HomeMy WebLinkAboutResolutions - 2000.11.01 - 26183MISCELLANEOUS RESOLUTION #00279 November 2, 2000 BY: FINANCE COMMITTEE, SUE ANN DOUGLAS, CHAIRPERSON IN RE: DEPARTMENT OF COMMUNITY AND ECONOMIC DEVELOPMENT / SOLID WASTE DIVISION - ACCEPTANCE OF U.S. ENVIRONMENTAL PROTECTION AGENCY BROWNFIELD ASSESSMENT DEMONSTRATION PILOT FUNDING TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Chairperson, Ladies and Gentlemen: WHEREAS pursuant to M.R. #99252, "Board of Commissioners - Amendments to the Grants Procedures", the Solid Waste Division of the Department of Community and Economic Development applied to the U.S. Environmental Protection Agency (EPA) for federal Comprehensive Environmental Response, Compensation, and Liability (CERCLA)funds in the amount of $250,000, $200,000 for brownfield assessment and $50,000 for greenspace development; and WHEREAS the EPA has awarded Oakland County a $250,000 grant, the same amount as the application, for the period September 25, 2000 through September 24, 2002; and WHEREAS funds will be used to reimburse the County for the required grant administrative support as well as covering travel expenses to meetings and conferences, equipment and supplies, legal services, and contractual services for an environmental consultant, as detailed on the attached schedule; and WHEREAS grant funds will cover 100% of the program cost, no General Fund / General Purpose appropriation is required; and WHEREAS acceptance of this grant does not obligate the County to any future commitments. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners accepts the CERCLA fund grant from the U.S. Environmental Protection Agency in the amount of $250,000. BE IT FURTHER RESOLVED that the Board Chairperson is authorized to execute the grant agreement and to approve grant changes and extensions, within 15 percent of the original award, which are consistent with the original agreement. BE IT FURTHER RESOLVED that continuation of this program is contingent upon continued funding from the grantor agency. BE IT FURTHER RESOLVED that the FY 2001 Special Revenue budget be amended to match this new award. Chairperson, on behalf of the Finance Committee, I move adoption of the foregoing resolution. MIIE/WBE - FAIR SHARE In accordance with EPA's Program for Utilization of Small, Minority and Women's Business Enterprises in procurement under assistance programs, the recipient agrees to: a) Accept the applicable FY 2000 "fair share" goals negotiated with EPA by the Michigan Department of Environmental Quality as follows: MBE WBE Combined Rate 4% 4% If the recipient does not want to rely on the applicable States MBE/WBE goals, the recipient agrees to submit proposed MBE/WBE goals based on availability of qualified minority and women-owned businesses to do work in the relevant market for construction, services, supplies and equipment. "Fair share" objectives must be submitted to Robert Richardson, the MBE/WBE Coordinator) within 30 days of award and approved by EPA no later than 30 days thereafter. b) Ensure to the fullest extent possible that at least the applicable "fair share" objective see a) above of Federal funds for prime contracts or subcontracts for supplies, construction, equipment or services are made available to organizations owned or controlled by socially and economically disadvantaged individuals, women and historically black colleges and universities. c) Include in its bid documents applicable "fair share" objectives see a) above and require all of its prime contractors to include in their bid documents for subcontracts the negotiated fair share percentages. d) Follow the six affirmative steps stated in 40 CFR 30.44(b), 40 CFR 31.36(e), 35.3145(d), or 35.6580, as appropriate e) For assistance awards for continuing environmental programs and assistance awards with institutions of higher education, hospitals and other non-profit organizations, submit an EPA Form 5700-52A, "MBE/WBE Utilization Under Federal Grants, Cooperative Agreements and Interagency Agreements" to the EPA Award Official by October 30 of each year. Other program reports must be submitted to the award official within 30 days of the end of the Federal fiscal quarter (January 30, April 30, July 30, and October 30). 0 In the event race and/or gender neutral efforts prove to be inadequate to achieve a fair share objective for MBE/WBEs, the recipient agrees to notify EPA in advance of any race and/or gender conscious action it plans to take to more closely achieve the fair share objective. 8) Until the recipient has completed its fair share negotiations with EPA, it agrees to apply the main state Agency's fair share objectives. Once the recipient has completed its fair share negotiations with EPA, it will apply those objectives. The recipient also agrees to include in its bid documents the applicable FY 2000 "fair share" objectives and require all of its prime contractors to include in their bid documents for subcontracts the applicable FY 2000 "fair share" percentages and to comply with paragraphs (c) through (e) above. 2. HOTEL AND MOTEL FIRE SAFETY ACT OF 1990 The recipient agrees to ensure that all conference, meeting, convention or training space funded in whole or in part with Federal funds, complies with the Hotel and Motel Fire Safety Act of 1990. 3. QUALITY ASSURANCE PROGRAM PLAN A Quality Assurance Project Plan (QAPP) must be submitted to EPA at least 90 days prior to the planned start date for field sampling, and field sampling must not commence until approval of the QAPP is obtained from EPA. Costs associated with environmental measurement or data collection for monitoring are not allowable costs unless a QAPP and sampling plan are submitted and approved, nor will such costs be reimbursed. In the event a generic, multi-site QAPP is submitted and approved, site-specific sampling plans for each assessment will need to be submitted 14 days prior to the planned start date for field sampling. The site sampling must include a site specific health and safety plan. 4. RECYCLED PAPER Pursuant to EPA Order 1000.25, dated January 24, 1990, the recipient agrees to use recycled paper for all reports which are prepared as a part of this agreement and delivered to the Agency. This requirement does not apply to reports which are prepared on forms supplied by EPA. This requirement applies even when the cost of recycled paper is higher than that of virgin paper. 5. REPORTING - QUARTERLY Programmatic and financial status reports will be submitted to U.S. EPA on a quarterly basis, within 30 days following the end of the quarter. Final financial status reports will be submitted when all encumberances are liquidated. In describing the work accomplished during the reporting period, recipients are encouraged to describe related brownfields efforts in their quarterly reports; however, the report must clearly delineate which tasks are funded by the cooperative agreement and which items are funded from other sources. 6. SMALL BUSINESS IN RURAL AREAS By accepting this agreement, the recipient agrees to comply with Section 129 of Public Law 100-590, the Small Business Administration Reauthorization and Amendment Act of 1988. Therefore, if the recipient awards a contract under this assistance agreement, it will utilize the following affirmative steps relative to Small Business in Rural Areas (SBRAs): a. Placing SBRAs on solicitation lists; b. Ensuring that SBRAs are solicited whenever they are potential sources; c. Dividing total requirements when economically feasible, into small tasks or quantities to permit maximum participation by SBRAs; d. Establishing delivery schedules, where the requirements of work will permit, which would encourage participation by SBRAs; e. Using the services of the Small Business Administration and the Minority Business Development Agency of the U.S. Department of Commerce, as appropriate; and f. Requiring the contractor, if it awards subcontracts, to take the affirmative steps in subparagraphs a. through e. of this condition. 7. YEAR 2000 COMPLIANCE Your Assistance Agreement may produce electronic date-sensitive data or systems that use such data. Any information technology purchased, produced, submitted or exchanged under this representation of calendar dates (EPA Directive 2100, IRM Policy Manual, Chapter 5, Data Standards). Information technology acquired under this agreement should be consistent with the technical Year 2000 requirements as described in the Federal Acquisition Regulation 39.002. Oakland County Brownfield Initiative USEPA Brownfield Assessment Demonstration Pilot October 2000-September 2002 and Beyond Cooperative Agreement Work Plan Introduction The Oakland County Brownfield Initiative is designed to protect the unique water features of the area and encourage the economic vitality of its mature core cities by addressing historic contamination caused by typical industrial developments and orphan landfills. Identified locations currently include mixed industrial use and wholesale/retail facilities in the mature cities of Pontiac, Oak Park, Hazel Park, Royal Oak and Rochester, and the Village of Holly, along with unique green space redevelopment opportunities in Pontiac-sunlighting a downtown river. Orphaned landfill sites, of which there are over 60 known sites in Oakland, will also be a focus of inquiry and activity. The County will conduct as many Phase I assessments as possible, and will typically add title quality, tax delinquency and nuisance identification to these assessments. The County will aggressively seek private funding for these and the anticipated Phase II assessments which will follow, using this grant to serve as a laboratory for the concept that removing some and then sharing some risk with the development and investment community is good business, good community development and good for the environment. Selected properties which may have negative value even in strong markets will be the focus of additional effort and grant resources to bring these properties into use, and to explore and produce creative solutions for redevelopment. Significant effort will go into creating a backbone of technical and administrative know-how which will entice the significant economic firepower of Oakland County investors to not leave anyone behind. Oakland will work with its 61 communities to ensure that local efforts continue, and are supported by the fmancial and administrative strength of the County. The Oakland County Brownfield Initiative will build local capacity for communities to undertake redevelopment projects and County's ability to assist communities, raise monies and educate the public about Brownfield Issues. An ongoing inventory and assessment of all potentially developable sites, and the capability to do it is the ultimate objective. Task 2: Community Outreach and Redevelopment To assure active implementation of Tasks 1 and 3, and develop community support, County project team will educate elected officials, administration and general public, including project specific and general brownfield information. To ensure long-term program development, County project team will actively train, assist and support municipal practitioners who will assist in identifying, conducting and maintaining the site inventory for the project and beyond.. The County will also develop working relations to assist in financial analysis and reuse planning to ensure project success and continuing brownfield redevelopment efforts.. County will consult with advisory board to select projects which meet critical waterways, urban vitality, and project viability priorities, along with other detailed criteria set forth in the grant application and as developed from community feedback. This funding is 100% federal program money, and does not require local matching funds. 6) No new personnel will be needed to complete the project in the grant application. 7) The Solid Waste Division is acting as fiduciary and lead agency for the grant. I found none in the Cooperative Agreement I assume that you have taken note of the Administrative Conditions set forth at pages 4 and 5 of the Cooperative Agreement which include utilization of minority contractors, the submittal of a quality • insurance program plan (which should be done by an 'environmental consultant), and the reporting requirements. in summary, I see no reason why the County should not execute the Cooperative Agreement submitted by U.S. EPA, Region 5.
