Crawford, Chairperson IN RE: 52 'd DISTRICT COURT, DIVISION I - 2003 MICHIGAN DRUG COURT PROGRAM CONTINUATION GRANT CONTRACT ACCEPTANCE To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS the 52 nd District Court, Division I (Novi) applied for a grant with the State Court Administrative Office (SCAO), Michigan Drug Court Grant Program with a granting period of January 1, 2003 through December 31, 2003; and WHEREAS the application requested total funding in the amount of $95,684 of which $37,284 is the State portion and $12,428 is the County's in- kind match, and $58,400 was received from the Byrne Memorial Grant; and WHEREAS the award from the SCAO is for $37,284 and the County's in-kind Match is $12,428 totaling $49,712; and WHEREAS the twenty-five percent (25%) County in-kind Match of $12,428 will come from the Byrne Memorial Grant for FY 2003; and WHEREAS the court intends to continue the Drug Court to deal with the problems of increasing recidivism, increasing use of alcohol and illegal drugs, rising systems costs, and an increase in jail days ordered; and WHEREAS to provide continued intensive probation supervision and frequent alcohol testing of defendants, there is one (1) special revenue full-time eligible Probation Officer I position (32205-09903) in the Probation Unit; and WHEREAS this position changes from SCAO to Byrne Memorial Grant funding effective the first pay period of the second quarter of the FY 2003; and WHEREAS the 25% grant match funding ($12,428) for this position will be SCAO funded; and WHEREAS Miscellaneous Resolution #90004 established a fiscal policy to maintain proportionate funding for Federal, State and Private grants; and WHEREAS the grant agreement has been processed through the County Executive Contract Review Process and the Board of Commissioners Grant Acceptance Procedures. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners accepts the State Court Administrative Office, Michigan Drug Court Program Grant, in the amount of $49,712 which includes $37,284 from the State and $12,428 as the County's Match. BE IT FURTHER RESOLVED that the Chairperson of the Board of Commissioners is authorized to execute the contract agreement and that the chairperson may approve amendments and extensions up to fifteen (15%) percent variance from the award, consistent with the original agreement as approved. BE IT FURTHER RESOLVED that acceptance of this grant is conditioned upon continued interpretation of the contract consistent with the February 6, 2001, Letter from the Michigan Supreme Court, State Court Administrative Office, providing that assurance #4 of the grant application shall not be construed as a mandate for future funding of the program from the funding unit, said letter attached hereto and incorporated by reference herein. BE IT FURTHER RESOLVED that the 25% grant match funding ($12,428) for one (1) full-time eligible special revenue Probation Officer I position (32205-09903) in the Probation unit of 52 nd District Court, Division I (Novi), be paid from the SCAO grant award, approval of the SCAO. Public Services Committee Vote: Motion carried unanimously on a roll call vote with McPherson, Obrecht, Garfield and Sever absent. BE IT FURTHER RESOLVED that no positions may be filled nor expenditures authorized until a grant agreement is fully executed with the County's obligation limited to the grant funding period. BE IT FURTHER RESOLVED that the Court report in June and December of 2003 to the Public Services Committee and the Finance Committee on the effectiveness of the grant program. BE IT FURTHER RESOLVED that continuation of the position associated with this grant is contingent upon continuation of State funding. The assurances included in the Michigan Drug Court Grant application materials are the same as the assurances required to apply for and accept federal program funding for drug court programs. Assurance #4 calls for the applicant to provide assurance of a program's intern to continue funding whether that be from local, other state, or federal sources of funding. The Michigan Drug Court Grant Program is a state-approprimd program funded with limited general fund dollars. The funding is intended to assist in developing and implementing new programs and provide limited support to continuing programs. It is, however, the program's responsibility to eventually seek additional sources of funding. This should not be construed as a mandate for future funding of a program from the funding unit. Grantee shall comply with all applicable Federal, State and local laws, rules, and regulations. 7. Cash/ln-Kind Match The State share of the grant project may not exceed 75% of the total project costs. At least 25% of the total project cost is a required match and must come from local or other sources. Cash contributions must constitute a portion of the required match. Portion is not defined. 8. Assignments and Subcontracts All appropriate provisions and requirements of this Contract shall apply to any sub- contracts or agreements. Both parties of this Contract will be acting in an independent capacity and not as agents, employees, partners, joint ventures, or associates of one another. The employees or agents of one party shall not be deemed or construed to be the agent or employee of the other party for any purpose. B. Grantee understands and agrees that all persons furnishing services pursuant to this Contract are, for purposed of Workers Compensation liability or other actions of employee- related liability, not employee of the State Court Administrative Office or Supreme Court. Grantee bears the sole responsibility and liability for furnishing Workers Compensation benefits to any of its employees for injuries arising from or connected with services performed pursuant to the Contract. Grantee may require subcontractors expected to perform services under this contract to provide further information according to local policies and procedures. ID. Debarment and Suspension A. Grantee may not contract with or make any award of the State Court Administrative Office Drug Grant funds at any time to any party which is debarred or suspended or is otherwise excluded from or ineligible for participation in federal assistance programs under Executive Order 12549, "Debarment and Suspension." 12. Acquisition, Accounting, Record Keeping & Inspection A. Grantee agrees that all expenditures from this Contract including the acquisition of personnel services, contractual services, supplies, and equipment, shall be in accordance with (1) the standard procedures of Grantee's unit of government and (2) the Administrative and Budget Requirements of the Michigan Drug Court Grant Program. B. Grantee agrees that the Supreme Court, State Court Administrative Office, the local government audit division of the Michigan Department of Treasury, the State Auditor General, or any of their duly authorized representatives, including program evaluators and auditors, shall have access to and the right to examine, audit, excerpt, copy, or transcribe any pertinent transaction, books, accounts, data, time cards, or other records related to this Contract. Such materials, including all pertinent costs reports, accounting and financial records shall be kept and maintained by Grantee for a period of five (5) years after completion of this Contract or until all State Court Administrative Office audits are complete for the fiscal period, whichever is later. Failure of Grantee to comply with requirements of this section shall constitute a material breach of this Contract upon which the State Court Administrator may cancel, terminate, or suspend this Contract. D. The grantee's accounting system must maintain a separate fund or account which segregates the Michigan Drug Court Grant Program contract receipts and expenditures. 13. Program Evaluation and Review Grantee shall allow appropriate Supreme Court and State Court Administrative Office representatives to evaluate, audit, inspect and monitor operation of the drug court. The inspection methods that may be used include: on-site visits; interviews of staff and drug court participants; and review of case records, receipts, monthly/quarterly statistical reports, and fiscal records. 15. Reports A. Grantee agrees to provide reports as identified in the Application Guidelines and Administrative Requirements for the Michigan Drug Court Grant Program to the State Court Administrative Office as follows: B. Financial Reports: Financial reports are due quarterly one month following each quarter of the fiscal year with the exception of the 3rd quarterly report which will be due October 10,2003 in order to meet fiscal year end reporting requirements. Therefore, quarterly reports will be due April 30, 2003; July 31, 2003; October 10, 2003, and January 31, 2004. Reimbursement for grant costs and future funding may be withheld if the progress and financial reports are delinquent. Grant Program-2003 Page Eight C. Progress Rep_orts: Progress reports are due semi-annually. The reports will be due OD June 30, 2003 and one month after the end of the calendar year or January 31, 2004. The progress reports describe activities during the reporting period and the status of accomplishment of objectives as set forth in the application for grant funding. The final report must provide a summary of progress toward achieving the goals and objectives of the award, significant results, and any products developed under the award. The State Court Administrative Office will provide copies of the progress report forms with the grant contract for each grant award made. D. annafsil 12g/,...,_=g_Q=QLjga.SLIII"g!aect Recipients of implementation, enhancement and continuation funding are required to submit to the SCAO the Drug Court Grantee Data Collection Survey developed by the federal Drug Court Grant Program one month after the end of the grant project or January 31, 2004. These data will capture baseline information on both drug courts and defendants. The data are intended to serve as a minimum data set for both local and national evaluation efforts. E. The Stue Court Administrative Office retains the right to reallocate grant funding if ongoing progress is not being made toward implementation of the drug court grant project. Budget Modification: Adjustments in expenditures within line item categories in the approved budget may be made up to $1,000 without prior written approval of the State Court Administrative Office. Funding flold/Tentsination The State Court Administrative Office, may at its election, place a funding hold on contracted amounts not yet disbursed, or terminate the contract if the State Court Administrative Office concludes that the Grantee is not in compliance with the conditions and provisions of this Grant Contract, the Grant Application Guidelines and Administrative Requirements or the Budget Requirements of the Michigan Drug Court Grant Program. In addition, the Office of Drug Control Policy (ODCP) provides funding from the Byrne Memorial Foundation to implement drug courts. This year, in an effort to begin coordinating these two funding sources for drug court programs, the SCAO and the ODCP utilized one application (the appfication for Byrne Memorial Foundation funds) to determine total program awards. Recently, you received notification of an award from the Office of Drug Control Policy for the Byrne Memorial Foundation Funding. We are pleased to inform you that year court has also been awarded a grant in the amount of $37,284 from the Michigan Drug Court Grant Program. In addition, because the Byrne Memorial Foundation is federal funding, the SAO award can be utilized toward the match requirement for your ODCP award. The SCAO grant contact and required reporting forms will be sent to the Project Contact that your court has identified on your grant application. Please submit a revised budget detail page to reflect the amount of the SCAO award. A copy of your signed grant contact and revised budget detail page will need to be returned to the state Court Administrative Office. Your Project Contact will then receive a final copy of the grant contract signed by the State Court Administrative Office. E quipment purchases ma y be recorded in the Supplies and Operatin g category but will be authorized for match expenditures only. -1- $ 52/1 DISTRICT COURT-SOBRIETY COURT BUDGET NARRATIVE 2003 SCAO GRANT The Drug Court literature addresses the need for a strong linkage between drug courts and the police. The role of the officer in our Sobriety Court is to make random visits to the homes of Sobriety Court participants with the expectation of finding them clean and sober and the home free of any alcohol or illegal drugs. The police officer will make these visits four times weekly, specifically during the evening and weekend hours when the participant would typically be using. Should the defendant be found drunk or high, the office will arrest the defendant for violation of probation and transport that person to the department for holding until sanctions are imposed at a court hearing the next day. In the eighteen months of the operation of Sobriety Court, we were fortunate to have grant funding for this purpose during first nine months of implementation of the program. The Sobriety Court team strongly believes that the Sobriety Court participant becomes more accountable knowing there is a strong police presence. In face, the team observed a higher rate of relapse and failure in the program when the police component was discontinued. In addition to home visits, the officer would make warrant arrests on any offenders who absconded from Sobriety Court. Therefore, we are asking for funding for the officer and milage to renew this component of the program. Sobriety Court is dependent on regular drug testing. The Genie Cup is the testing instrument of Sobriety Court and has remained a significant cost in the operation of the drunk driving drug court. Another significant expense is the printing of the Sobriety Court participant Handbook. That expense, during the first year of our operation was funded in full by Lyon Area Community Counts, a sub-committee of South Lyon Youth Assistance. The handbook is distributed to potential participants and welcomes them to Sobriety Court with a full explanation of all facets of the program. Finally, the daily operational supplies; paper, printer cartridges, file folders are a consistent cost. 11 Name/Position Computation Cost OJT T. The 52nd District Court, Division I (Novi) has received a grant from the State Court Administrator's Office (SCAO), Michigan Drug Court Program, for the period of January 1, 2003, through December 31, 2003. 2.
