Crawford, District #17 IN RE: ENVIRONMENTAL INFRASTRUCTURE FUND REIMBURSEMENT FOR PROJECT IN THE CITY OF NOVI - FY 2001 AND FY 2002 ALLOCATION TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Chairperson, Ladies and Gentlemen: WHEREAS the Oakland County Board of Commissioners established an Environmental Infrastructure Funds and Disbursement Policy per Miscellaneous Resolution #99093 in an effort to increase the share of dollars flowing into infrastructure projects for the County and its cities, villages and townships (CVTs); and WHEREAS pursuant to the Disbursement Policy, the City of Novi has submitted a resolution of authorization to the County for reimbursement of expenses incurred in connection with an eligible environment remediation of improvement project; and WHEREAS the City of Novi is requesting reimbursement from the FY 2001 and FY 2002 appropriation for expenses related to the Arsenic remediation project located north of Twelve Mile Road and West of Dixon Road; and WHEREAS the FY 2000 appropriation which was approved by M.R. # 00312 will also be used towards this project which totals $577,914.03; and WHEREAS the FY 2001 and FY 2002 authorized amount of funding for the City of Novi is $192,638.01 annually from the Environmental Infrastructure Fund as repayment to the City of Novi for expenses incurred in connection with environmental remediation or improvement projects. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approves the project submitted by the City of Novi as eligible for reimbursement from the Environmental Infrastructure Fund. BE IT FURTHER RESOLVED that the Board authorizes the FY 2001 and FY 2002 appropriation in the amount of $192,638.01 annually from the Environmental Infrastructure Fund (Account #90-263248-41000-3985) to repay the City of Novi for expenses incurred in connection with environmental remediation or improvement projects, once proper invoices are presented. Bononi RESOLUTION Authorizing Environmental Infrastructure Fund Expense Reimbursement Request City of Novi Oakland County, Michigan WHEREAS, upon the recommendation of the Oakland County Executive, the Oakland County Board of Commissioners has established an Environmental Infrastructure Fund Program to assist Oakland County cities, villages and townships in addressing clean water and storm water needs; and WHEREAS, Oakland County's Environmental Infrastructure Fund Program authorizes Oakland County cities, villages and townships to apply for reimbursement of eligible expenses incurred in connection with environmental remediation or improvements relating to ground and/or surface water, water supply, sewer and/or drainage systems and/or water pollution control effects incurred as part of a city, village, or township road project; and WHEREAS, the City of Novi, Oakland County, Michigan will be incurring expenses in connection with arsenic remediation to protect shallow ground water wells on property formally used as an orchard site located north of Twelve Mile Road and West of Dixon Road, eligible for reimbursement under Oakland County's Environmental Infrastructure Fund Program. NOW, THEREFORE, BE IT RESOLVED that the City Council authorizes and directs its Director of Public Works, William A. McCusker, as agent for the City of Novi, in the manner and to the extent provided for under Oakland County Board of Commissioners Miscellaneous Resolution 99093, to request reimbursement for eligible environmental remediation project expenses available under the County's Environmental Infrastructure Fund Program for the 2000/01, 2001/02 and 2002/03 fiscal year allocations totaling $577,914.03. CERTIFICATION I hereby certify that the foregoing is a true and complete copy of a resolution adopted by the City Council of the City of Novi at a regular meeting held this July 1, 2002. Lorenzo Sincepely ichbrd Clark May July 5, 2002 Mr. Tim Soave Manager of Fiscal Services Oakland County Management and Budget 1200 North Telegraph Pontiac, MI 48341-0409 RE: Oakland County Environmental Infrastructure Fund Dear Tim: Pursuant to the County's guidelines, attached is a certified Resolution adopted by the Novi City Council on July 1, 2002 seeking reimbursement from the Oakland County Environmental Infrastructure Fund for expenses to be incurred in connection with environmental remediation to protect shallow ground water wells on property formally used as an orchard site located north of Twelve Mile Road. Infrastructure funds totaling $577,914.03 currently set aside for Novi from the 2000, 2001 and 2002 fiscal year allocations will be applied against the $1,105,355 awarded to Waterland Trucking for the cost of excavation, disposal and restoration of soil currently contaminated with high levels of arsenic resulting from the historical presence of apple orchards on the site. A formal resolution requesting reimbursement from the County's fiscal year 2003 allocation in the amount of $192,638.01 will be requested after October 1, 2002 in order to receive full reimbursement from the County. Project expense reimbursement requests will be forwarded to you as actual costs are incurred. On behalf of the City of Novi, I would like to thank you for all your assistance. The level of support which will be provided by Oakland County to assist local units of government to meet the challenges of financing environmental costs will have a significant impact to the citizens of Novi. Funding of $192,638.01 is available in the Environmental Infrastructure Fund for Fiscal Year 2001 and FY 2002, to reimburse the City of Novi for this project; no additional appropriation is required. 2.
