Galloway, District #2 IN RE: ENVIRONMENTAL INFRASTRUCTURE FUND REIMBURSEMENT FOR PROJECT IN THE CHARTER TOWNSHIP OF SPRINGFIELD - FISCAL YEAR 1999, FISCAL YEAR 2000, FISCAL YEAR 2001 AND FISCAL YEAR 2002 ALLOCATION TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Chairperson, Ladies and Gentlemen: WHEREAS the Oakland County Board of Commissioners established an Environmental Infrastructure Funds and Disbursement Policy per Miscellaneous Resolution #99093 in an effort to increase the share of dollars flowing into infrastructure projects for the County and its cities, villages and townships (CVTs); and WHEREAS pursuant to the Disbursement Policy, the Township of Springfield has submitted a resolution of authorization to the County for reimbursement of expenses incurred in connection with an eligible environment remediation of improvement project; and WHEREAS the Township of Springfield is requesting reimbursement for expenses directly related to the Dixie Highway storm sewer project; and WHEREAS authorized funding for FY 1999, FY 2000, FY 2001 and FY 2002 for the Township of Springfield is $46,505.47 annually from the Environmental Infrastructure Fund as repayment to the Township of Springfield for expenses incurred in connection with storm sewer project. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approves the project submitted by the Township of Springfield as eligible for reimbursement from the Environmental Infrastructure Fund. BE IT FURTHER RESOLVED that the Board authorizes a FY 1999, FY 2000, FY 2001 and FY 2002 appropriation in the amount of $186,021.88 or $46,505.47 annually from the Environmental Infrastructure Fund (Account #90-263228-41000-3985) to repay the Township of Springfield for expenses incurred in connection with the Dixie Highway storm sewer project, once proper invoices are presented. Telegraph Road Pontiac, MI 48341 Dear Mr. Soave: Re: Environmental Infrastructure Fund — Springfield Township Reimbursement Request Pursuant to Oakland County Board of Commissioners Miscellaneous Resolution (MR) 99093, the Township of Springfield hereby requests reimbursement under Oakland County's Environmental Infrastructure Fund Program for costs incurred in connection with an eligible environmental remediation or improvement project undertaken by our Township. Our request is for $+-7-7748-2-.4), which is the amount of our allocation for 1999, 2000, 2001 and 2002. 186.021,118 Our request is for reimbursement for a portion of the storm sewer and storm water improvement that is included in a 4.6 million dollar construction project to widen Dixie Highway from 1-75 to Davisburg Road. Attached is a copy of the contract between the Road Commission for Oakland County and Springfield Township to verify the entire 4.6 million dollar project cost and Springfield Township's $549,219.00 contribution to that cost. Also attached is an engineer's opinion of the cost for all storm sewer and storm water facility improvements contained within the 4.6 million dollar project. The total storm sewer and storm water facility projected cost is $648,232.00 plus dollars. A certified copy of the adopted Springfield Township Board resolution authorizing the Township Supervisor to submit reimbursement requests was sent to your department in August of 1999. A copy of the transmittal letter is enclosed for your review. The township understands that the review and processing of this request will be governed by the provisions of Miscellaneous Resolution No. 99093 and we certify that all costs submitted will be incurred in connection with a qualifying environmental remediation or improvement project. COST PARTICIPATION, AGREEMENT CONSTRUCTION Dixie Highway 1-75 to Davisburg Road Charter Township of Springfield This agreement made and entered into this 25th day of April 2002, by and between the Board of Road Commissioners for the County of Oakland, Michigan, hereinafter referred to as the BOARD, and the Charter Township of Springfield, hereinafter referred to as the COMMUNITY, provides as follows: WHEREAS, the BOARD and the COMMUNITY, in cooperation with the Michigan Department of Transportation, hereinafter referred to as MDOT, have agreed that it is necessary to program the widening from four to five lanes of Dixie Highway, from 1 -75 to Davisburg Road in Springfield Township as described in Exhibit "A", attached hereto, and made a part hereof, which improvements involve roads under the jurisdiction of the BOARD and within the COMMUNITY, which improvements are hereinafter referred to as the PROJECT; and WHEREAS, the cost of the PROJECT is estimated to cost $4,600,000; and WHEREAS, the BOARD shall enter into an agreement with MDOT for partial funding of the PROJECT with federal program dollars funds under the Surface Transportation Program; and WHEREAS, the BOARD shall be the requesting party financially responsible to MOOT to bear all costs of the PROJECT in excess of the federal funds, hereinafter referred to as the LOCAL MATCH; and WHEREAS, a portion of said LOCAL MATCH involves certain designated and approved Tr-Party Program funding, in the amount of $147,657; which amount shall be paid through equal contributions by the BOARD, the COMMUNITY and the Oakland County Board of Commissioners, hereinafter referred to a the COUNTY, in accordance with the Tr-Party Program; and WHEREAS, the BOARD and the COMMUNITY have reached a mutual understanding regarding the cost sharing of the PROJECT and wish to commit that understanding to writing in this agreement. NOW, THEREFORE, in consideration of the mutual covenants set forth herein, it is hereby agreed between the COMMUNITY and the BOARD that: The COMMUNITY approves of the PROJECT, declares its public necessity and authorizes the BOARD and MDOT to undertake and complete the PROJECT, as above described, and perform all administration in reference thereto. The actual total cost of the PROJECT shall include total payments to the contractors, engineering and inspection services, construction and permanent traffic controls, and right of way acquisition. 3. A portion of the LOCAL MATCH shall be funded in accordance with the following: a. Tr -Party Program funds in the amount of $147,657. b. The BOARD shall credit to the PROJECT, the COUNTY'S Tr-Party contribution of $49,219, together with the BOARD'S Tr-Party contribution in an amount equal thereto. 3. The COMMUNITY agrees to contribute an additional share to the cost of the LOCAL MATCH in the amount of $500,000. 4. Upon execution of this agreement, the BOARD shall submit an invoice to the COMMUNITY for $274,609.50 (being 50% of the COMMUNITY'S total estimated share of $549,219). 5. NOW, THEREFORE, BE IT RESOLVED: that the Springfield Township Board authorizes and directs the Township Supervisor, as agent for the Charter Township of Springfield, in the manner and to the extent provided for under Oakland County Board of Commissioner Miscellaneous Resolution 99093, to request reimbursement of eligible environmental remediation or improvement project expenses under Oaldand County's Environmental Infrastructure Fund Program. Funds of $186,021.88 (annual allocation of $46,505.47) are available in the Environmental Infrastructure Fund for FY 1999, FY 2000, FY 2001 and FY 2002, to reimburse the Charter Township of Springfield for the Dixie Highway storm sewer project; no additional appropriation is required. 2.
