BLOCK GRANT (ONGOING GRANT)
To the Oakland County Board of Commissioners
Chairperson, Ladies and Gentlemen:
WHEREAS, pursuant to M.R. #96215, the Oakland County Board of
Commissioners originally accepted formula law enforcement block grant funding
from the U.S. Department of Justice; and
WHEREAS in August 1999, Oakland County applied for $178,923 in FY 1999
Law Enforcement Block Grant funding; and
WHEREAS the U.S. Department of Justice has awarded Oakland County
formula block grant funding, in the same amount as the application,$178,923,
for local law enforcement under the Omnibus FY 1999 Appropriations Act; and
WHEREAS the purpose of the formula block grant funding is to assist in
reducing crime and improving public safety; and
WHEREAS an Oakland County Advisory Board, created by M.R. #99198 and
required by the block grant program for review by recognized interests in
criminal justice and crime or substance abuse prevention and treatment, has
reviewed and recommended a project to capture the full federal allocation;
and
WHEREAS the grant award will support the Oakland County drug court
utilizing the full federal share allocation to the County of $178,923 and
requires a minimum of 10% in local matching funds; and
WHEREAS the County has budgeted a total match of $120,861, raising the
total program effort to $299,784; and
WHEREAS $99,654 of the required County match is available in the budgets
of the participating departments (Circuit Court, Community Corrections,
Sheriff, Prosecutor), the remaining $21,207 of the required match is
available from mediation funds under the Circuit Court, no additional
appropriation is required; and
WHEREAS this grant award will continue to fund the current drug court
operations including contractual services in the Circuit Court for visiting
judges as well as the salaries and fringe benefits of one (1) full time
eligible Court Clerk I position (#31105-07496) in the Circuit Court
Administration Division; one (1) Pretrial Services Investigator I position
(#17402-07363) in the Community Correction Division; one (1) Deputy I
position (#4312-07928) in the Sheriff Department; and, one (1) Assistant
Prosecutor II position (#4120103339) in the Prosecutor Office.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of
Commissioners accepts the FY 1999 Law Enforcement Block Grant funding from
the U.S. Department of Justice in the amount of $178,923.
BE IT FURTHER RESOLVED that the Chairperson of the Board is authorized
to execute the grant agreement and to approve grant extensions and revisions,
within fifteen (15) percent of the original award.
BE IT FURTHER RESOLVED that the FY 2000 Special Revenue budget be
amended, to match the latest award, as specified on the attached schedule.
BE IT FURTHER RESOLVED that the FY 2000 General Fund budget be amended,
as specified below, to authorize the use of Circuit Court mediation funds to
cover a portion of the required Circuit Court match:

The Omnibus Fiscal Year 1999 Appropriations Act, Public Law 105 -277, provides funds
for the implementation of the LLEBG Program, to be administered by BJA, U.S.
Department of Justice. The purpose of the LLEBG Program is to Provide units of local
government with funds to underwrite projects to reduce crime and improve public safety.
The LLEBG Program allows jurisdictions to find criminal justice initiatives in the
following seven purpose areas: supporting law enforcement; enhancing security measures;
establishing or supporting drug courts; enhancing the adjudication of cases involving
violent offenders; establishing multijurisdictional task forces; establishing community
crime prevention programs; and indemnification insurance.

Notice of Public Hearing
NOTICE IS HEREBY GIVEN that a Public Hearing will be held by the County of Oakland,
Michigan, on Thursday, November 18, 1999 at 9:45 a.m. local time, in the Oakland County
Board of Commissioners' Auditorium located at 1200 N. Telegraph Road, Pontiac. The Public
Hearing is for the purpose of receiving comments on a project to reduce crime and improve
public safety for which financial assistance in the amount of $178,923 is being sought under the
Fiscal Year 1999 Omnibus Appropriation Act, Local Law Enforcement Block Grant Program
from the U.S. Department of Justice.
At the Public Hearing, interested persons may submit orally or in writing evidence and
recommendations with respect to the proposed project. Additionally, written comments will be
accepted up to ten working days after the public hearing and may be submitted to: Local Law
Enforcement Block Grant Public Hearing c/o Fiscal Services Division at the address below. A
copy of the federal funding application for the proposed project will be available for public
inspection at the Oakland County Division Fiscal Services, EOB, 1200 N. Telegraph Road,
Pontiac, MI 48341. The application may be reviewed until December 2, 1999 on workdays
between the hours of 8:30 a.m. and 5:00 p.m.

COUNTY LOCAL LAW ENFORCEMENT BLOCK GRANT

Pursuant to Miscellaneous Resolution H95098, as amended, this report is being submitted for the
above referenced grant application:
I. The U.S. Department of Justice has notified Oakland County that formula block grant
funding is available for local law enforcement under the Omnibus FY 1999
Appropriations Act. - _
2. The purpose of the formula block grant funding is to assist in reducing crime and
improving public safety.
3. The original grant funding was approved by the Board of Commissioners under
MR# 96215.
4. The FY 1999 federal ongoing grant allocation is a 4.3% decrease from the FY 1998
federal allocation, and is less than a 15% variance from the adopted budget.
5. An Oakland County Advisory Board, created by /vIR# 99198 and required by the block
grant program for review by recognized interests in criminal justice and crime or
substance abuse prevention and treatment, has reviewed and recommended a project to
capture the full federal allocation. Please find this recommendation as Attachment A.
6. The grant funding will support the Oakland County drug court utilizing the full federal
share allocation to the County of $178,923. A minimum of 10% in local matching funds
is required in this grant program.
7. The project includes funding for drug court visiting judges contractual services. The
funding will also continue one (1) full time eligible Court Clerk I position in the Circuit
Court Administration Division; one (1) Pretrial Services Investigator I position in the
Community Correction Division; one (1) Deputy I position in the Sheriff's Department;
and, one (1) Assistant Prosecutor II position in the Prosecutor's Office.
8. This use of funding complies with the Local Law Enforcement Block Grant program.
guidelines. The project will begin I October 1999 with all funds expended within 24
months.
9. It is understood the four full time eligible positions funding by this grant will be
discontinued when the block grant funding for the positions is terminated or is no longer
available to the County.
10. The application this year is an electronic submission, which does not require signature. It
is additionally understood this Report authorizes the Department of Management and
Budget to electronic submit the grant application. Grant contract acceptance to will
require signature and will follow set Board procedures.
11. Submittal of this application does not obligate Oakland County to grant acceptance nor
any future commitment.

Pursuant to the guidelines and program re quirements presented by the U.S. Department of Justice, Bureau of Justice
Assistance, for the Local Law Enforcement Block Grant, we, the undersigned, have been desi gnated as the Advisory
Board for the purpose of reviewing the County of Oakland, Michigan, project for funding under the Local Law
Enforcement Block Grant Program. We are makin g a nonbinding recommendation for the use of the funds received
under this program. The Advisory Board includes representatives with a recognized interest in criminal justice and
crime or substance abuse prevention and treatment, as stipulated under the grant program guidelines.
This is to certify we have reviewed the project under consideration for funding, and by a majority vote are
the U.S. Bureau of Justice Assistance under the Local Law Enforcement recommending an application be made to

Acceptance of this Award and special conditions DOES NOT result in an automatic
payment of block grant funds. BJA requires that all grantees return to the Grants
Management System (GMS) in late January to begin the Request For Drawdown
(RFD) phase of the Award process. Please take time over the next several months to
plan a detailed budget and comply with your special conditions.

This function will provide you with the ability to correct and/or update the spelling of
your jurisdiction's name and mailing address. BJA will consider these adjustments an
"Accept with Change" and will require no additional information from you to accept
this Award.
O Change Chief Executive Information - Requiring Additional BJA Review/Approval
This function allows you to make changes to the Chief Executive's (CE) name and
title. BJA will consider this to be a "Change Requiring Additional BJA
Review/Approval." Once you have submitted your changes, BJA will not provide you

Special Conditions - Oakland County
Local Jurisdiction in compliance w/PSOHB
1. The recipient agrees to comply with the financial and administrative requirements set forth in the current
edition of the Office of Justice Programs (OJP) Financial Guide.
2. The recipient agrees to comply with the organizational audit requirements of OMB Circular, A-133, Audits of
States, Local Governments and Non-Profit Organizations, as further described in OJP's Financial Guide,
Chapter 19.
3. The recipient shall submit one copy of all reports and proposed publications resulting from this agreement
twenty (20) days prior to public release. Any publications (written, visual, or sound), whether published at
the recipient's or government's expense, shall contain the following statement: (NOTE: This excludes press
releases, newsletters, and issue analysis.)
"This project was supported by Grant No. 1999-LB-VX-8643 awarded by the Bureau of Justice Assistance,
Office of Justice Programs, U.S. Department of Justice. Points of view in this document are those of the
author and do not necessarily represent the official position or policies of the U.S. Department of Justice."
4. The recipient agrees to provide information required for any national evaluation conducted by the U.S.
Department of Justice.
5. The recipient acknowledges that failure to submit an acceptable Equal Employment Opportunity Plan (if
recipient is required to submit one pursuant to 28 CFR 42.302), that is approved by the Office of Civil
Rights, is a violation of its Certified Assurances and may result in funds from the award being frozen, until
such time as the recipient is in compliance.
6. The recipient agrees to provide and expend a 10 percent cash match (calculated as 1/9 of the Federal
award amount) before the end of the 24 month grant expenditure period. The recipient is reminded that the
matching funds are auditable under Special Condition #2, and will be binding to the recipient.
7. The recipient is required to establish a trust fund account. This fund may not be used to pay debts incurred
by other activities beyond the scope of the Local Law Enforcement Block Grants Program. The recipient
also agrees to expend the grant funds in the trust fund (including any interest earned) during the 24 month
grant expenditure period. Grant funds (including any interest earned) not expended by the end of the 24
month period must be returned to the Bureau of Justice Assistance (BJA) along with the final submission of
the Financial Status Report (SF-269A) by the end of the 27 month.
8. The recipient agrees, if the funds are used for the hiring and employing of new, additional law enforcement
officers and support personnel, as described in the applicable purpose area of Subpart A section 101(a)(2),
that the recipient unit of local government will achieve a net gain in the number of law enforcement officers
who perform non-administrative public safety service.
9. The recipient agrees, if the funds are used for the hiring and employing of new, additional law enforcement
officers and support personnel, that the unit of local government will establish procedures to give members
of the Armed Forces who, on or after October 1, 1990, were or are selected for involuntary separation (as
described in section 1141 of Title 10, United States Code), approved for separation under section 1174a or
1175 of such title, or retired pursuant to the authority provided under section 4403 of the Defense
Conversion, Reinvestment, and Transition Assistance Act of 1992 (division D of Public Law 102-484; 10
U.S.C. 1923 note), a suitable preference in the employment of persons as additional law enforcement
officers or support personnel.
10. The recipient agrees, if funds are used for enhancing security or crime prevention, that the unit of local
government - -
(a) has an adequate process to assess the impact of any enhancement of a school security measure
that is undertaken under subparagraph (B) of section 101(a)(2), or any crime prevention programs that
are established under subparagraphs (C) and (E) of section 101(a)(2), on the incidence of crime in the
geographic area where the enhancement is undertaken or the program is established;
(b) will conduct such an assessment with respect to each such enhancement or program; and
(c) will submit to the BJA an annual assessment report, via the Internet system.
11. The recipient agrees that prior to expenditure of any LLEBG funds, at least one (1) public hearing will be
held regarding the proposed use(s) of the grant funds. The recipient must also provide verification to BJA

the public hearing. At the hearing, persons shall be given an opportunity to provide written and oral views to
the recipient on the proposed use(s) of the grant funds. The recipient will hold the public hearing at a time
and place that allows and encourages public attendance and participation. The recipient may not request a drawdown of funds until these requirements are met and the formal budget allocations are adopted by the
recipient.

12. The recipient agrees that prior to expenditure of any LLEBG funds, a previously designated or newly

FOR LOUISIANA PARISH RECIPIENTS:
The recipient agrees that prior to expenditure of any LLEBG funds, a previously designated or newly
established advisory board will meet to discuss the proposed use(s) of the grant funds. The recipient will
designate the advisory board to make binding recommendations on the use(s) of funds under the LLEBG
Program. Membership on the advisory board must include a representative from the following; however it
may be broader:
a) the local police department or sheriffs department;
b) the local prosecutor's office;
c) the local court system;
d) the local school system; and
e) a local nonprofit, educational, religious:or community group active in crime prevention or drug use
prevention or treatment.
The recipient may not request a drawdown of funds until these requirements are met and the formal budget
allocations are adopted by the recipient.
13. The recipient has certified it is in compliance with the Public Safety Officers' Health Benefits Provision of the
Omnibus Consolidated and Emergency Supplement Appropriations Act for 1999 and agrees to remain in
compliance during the life of the award. This provision requires that the unit of local government which
employs a public safety officer (as defined by section 1204 of Title I of the Omnibus Crime Control and Safe
Street Act of 1968, as amended) to afford such public safety officer who retires or is separated from service
due to injury suffered as a direct and proximate result of a personal injury sustained in the line of duty while
responding to an emergency situation or hot pursuit (as such terms are defined by State law) with the same
or better level of health insurance benefits at the time of retirement or separation as they received while on
duty. If the recipient demonstrates noncompliance during the life of the award, 10 percent of the award
amount must be returned to BJA
14. Criminal Intelligence Systems operating with support of Federal funds, must comply with 28 CFR, Part 23, if
the recipient chooses to implement this project.
15. At the Request for Drawdown, the recipient must submit to BJA a budget for approved purpose area
allocations via the Internet system.
16. The recipient agrees this award document constitutes the obligation of Federal funds for use by the
recipient in execution of the program or project covered by the award. Such obligation may be terminated
without further cause if the recipient fails to affirm its timely utilization of the award by accepting the award
and special conditions (within 45 days) from the date of award.

17. The recipient agrees to one 24 month obligation and expenditUre period that will begin on the day of the
recipient's submission of a Request for Drawdown through the Internet system. All funds must be expended
by the end of this 24 month period with no exceptions. Six months from the date of the beginning of the
expenditure period, the recipient agrees to submit a semiannual progress report through the Internet
system, and to report every six months until all funds are expended or the grant period ends.
