PERSONNEL COMMITTEE Personnel Committee Vote: Motion carried on unanimous roll call vote with Moffitt and Buckley absent PUBLIC SE S COMMITTEE MISCELLANEOUS RESOLUTION #00216 August 24, 2000 BY: PUBLIC SERVICES COMMITTEE, FRANK MILLARD, CHAIRPERSON IN RE: PROSECUTING ATTORNEY - FY2001 COOPERATIVE REIMBURSEMENT PROGRAM (CRP) CONTRACT APPLICATION/ACCEPTANCE TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Chairperson, Ladies and Gentlemen: WHEREAS the Family Independence Agency of the State of Michigan has awarded the Office of the Prosecuting Attorney funding in the amount of $1,774,830 for the period October 1, 2000 through September 30, 2001; and WHEREAS notification of available grant funding was received May 5, as attached, but delay of information to complete and return the application to the State necessitated expediting the application process outside of the adopted grant procedures; and WHEREAS the attached letter requires that a signed acceptance be returned prior to September 16, 2000; and WHEREAS this is the 28 th year of grant acceptance for this program; and WHEREAS the contract award of $1,774,830 is an increase of $160,625 (9.95%) of the current award and $2,806 less (-0.16%) than the application amount; and WHEREAS the award includes the addition of one (1) Prosecutor Investigator position with county car; and WHEREAS the State contribution is $1,171,388 (66%), the County contribution is $494,593 (27.87%), and the State supplement is $108,849 (6.13%); and WHEREAS the required County match of $494,593 is available in the FY2001 Executive Recommended Budget under the Prosecuting Attorney's Grant Match line item; and WHEREAS acceptance of this contract does not obligate the County to any future commitment; and WHEREAS the grant agreement has been processed through the County Executive Contract Review Process and the Board of Commissioners Grant Acceptance Procedures. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners accepts the contract renewal for the Prosecuting Attorney's Cooperative Reimbursement Program in the total amount of $1,774,830 for the period of October 1, 2000 through September 30, 2001. BE IT FURTHER RESOLVED that one (1) Prosecutor Investigator FTE Special Revenue position be added to the Prosecuting Attorney's Cooperative Reimbursement Grant. BE IT FURTHER RESOLVED that one (1) county car be added to the fleet. BE IT FURTHER RESOLVED that future level of service, including personnel, will be contingent upon the level of funding available from the State for this program. BE IT FURTHER RESOLVED that amendments be made to the Prosecuting Attorney's grant budget to reflect the changes in the award as detailed in Attachment A. BE IT FURTHER RESOLVED that the Chairperson of the Board of Commissioners is authorized to execute the contract agreement and to approve amendments and extensions up to fifteen (15%) percent variance from the award, consistent with the original agreement as approved. Dutkowski, Director Office of Child Support SUBJECT: Fiscal Year (FY) 2001 Cooperative Reimbursement Contract Application Enclosed with this letter are instructions and application documents for the FY 2001 Title IV-D Child Support Cooperative Reimbursement (CR) contracts. The contract application process will be administered by the Office of Child Support (OCS), Family Independence Agency (FIA) in accordance with these instructions. Significant changes in the application and contract process for FY 2001 are summarized in the What's New in FY 2001 summary sheet included as Enclosure A. The following changes in particular will have significant impact for most contracts: • Applications need to be returned to OCS Managers from May through June. • Signed contracts need to be returned to OCS by September 15, 2000. • Only one Lobbying Certification will be required for contracts of $100,000 or more. • The State share for all contracts will be 66% (FFP). • The State fixed allocation will be paid through a separate payment process. • Court service fees may now be applied first to parenting time and custody costs. • Counties will have to submit requests for all Line Item transfers. • Medical Support Enforcement (MSE) positions may be counted in CR contracts. FUNDING Total funding proposed in the FIA budget for FY 2001 in CR contracts is $156,579,985, a 20% increase over the original FY 2000 CR contract funding allocation maximum. To be within the proposed FIA appropriation, the sum total of all net budgets for FY 2001 CR contracts must not exceed the amount of total funding included in the FIA budget for CR contracts in FY 2001. In order to stay within this FIA appropriation-funding limit, a funding maximum for each county CR contract is identified. Enclosure E shows each contract's FY 2001 TOTAL CONTRACT FUNDING CAP maximum and the STATE SUPPLEMENT allocation (formerly listed as the GF/GP funding share of the allocation). Each FY 2001 CR application budget must stay within the FY 2001 TOTAL CONTRACT FUNDING CAP maximum in order to assure that the State funding appropriation is not exceeded. It is expected that most contracts will not need to use the full allocation to cover projected program costs. 4%..1 ItC7CLED PARA , Requests for funding in excess of the allocation maximum need to be submitted through a separate amendment application. Approval of subsequent amendment requests will be dependent upon the extent to which FIA is able to obtain additional funding through the State appropriation process later in the year. CONTRACT LANGUAGE FY 2001 Cooperative Reimbursement contract documents are currently in the final review process for language changes and other revisions. A draft of the contract documents will be forwarded to representatives of FOCA, PAAM and SCAO for review before the documents are finalized. CR CONTRACT APPLICATION PROCESSING All FY 2001 CR contracts begin on October 1, 2000. Therefore, to allow sufficient time for processing, the Application needs to be completed, signed by the authorized person for the Court or Prosecuting Attorney and forwarded to the OCS Contraat Manager from late May through June 30, 2000. The Application will be processed and will result in an actual CR contract. Original Contracts should be signed and returned to OCS no later than September 15, 2000. OCS Contract Managers will be available to answer questions and provide advice as you prepare your FY 2001 CR contract application. FINANCE COMMITTEE FISCAL NOTE (M.R. #00216) September 7, 2000 BY: FINANCE COMMITTEE, SUE ANN DOUGLAS, CHAIRPERSON IN RE: PROSECUTING ATTORNEY - FY 2001 COOPERATIVE REIMBURSEMENT PROGRAM (CRP) CONTRACT APPLICATION/ACCEPTANCE TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Chairperson, Ladies and Gentlemen: Pursuant to Rule XII-C of this Board, the Finance Committee has reviewed the above named Miscellaneous Resolution and finds: 1. The Prosecuting Attorney is requesting the acceptance of the FY 2001 Cooperative Reimbursement Program Grant. 2. The grant award of $1,774,830 is $160,625 (9.95%) more than the current award and $2,806 (.16%) less than the application amount of $1,777,636. The County match of $494,593 (27.87%) will come from the Prosecutor's Grant Match line item shown in the FY 2001 - FY 2002 County Executive Recommended Budget (page 214). 3. The Prosecutor's Cooperative Reimbursement Program Grant budget will be amended as shown on Attachment A. 4. Included in the award is funding for an additional Prosecutor Investigator position that necessitates the acquisition of one (1) fleet automobile and one (1) hand-held radio. Capital costs of $18,500 for the automobile and $2,218 for the radio will come from the non-departmental Contingency Account. 5.
