RE: MR #00017 SUPPORT OF SENATE BILL'S 398 AND 399 — ICE FISHING RESCUE FINES

Chairperson, Ladies and Gentlemen:
The General Government Committee having reviewed the above-mentioned resolution on February 28, 2000,
recommends to the Oakland County Board of Commissioners the resolution be adopted.
Chairperson, on behalf of the General Government Committee, I move the acceptance of the foregoing report.

MISCELLANEOUS RESOLUTION #00017

RE: SUPPORT OF SENATE BILL'S 398 AND 399 -- ICE FISHING RESCUE FINES
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
MR. CHAIRMAN, LADIES AND GENTLEMEN:
WHEREAS, the cost to local government agencies for the rescue of winter-sports
enthusiasts who fail to heed warnings about dangerous ice conditions is high both in
monetary costs and in endangerment of the public servants who must perform the rescue;
and
WHEREAS, SB 399 would amend the Natural Resources and Environmental
Protection Act to establish civil penalties for individuals who have to be rescued for
venturing onto the ice for any ice sport, if the conditions are such that a reasonable person
would have concluded that the ice is unsafe based on observable, reported or posted
information; and
WHEREAS, while most people who engage in winter sports are cautious and
responsible, those few who continue to ignore warnings, place both themselves and their
rescuers at great risk; and
WHEREAS, under SB 388 the fine for the first infraction is $5.00, plus court
costs, the second infraction is $200 plus court costs and the third and subsequent
infractions are $500, court costs and a three-year suspension of ice-fishing privileges; and
WHEREAS, SB 398 is tie-barred to SB 399, and amends L.E.I.N. rules to include
these infractions on the L.E.I.N. system; and
WHEREAS, the Oakland County Sheriff supports the passage of these bills.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of
Commissioners does hereby support passage of SB 398 and SB 399, and directs the
County Clerk to send certified copies of this adopted resolution to all of the County's
State Legislators, Macomb and Wayne County Board of Commissioners, to the Michigan
Association of Counties and to Oakland County's lobbyists.
Mr. Chairman, I move the adoption of the foregoing resolution.

Moved by Taub supported by Coleman the General Government Committee Report
be accepted.
A sufficient majority having voted therefor, the report was accepted.
Moved by Taub supported by Coleman the resolution be adopted.
Moved by Coleman supported by McPherson the resolution be amended, as
follows:
In the title, delete the word " FISHING" so the title reads " _ICE
RESCUE FINES" ; and
In the 4th WHEREAS paragraph, delete the word " -fishing" so the
paragraph reads " _three-year suspension of ice privileges; and" .
A sufficient majority having voted therefor, the amendment carried.

A sufficient majority having voted therefor, the resolution, as amended,
was adopted.
