IN RE: ENVIRONMENTAL INFRASTRUCTURE FUND REIMBURSEMENT FOR PROJECT IN
THE CITY OF BERKLEY - FISCAL YEARS 1999, 2000, 2001, 2002 AND 2003
ALLOCATION
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Chairperson, Ladies and Gentlemen:
WHEREAS the Oakland County Board of Commissioners established an
Environmental Infrastructure Funds and Disbursement Policy per
Miscellaneous Resolution #99093 in an effort to increase the share of
dollars flowing into infrastructure projects for the County and its
cities, villages and townships (CVTs); and
WHEREAS pursuant to the Disbursement Policy, the City of Berkley
has submitted a resolution of authorization to the County for
reimbursement of expenses incurred in connection with an eligible
environment remediation of improvement project; and
WHEREAS the City of Berkley is requesting reimbursement for
expenses directly related to the Twelve Towns Improvement project; and
WHEREAS the FY 1999, FY 2000, FY 2001, FY 2002 and FY 2003
authorized amount of funding for the City of Berkley is $59,889.73
annually from the Environmental Infrastructure Fund as repayment to the
City of Berkley for expenses incurred in connection with environmental
remediation or improvement projects.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of
Commissioners approves the project submitted by the City of Berkley as
eligible for reimbursement from the Environmental Infrastructure Fund.
BE IT FURTHER RESOLVED that the Board authorizes a FY 2003
appropriation in the amount of $59,889.73 annually from the
Environmental Infrastructure Fund (Account #90-263233-41000-3985) to
repay the City of Berkley for expenses incurred in connection with the
Twelve Towns Improvement project, once proper invoices are presented.
Chairperson, I move the adoption of the foregoing resolution.

Dear Tim,
Attached is a resolution authorizing and directing me as agent for the City of Berkley to
request reimbursement of eligible environmental remediation or improvement project
expenses under Oakland County's Environmental Infrastructure Fund Program.
The City of Berkley would like to appropriate all five years of our allocation to the costs
associated with the 12 Towns improvement project. Copies of paid invoices will follow
once I receive notice that our appropriation has been approved. Please call me if
additional information is needed. Thank you!

Re Optional Accelerated Payment Schedule for Environmental Infrastructure Fund Distributions
We received a communication from the Oakland County Board of Commissioners regarding the $25
million Environmental Infrastructure Fund available to the City of Berkley, as well as other local
communities: for water and sewer related projects.
The Board of Commissioners adopted a resolution on March 9, 2000, authorizing an "optional
accelerated payment schedule" that gives us the opportunity to access reimbursements from future
fund allocations (less a discount rate of 6%). The attached letter outlines all the methods of receipt of
this allocation.
In any case all money has to be used by September 30, 2004. Berkley share from the County is as
follows:
1999 59,889.73
2000 59, 889.73
2001 58,298.35
2002 52,487.38
2003 48,450.79
The grand total is $277,013.98. After discussion with Mr. Shepler and Mr. Tyler, it is my
recommendation that we use this money as our payment of the 12 Town Improvement costs.

A RESOLUTION
of the Council of the City of Berkley. Michigan
authorizing Environmental Infrastructure Fund
Expense Reimbursement Request
WHEREAS, upon the recommendation of the Oakland County Executive, the Oakland County
Board of Commissioners has estabiished an Environmental infrastructure Fund Program to assist
Oakland County cities, villages and townships in addressing clean water and storm water needs;
and
WHEREAS, Oakland County's Environmental Infrastructure Fund Program authorizes Oakland
County cities, villages and townships to apply for reimbursement of eligible expenses incurred in
connection with environmental remediations or improvements relating to ground and/or surface
water, water supply, sewer and/or drainage systems and/or water pollution control efforts incurred
as part of a city, village or township road project; and
WHEREAS, the City of Berkley, Oakland County, Michigan, has incurred expenses in connection
with environmental remediation or improvement project(s) believed to be eligible for
reimbursement under Oakland County's Environmental Infrastructure Fund Program.
NOW, THEREFORE, THE CITY OF BERKLEY RESOLVES:
SECTION 1: That the City Council of the City of Berkley hereby authorizes and directs the
Director of Public Works, as agent for the City of Berkley, in the manner and to the extent
provided for under Oakland County Board of Commission Miscellaneous Resolution 99093, to
request reimbursement of eligible environmental rAffellation or improvement project expenses
under Oakland County's Environmental Infrastru*re FUN Program.

Pursuant to Rule XII-C of this Board, the Finance Committee, has
reviewed the above referenced resolution and finds:
1. Annual funding of $59,889.73 is available in the Environmental
Infrastructure Fund for FY 1999, FY 2000, FY 2001, FY 2002 and FY
2003 to reimburse the City of Berkley for this project; no
additional appropriation is required.
2. The Committee recommends adoption of the resolution.
