MISCELLANEOUS RESOLUTION# 01276 October 25, 2001 By: Public Services Committee, David L. Moffitt, Chairperson IN RE: DEPARTMENT OF INFORMATION TECHNOLOGY/EMERGENCY MANAGEMENT — APPLICATION/ACCEPTANCE OF TERRORISM NEEDS ASSESSMENT TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Chairperson, Ladies and Gentlemen: WHEREAS the Michigan State Police Emergency Management Division (MSP EMD) was required to prepare a three year domestic preparedness strategy, and WHEREAS the MSP EMD needed information and required the assistance from the emergency management programs regarding local risk, vulnerable areas, threats, and equipment shortfalls, and WHEREAS the MSP EMD has agreed to provide a grant of $1,000 to each emergency management program that has completed its assessment and entered the information into the Department of Justice national database, and WHEREAS Oakland County Emergency Management completed the task March 2001. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approves and accepts the Terrorism Consequence Management Preparedness Assistance Grant as awarded in the amount of $1,000. ROBINSON, Director July 13, 2001 Dear Emergency Management Coordinator: Because the local Terrorism Needs Assessments are the foundation for the state's three-year statewide domestic preparedness strategy, the Emergency Management Division (EMD) has agreed to provide a grant to each emergency management program that has completed its assessment and entered the information into the Department of Justice national database. The source of the pass- through grant finds is a Terrorism Consequence Management Preparedness Assistance (TCMPA) Grant awarded to EMD by the Federal Emergency Management Agency (FEMA) in FY 2001. The grant was awarded for consequence management activities that will enhance the capability of the state and its political subdivisions to prepare for, respond to and recover from acts of terrorism involving weapons of mass destruction. Since your jurisdiction has met the requirements, you are eligible for a grant of $1,000.00. Attached you will find two signed copies of the Terrorism Consequence Management Preparedness Assistance Grant Agreement for your jurisdiction. Please obtain the necessary signatures on this agreement. Retain one signed agreement for your office files and return one to the Emergency Management Division office in Lansing. We cannot release payment until we have received your signed grant agreement. I. Purpose The purpose of this agreement is to provide federal Terrorism Consequence Management Preparedness Assistance Grant funds to the Subgrantee for completion of the Department of Justice Terrorism Needs Assessment. Objectives The principal objective of this agreement is to provide financial assistance for the development of the local Terrorism Needs Assessment and entry of the data into the national database providing information for the State of Michigan Three-Year Statewide Domestic Preparedness Strategy. III. Legal Authority The Subgrantee agrees to comply with all TCMPA program requirements in accordance with the Michigan Emergency Management Act, Act 390, P.A. of 1976, as amended, the Robert T. Stafford Disaster Relief and Emergency Assistance Act, as amended, Emergency Management and Assistance Regulations (44 CFR), Office of Management and Budget Circulars A-87, A-102 and A-133, as revised, the Michigan State Administrative Plan and applicable state and federal laws and regulations. IV. Terrorism Consequence Management Preparedness Grant Award For FY 2001 the total TCMPA award for the Subgrantee is $1,000.00 . This grant agreement designates TCMPA funds as reimbursement for expenses incurred in preparing and submitting the Terrorism Needs Assessment. The Subgrantee may utilize grant funds in any eligible cost category it determines to be the most effective for its emergency management program. The funds awarded in the grant agreement shall only be used to cover allowable costs that are incurred during the agreement period. The Subgrantee is not required to provide any matching funds under this grant program. V. Responsibilities of the Subgrantee The Subgrantee agrees to complete the local Terrorism Needs Assessment and enter the data into the Department of Justice's national database. Submit this signed TCMPA agreement to the Grantor. B. Comply with all items included in Parts I and III (and IV, if applicable) of the Summary Sheet for Assurances and Certifications (FEMA Form 20-16) that was submitted with the FY 2001 Emergency Management Performance Grant Agreement. C. Account for receipts and expenditures, maintain adequate financial records, and refund expenditures disallowed by federal or state audit. D. Retain all financial records, supporting documents, statistical records, and all other records pertinent to the TCMPA program for at least three years after your final grant report, for purposes of federal examination and audit. E. Perform the required financial and compliance audits in accordance with the Single Audit Act of 1984, as amended, and Office of Management and Budget Circular A-133, as revised. If an audit is required, submit a copy of the annual audit report to Financial Services Section, Michigan Department of State Police, 714 South Harrison Road, East Lansing, Michigan 48823. VI. Responsibilities of the Grantor The Grantor, in accordance with the general purposes and objectives of this agreement, will reimburse the Subgrantee in accordance with this agreement in an amount not to exceed the allocation. VII. Payment and Reporting Procedures A. The Grantee agrees to pay the Subgrantee upon receipt of this signed grant agreement. B. The Subgrantee agrees to return to the Grantor any unobligated balance of funds held by the Subgrantee at the end of the agreement period or handle them in accordance with the instructions provided by the Grantor. VIII. Agreement Period This agreement is in full force and effect from October 1, 2000, through September 30, 2001. This agreement consists of two identical sets that may be simultaneously executed, each of which shall be deemed to be an original having identical legal effect. No costs eligible under this agreement shall be incurred before October 1, 2000. This agreement may be terminated by either party by giving thirty (30) days written notice to the other party stating reasons for termination and the effective date, or upon the failure of either party to carry out the terms of the agreement. Upon any such termination, the Subgrantee agrees to return to the Grantor any funds not authorized for use. IX. Official Certification The individual or officer signing this agreement certifies by his or her signature that he or she is authorized to sign this agreement on behalf of the responsible governing board, official, or agency.
