LAW, CHAIRPERSON RE: MR #01022 DRAIN COMMISSIONER/ADMINISTRATION — CREATION OF TWO NEW CLASSIFICATIONS AND SPECIAL REVENUE POSITIONS To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: The Personnel Committee, having reviewed the above reference resolution on February 7, 2001 recommendations the resolution be amended as follows and adopted: ADD "BE IT FURTHER RESOLVED that both positions are included in the Merit System and costs for these positions are charged to the appropriate drainage districts as set forth in the Drain Code BE IT FURTHER RESOLVED that the Drain Office submit a semi-annual report as to the activities of these two positions to the appropriate Liaison Committee." FURTHER the attached "Description" and "Qualifications" of the Drainage District Legal Counsel and Drain District Insurance Administrator positions be adopted. DESCRIPTION GENERAL SUMMARY Under limited direction, represents non-County drainage districts in complex civil suits and acts as legal counsel. Reviews municipal water, sewer, and sewage treatment system construction contracts for appropriate language. Prepares legal documents for contracted water, sewer, and sewage treatment services. Performs legal research and trial work. Represents non-County drainage districts in a variety of matters relating to liability issues. Defends non-County drainage districts and its elected officials, employees, and agents in disputed claims or civil suits. Establishes and maintains effective working relationships and monitors the litigations brought against drainage districts that are represented by outside counsel. SUPERVISION EXERCISED Provides administrative direction to municipalities and Drain department managers. Instructs staff regarding contractual, liability and legal issues. TYPICAL DUTIES AND RESPONSIBILITIES Represents non-County drainage districts in extremely complex cases relating to liability issues. Formulates and presents the defense for suits brought against local cites, villages and townships. Follows legal precedent in representing non-County drainage districts in civil legal matters in the appropriate courts. Conducts legal research on existing or proposed litigation and compiles a written opinion. Conducts research and renders legal advice to various non-County drainage district administrators and elected officials concerning their rights and obligations. Prepares and/or approves extremely complex decrees, contracts and other legal documents to which non- County drainage districts and the County are partners. Cooperates with Drainage Boards in acquiring rights-of-way for drain construction by reviewing title work and ensuring that the necessary rights-of-way are obtained and are in good order. Coordinates efforts and monitors the progress of Drain related litigations brought against non-County drainage districts where the municipality is represented by outside counsel. Pass the complete examination, including the employment physical, established for this class. 4. Successfully complete the six month probationary period. B. Additional Desirable Qualifications 1. Considerable knowledge of and experience in the principles of civil law as they relate to municipal water, sewer, and storm drain systems. 2. Considerable experience and ability in establishing and maintaining effective working relationships with non-County drainage districts, Court officials, County administrators, representatives from outside agencies and employees. 3. Considerable knowledge and experience in the principles, methods, materials and practices of legal research. 4. Prepares a non-County/municipality safety policy statement, develops an operational system to reflect that policy and oversees its implementation. May establish safety committees, coordinate with department heads and participating staff within departments. APPROVED BY: DATE: 6o February 1, 2001 MISCELLANEOUS RESOLUTION 401022 BY: PLANNING AND BUILDING COMMITTEE - Charles Palmer, CHAIRPERSON IN RE: DRAIN COMMISSIONER/ADMINISTRATION-CREATION OF TWO NEW CLASSIFICATIONS AND SPECIAL REVENUE POSITIONS To The Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS the Drain Commissioner, while acting in his capacity as a non-county statutory officer under the Drain Code, contracts with outside firms for the services needed to design, build, and renovate various drainage district facilities located throughout the County; and WHEREAS the Drain Commissioner, acting in his capacity as a non- county statutory officer under the Drain Code, operates and maintains a large variety of above and below ground facilities needed to provide the water, sanitary sewer, storm drain, and lake level services used by the various cities, villages and townships which comprise our County; and WHEREAS the Drain Commissioner and the County Executive Administration have reviewed the Drain Office's construction, operation, and local liaison responsibilities, focusing particularly on liability, legal representation and risk management issues; and WHEREAS the Drain Commissioner and County Executive Administration have determined that it is in the County's best interests to establish two new classifications and staff positions to provide appropriate drainage district support services, one dedicated to providing legal representation for the non-county Chapter 20 and Chapter 21 drainage districts and one position dedicated to managing the risk associated with the Drain Commissioner's non-county Chapter 20 and Chapter 21 construction, maintenance and operation duties; and WHEREAS the proposed Drainage District Legal Counsel position would represent Drainage Districts, which are, under Michigan law, entities distinct from and independent of the corporate body that is the County of Oakland; and WHEREAS the proposed Drainage District Insurance Administrator would develop cost effective risk management and avoidance programs for the various drainage districts; and WHEREAS after study of internal and external job and pay comparisons, the Personnel Department has determined appropriate salary ranges for the Drainage District Legal Counsel and Drainage District Insurance Administrator which are excepted from salary grade placement; and WHEREAS both requested positions are proposed to be included in the Merit System and be Special Revenue funded, with costs allocated to the drainage districts being served rather than drawing from the County General Fund. SUPERVISION EXERCISED Provides administrative direction to municipalities and Drain department managers. Instructs staff regarding risk management and insurance procedures. TYPICAL DUTIES AND RESPONSIBILITIES Develops an overall insurance and risk management system in regards to Chapter 20 and Chapter 21 construction, maintenance and operations activities at non-County cities, villages and townships. Recommends to the Drain Commissioner and administers approved plan. Administers contractual agreements with insurance providers, coordinating bids, negotiating purchase and coverage plan, requesting changes as needed on secured policies and notifying of cancellations. Oversees related office functions such as maintenance of bonds, custody of legal documents and policies, preparation of correspondence and billing procedures. Provides administrative direction to cities, villages and townships regarding insurance and risk management. Establishes goals and objectives. Acts as a resource to provide information such as suggested improvements and related costs, results of claims or assistance with a claim. Monitors related progress and provides periodic status reports. Prepares a non-County/municipality safety policy statement, develops an operational system to reflect that policy and oversees its implementation. May establish safety committees, coordinate with department heads and participating staff within departments. Provides operational manuals and employee training. Advises of possible violations and effective solutions. Provides for periodic inspection of non-County facilities to ensure adherence to maintenance standards, safety policy and procedure.
