HomeMy WebLinkAboutResolutions - 2002.12.12 - 26747MISCELLANEOUS RESOLUTION #02296 BY: Commissioner Hugh Crawford, District #17 IN RE: ENVIRONMENTAL INFRASTRUCTURE FUND REIMBURSEMENT FOR PROJECT IN THE CITY OF NORTHVILLE - FISCAL YEARS 2000, 2001, 2002 AND 2003 ALLOCATIONS TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Chairperson, Ladies and Gentlemen: WHEREAS the Oakland County Board of Commissioners established an Environmental Infrastructure Funds and Disbursement Policy per Miscellaneous Resolution #99093 in an effort to increase the share of dollars flowing into infrastructure projects for the County and its cities, villages and townships (CVTs); and WHEREAS pursuant to the Disbursement Policy, the City of Northville has submitted a resolution of authorization to the County for reimbursement of expenses incurred in connection with an eligible environment remediation of improvement project; and WHEREAS the City of Northville is requesting reimbursement for expenses directly related to eliminating illicit discharge as specified under the State of Michigan General Storm Water Permit; and WHEREAS authorized funding for FY 2000 - FY 2003 for the City of Northville is $15,598.13 annually from the Environmental Infrastructure Fund as repayment to the City of Northville for expenses incurred in connection with the elimination of illicit discharge. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approves the project submitted by the City of Northville as eligible for reimbursement from the Environmental Infrastructure Fund. BE IT FURTHER RESOLVED that the Board authorizes the FY 2000, FY 2001, FY 2002 and FY 2003 appropriation in the amount of $15,598.13 annually from the Environmental Infrastructure Fund (Account *90- 263247-41000-3985) to repay the City of Northville for expenses incurred in connection with the elimination of illicit discharge, once proper invoices are presented. Telegraph Road Pontiac, MI 48341 Re: Environmental Infrastructure Fund Reimbursement Request Dear Mr. Soave: Pursuant to Oakland County Board of Commissioner Miscellaneous Resolution (MR) 99093, the City of Northville hereby requests reimbursement under Oakland County's Environmental Infrastructure Fund Program for expenses incurred with the implementation of the City's general storm water permit requirements. Under the City's "Certificate of Coverage" issued by the State of Michigan through its General Storm Water Permit," the City of Northville has undertaken requirements under its own illicit discharge elimination program, and educational program. In addition the City has committed itself to a long-term septic system elimination program. Attached you will fine copies of paid invoices for professional assistance and construction efforts over the past three years which exceed the amount allocated to the City of Northville under Oakland County's Environmental Infrastructure Fund Program. As you are aware, EPA's storm water requirements are here to stay. Please review these paid invoices to certify that they are storm water quality related. Clearly these types of expenses will continue in the years ahead. Reimbursement of past costs will assist the City of Northville in meeting storm water quality related expenses in the future. Attached you will find a resolution approved by the Northville City Council requesting reimbursement for the years 2000, 2001, 2002, along with our current fiscal year of 2003. We believe this totals in excess of $62,392.52. This resolution, along with the above mentioned paid invoices are being submitted, requesting that you will fully reimburse the remaining money allotted to the City of Northville through Oakland County's Environmental Infrastructure Fund. Crawford, Oakland County Commissioner Christopher Johnson, Mayor Ends: Resolution Copies of Paid Invoices 7' G cs) 9 F j Council Communications Subject: Environmental Infrastructure Fund Program — Oakland County Date: November 4, 2002 Background: In June 1999, the Oakland County Board of Commissioners approved the Environmental Infrastructure Fund for Oakland County. This fund was established to assist the County's 61 cities, townships and villages in paying for pollution abatement relating to water and sewer. The County transferred $5 million annually from the Delinquent Tax Revolving Fund into the Environmental Infrastructure Fund to help mitigate the cost of new EPA regulations on Oakland County communities. Based on a combination of population and taxable value, Northville's share of the fund totals $77,990.65. In November of 1999 the City of Northville requested the first year's allotment ($15,598.13) of this funding and it was used to cover cost incurred to bring Northville in compliance with the City's "Certificate of Coverage" issued by the State of Michigan under its general storm water permit from the US Environmental Protection Agency. Analysis: To remain in compliance with the City's "Certificate of Coverage" Northville has retained the professional services of Orchard, Hiltz & McCliment, Inc. (OHM) to plan and design required education and illicit discharge elimination programs, including steps to reduce the number of septic systems in our community. The City has received partial funding from the Rouge Program Office (RPO) for this effort, and it is proposed that the Oakland County Environmental Infrastructure Fund Program with a remaining amount of $62,392.52 be used to reimburse the City in these storm water related environmental expenses. Budget Impact: Oakland County requires no matching funds for this program. If they approve the City's request, and the City can verify eligible expenditure, the County will reimburse the City up to the specified amount for our community (Attachment A). Recommendation: It is recommended that City Council approve a resolution (Attachment B) authorizing the City Manager to request approval and reimbursement of eligible environmental remediation or improvement project expenses up to $62,392.52 under Oakland County's Environmental Infrastructure Fund Program. The Oakland County Board of Commissioners approved this 5- year, $25 million program in 1999, to assist our local communities by reimbursing them for the costs of eligible water and sewer projects. The City of Northville was eligible to receive an annual allocation of $15,598.13 from the Environmental Infrastructure Fund. If your community chose to utilize the optional accelerated payment schedule, the 5-year total allocation of $77,990.65 has been discounted. As of October 1, 2002, County records indicate that Environmental Infrastructure Fund reimbursements totaling $62,392.52 remain available to the City of Northville. Your community has not requested reimbursement for Fiscal Years 2000, 2001, 2002 and 2003. Please note that cities, villages and townships must submit their requests for reimbursement from the Environmental Infrastructure Fund by August 1, 2003. The requests should include: a resolution from your legislative board or council that identifies the project, a letter requesting • reimbursement for the costs incurred and a copy of paid invoices. Main Street • Northville, Michigan 48167-1540 Phone: (248) 349-1300 • FAX: (248) 349-9244 - RESOLUTION - A Resolution Authorizing an Environmental Infrastructure Fund Expense Reimbursement Request Whereas, upon the recommendation of the Oakland County Executive, the Oakland County Board of Commissioners has established an Environmental Infrastructure Fund Program to assist Oakland County cities, villages and townships in addressing clean water and storm water needs; and Whereas, Oakland County's Environmental Infrastructure Fund Program authorizes Oakland County cities, villages and townships to apply for reimbursement of eligible expenses incurred in connection with environmental remediation or improvements relating to ground and/or surface water, water supply, sewer and/or drainage systems and/or water pollution control efforts incurred as part of a city, village or township road project; and Whereas, the City of Northville, Oakland County, Michigan will/has incur expenses in connection with environmental remediation as required under the City's "Certificate of Coverage" issued under the State of Michigan's General Storm Water Permit; and that said expenses are determined to be eligible for reimbursement under Oakland County's Environmental Infrastructure Fund Program. Now therefore be it Resolved, that City Council authorizes and directs its City Manager; as agent for the City of Northville, in the manner and to the extent provided for under Oakland County Board of Commissioner Miscellaneous Resolution 99093, to request reimbursement of professional services and construction activities of eligible environmental remediation or improvement project expenses for Fiscal year 2000, 2001, 2002, and 2003 under Oakland County's Environmental Infrastructure Fund Program.
