y and importation
of alcoholic li quor would include the sale, deliver y or importation of
alcoholic liquor transacted b y means of mail order, Internet, telephone,
computer device or other electronic means, be included in the Li quor Control
Act, and that the retailer would have to be licensed under the laws of
Michi gan, pay applicable taxes to the commission, comply with all prohibitions
on the sale of alcohol to minors, verif y the a g e of the individual purchasing
alcohol by obtaining the purchaser's driver license number, date of birth,
telephone number and address, and would have to maintain the information for
four years after the transaction, and
WHEREAS, HB 4752 would re quire that the shipping container identif y the
contents as CONTAINS ALCOHOLIC LIQUOR—MUST BE DELIVERED TO PURCHASER ONLY in
letters at least one inch hi gh, and would re quire the deliverer to verif y that
the purchaser is of le gal a g e to make such a purchase.
NOW THEREFORE BE IT RESOLVED that the Oakland Count y Board of
Commissioners hereby supports the passa ge of HB4752, as being in the best
interest of all of our citizens and conforms with Michi gan's zero tolerance
polic y on undera ge drinking .
BE IT FURTHER RESOLVED that the Count y Clerk forward certified copies of
this resolution to all Oakland Count y State Legislators, the Michigan
Association of Counties and the County's leg islative lobbyists.
Chairperson, on behalf of the General Government Committee, I move the
adoption of the foregoing resolution.

A sufficient majority having voted therefor, the resolutions on the Consent
Agenda were adopted and the reports were accepted.
