MISCELLANEOUS RESOLUTION #02007 January 24, 2002

IN RE: DEPARTMENT OF MANAGEMENT AND BUDGET - WAIVER OF PURCHASING POLICY FOR
AWARD OF WIC START PROGRAM
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Chairperson, Ladies and Gentlemen:
WHEREAS the Comprehensive Planning, Budgeting, and Contracting Agreement
(CPBC) between the State of Michigan Department of Community Health and Oakland
County contains $150,000 in additional funding for the provision of nutritional
services to women and infants under the title of Women, Infants, and Children
(WIC) by an agency other than the Oakland County Health Division; and
WHEREAS the Oakland Livingston Human Service Agency (OLHSA), in
cooperation with the Oakland County Health Division, has agreed to develop the
staffing and infrastructure to provide these services for residents of Oakland
County under a pilot program called WIC Start; and
WHEREAS this program will make it possible for at-risk women and infants
to obtain services that otherwise may not be available to them; and
WHEREAS the contract period will be for one (1) year, and will comply with
all other purchasing policies; and
WHEREAS the State Department of Community Health has expressly authorized
and requested the creation of the contractual relationship with OLHSA to provide
Women, Infants, and Children Services.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of
Commissioners hereby waives Purchasing Policy PP-050 and authorizes the Oakland
County Health Division to continue its contractual arrangement with the Oakland
Livingston Human Service Agency for the provision of WIC Start services.
Chairperson, on behalf of the Finance Committee, I move the adoption of
the forgoing resolution.

Dear Mr. Fackler:
I am writing in response to ply recent request for clarification about the need to use open competitive
bids methods to identify a contractor for the "WIC Start Project". This matter has been presented to our
federal USDA liaison and our state contract office for comment, which is provided below.
Rochelle Sheets, our USDA federal contact researched this issue and provided the following guidance.
"According to WIC Regulations CFR Part 2463 (d) (1) (I to v) and 246.5 (2), the State agency should
notify the public of its intention that Oakland County plans to subcontract with a non-profit agency to
pilot a program to provide WIC services. The subcontracted agency is required to abide by the same
Federal and State regulations as the local agency.
In addition to abiding with Federal regulations, WIC .agencies must also follow all applicable state's
procurement regulations/procedures. Our review of the regulation quoted indicates that procedures to be
followed by State agencies as listed in 45 CFR 92.30, is following its own procurement procedures."
We were further told that this means Oakland does not have to use competitive bid for the services the
subcontrActor is providing, unless the agency requires that, or unless it is required under the state of
Michisdn's procurement procedures.
Our state procurement policy requires that all commodity and service purchases be awarded on a
competitive bid basis unless the requesting agency can demonstrate thata sole source award is justified.
The Department's Contract Management Section has advised that the unique qualifications of OLHSA,
cited in the October letter to Debra McKee, meets one of the criteria allowing for an exemption from the
competitive process foe this agreement.
Please use this letter of explanation as reference should questions arise in the future regarding this issue.

Thank you for your ongoing efforts with this project to assure that Oakland county residents continue to
have access to WIC services.

Dear Ms. McKee:
We are very pleased to collaborate with your agency in order to identify an alternative
provider for WIC services in Oakland County. It is my impression that Oakland
Livingston Human Services Agency (OLHSA) is the only agency in your community that
could partner with your agency to adequately provide WIC services according to USDA
established regulations and within the scope of the proposed pilot. The experience of
OLHSA with the target population of families that would be income eligible for WIC,
and the years of involvement of OLHSA with Head Start service delivery seems to
uniquely position this agency within Oakland county. Furthermore, the specific
collaborative arrangement that exists with OLHSA and Oakland County Health Division
is a basic foundation to assure that enfolled WIC participants are referred and have access
to needed health services.
Please do not hesitate to contact my office if additional information is required. Thank
you again for your interest and commitment t. mutual goal of assuring access to WIC
services in Oakland County.

Dear Ms Ms Rowneita.
Thank you for your October 2, 2001 request for funding to support the WIC Start pilot
project. Please be advised that WIC will provide $150,000 of additional funding at this
time. I understand the request was for $161,992 and will work to identify additional
funding later in this fiscal year to accommodate the needs outlined in the submitted plan.
We have enclosed a revised allocation sheet. You will need to submit a revised CPBC
budget that includes the additional WIC funding as soon as possible.
As you know the U.S. Department of Agriculture has not yet established a budget for
2002, and therefore WIC is operating on a monthly continuation resolution established by
Congress. Therefore, as with the current CPBC allocation this additional funding is also
contingent on availability of funds.
I continue to be very excited about the potential that exists to deliver WIC services within
the Oakland WIC Start pilot. I look forward to learning of the results of this pilot and am
very encouraged by your commitment to assure the provision of WIC services in Oakland
