Palmer, Chairperson IN RE: DEPARTMENT OF FACILITIES MANAGEMENT— RECOMMENDATION TO GRANT A PERMANENT EASEMENT TO DETROIT EDISON COMPANY FOR RELOCATION OF OVERHEAD POWER LINES AND POLES TO ACCOMMODATE CONSTRUCTION OF THE NEW WORK RELEASE FACILITY LOCATED IN THE CITY OF PONTIAC (TAX PARCEL NOS. 14-19-301-003 AND 14-19-351-009 PART) To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS the County of Oakland is in the process of constructing a new Work Release Facility on the Oakland County Service Center south of the Oakland County Jail and WHEREAS prior to beginning construction of the new Work Release Facility, approximately 1,300 linear feet of existing overhead power lines and poles must be relocated to prepare the site for construction of the new Work Release Facility; and WHEREAS the Department of Facilities Management and the Detroit Edison Company have determined that a new route for the relocation of the overhead power lines and poles located southeasterly of the County Jail is appropriate and would accommodate construction of the Work Release Facility and any future expansion of the County Jail. WHEREAS the Departments of Facilities Management and Corporation Counsel have reviewed and/or prepared all necessary documents and recommend the granting of the easement. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners hereby authorizes and approves the granting of the attached permanent easement for overhead power lines and poles over part of the Oakland County Service Center as referenced above. LE I FURTHER RESOLVED that the County of Oakland Board of Commissioners hereby directs its Chairperson or designee to execute the attached easement for overhead power lines and poles. PLANNING AND BUILDING COMMITTEE Planning & Building Committee Vote: Motion carried on unanimous roll call vote Detroit Edison Overhead Easement (Right of Way) No. 352574 On , 2002, for the consideration of system betterment, Grantor grants to Grantee a permanent overhead easement (Right of Way) in, on and across a part of Grantor's Land called the "Right of Way area". Grantor is: THE COUNTY OF OAKLAND, a Michigan constitutional corporation, 1200 N. Telegraph, Pontiac, Michigan 48341-1038. Grantee is: The Detroit Edison Company, a Michigan corporation, 2000 Second Avenue, Detroit, Michigan 48226, Ameritech Corporation a Michigan Corporation, 444 Michigan Avenue, Detroit, Michigan 48226, Comcast Cable Investors L. P. Pontiac Systems, a Delaware Corp., 1300 Cresent Lake Road, Waterford, Mi. 48327. Grantor's Land is in the City of Pontiac, Oakland County, Michigan described as: See attached EXHIBIT "A". SIDWELL NOs 14-19-301-003 and 14-19-351-009 part). The Right of Way Area is a part of Grantor , s Land and is described as: Shown on attached EXHIBIT B 1. Purpose: The purpose of this Right of Way is to construct, reconstruct, modify, add to, operate and maintain overhead utility line facilities consisting of poles, guys, anchors, wires, cables, transformers and accessories. 2. Access: Grantee has the right of access to and from the Right of Way Area. 3. Buildings or other Permanent Structures: No buildings or other permanent structures are allowed in the Right of Way Area without Grantee , s prior written consent. 4. Trees, Bushes, Branches, Roots, Structures and Fences: Grantee may trim, cut down, remove or otherwise control any trees, bushes, branches and roots in the Right of Way Area (or that could grow into the Right of Way Area) and remove structures and fences in the Right of Way Area that Grantee believes could interfere with the safe and reliable construction, operation and maintenance of Grantee s facilities. 5. Restoration: If Grantee, s employees, contractors, vehicles or equipment damage Grantor s Land while entering Grantor , s Land for the purposes stated in this Right of Way, then Grantee will restore Grantor, s Land as nearly as can be to its original condition. 6. Successors: This Right of Way runs with the land and binds and benefits Grantor s and Grantee , s successors and assigns. 7. Exempt under MCL 207.505 (a) and MCL 207.526 (a) 8. This document will cancel and supercede the portion of the existing Detroit Edison easement being removed (as shown on attached EXHIBIT B and described in EXHIBIT A), recorded in Liber 5464, Page 145 Oakland County Records.
