HomeMy WebLinkAboutResolutions - 2002.09.19 - 26992MISCELLANEOUS RESOLUTION #02208 BY: David Galloway, District #2; Lawrence Obrecht, District #3; Tom Middleton, District #4; IN RE: ENVIRONMENTAL INFRASTRUCTURE FUND REIMBURSEMENT FOR PROJECT IN THE CHARTER TOWNSHIP OF INDEPENDENCE - FISCAL YEAR 2001 AND FISCAL YEAR 2002 ALLOCATION TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Chairperson, Ladies and Gentlemen: WHEREAS the Oakland County Board of Commissioners established an Environmental Infrastructure Funds and Disbursement Policy per Miscellaneous Resolution #99093 in an effort to increase the share of dollars flowing into infrastructure projects for the County and its cities, villages and townships (CVTs); and WHEREAS pursuant to the Disbursement Policy, the Township of Independence has submitted a resolution of authorization to the County for reimbursement of expenses incurred in connection with an eligible environment remediation of improvement project; and WHEREAS the Township of Independence is requesting reimbursement for expenses directly related to Clarkston Gardens storm water drainage; and WHEREAS authorized funding for FY 2001 and FY 2002 for the Township of Independence is $112,473.23 annually from the Environmental Infrastructure Fund as repayment to the Township of Independence for expenses incurred in connection with the storm water drainage project. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approves the project submitted by the Township of Independence as eligible for reimbursement from the Environmental Infrastructure Fund. BE IT FURTHER RESOLVED that the Board authorizes a FY 2001 and FY 2002 appropriation in the amount of $112,473.23 annually from the Environmental Infrastructure Fund (Account #90-263212-41000-3985) to repay the Township of Independence for expenses incurred in connection with the Clarkston Gardens storm water drainage project, once proper invoices are presented. Telegraph Road Pontiac, MI 48341 RE: Environmental Infrastructure Fund Reimbursement Request Clarkston Gardens Storm Water Drainage (Clarkston High School Relief Storm Sewer Project) Dear: Mr. Soavey: Pursuant to Oakland County Board of Commissioner Miscellaneous Resolution (MR) 99093, the Charter Township of Independence hereby request reimbursement under Oakland County's Environmental Infrastructure Fund Program for expenses incurred in connection with an eligible environmental remediation or improvement project undertaken by our community. Attached in support of this request are the following: Attachment A: Attachment B: Attachment C: Project Description Governing Body Resolutions November 6, 2001 — Resolution for support of project Expense Invoices Submitting invoices totaling $309,616.38 but Reimbursement request for $215,000 from the following grant years: 2000-$4,451.75, 2001-$112,473.23, 2002-$98,075.02, as noted on the Township's OC Environmental Infrastructure Fund Activity Sheet. The Charter Township of Independence understands that the review and processing of this reimbursement request will be governed by the provisions of MR 99093, and certifies that all expenses submitted for reimbursement were incurred in connection with a qualifying environmental remediation or improvement project. Richardson, Director Department of Public Works LLR CC: Susan Hendricks, Finance Director Attachments • CLARKSTON GARDENS SUBDIVISION STORM WATER DRAINAGE (Clarkston High School Relief Sewer) PROJECT SCOPE Background There is an existing seven (7) acre wetland system located on the Clarkston School District property, adjacent to Clarkston Gardens Subdivision, which has no outlet and collects storm water runoff from the subdivision as well as a portion of the Clarkston School District property. The wetland system relies entirely on percolation and evaporation to maintain its level. Due to the size of the area contributing to the wetland system, it is unable to provide adequate storage of storm water runoff and has flooded the adjacent subdivision on at lest seven (7) occasions in the past three (3) years, resulting in ditch flooding, street flooding, yard flooding and house flooding. Emergency pumping has been required every year due to the flooding situation. The relief sewer will allow the wetland to function and provide a high level overflow for storm runoff to prevent future subdivision flooding problems. Project Description Construction of an outlet storm sewer, from the wetland system on the high school property, (approximately 3,500 lineal feet) to the south, to outlet into Gulick Lake. The relief sewer route originates at the Clarkston School District property located on Flemings Lake Road and extends along Church Street, Pear Street, and Snowapple Drive, terminating at the wetland system adjacent to Gulick Lake. The relief sewer is 15-inch diameter pipe with manholes placed at appropriate locations along the route for access and maintenance purposes. The sewer line was constructed along the edge of the road for the most part, with the subject subdivision roads, under County jurisdiction, being restored in accordance with the Road Commission for Oakland County requirements. The storm sewer is to be owned, operated, and maintained by the Charter Township of Independence. Project Cost It is anticipated that the final project cost will come in at approximately $415,000. This consists of contractor payments and construction inspection services totaling $350,000. The total engineering budget (plans and specifications, construction administration, construction layout, materials testing, and as-built plans) is estimated at $65,000. BOX 69 CLARKSTON, MICHIGAN 483470069 OAKLAND COUNTY ENVIRONMENTAL INFRASTRUCTURE FUND Resolution of Support For Clarkston Gardens Subdivision Storm Water Drainage WHEREAS, the Oakland County Board of Commissioners has established an Environmental Infrastructure Program to assist Oakland County cities, villages and townships in addressing clean water and storm water needs; and WHEREAS, Oakland County's Environmental Infrastructure Fund Program authorizes Oakland County cities, villages and townships to apply for reimbursement of eligible expenses incurred in connection with environmental remediation or improvements relating to ground and/or surface water, water supply, sewer and/or drainage systems and/or water pollution efforts incurred as part of a city, village or township road project . and WHEREAS, the Charter Township of Independence is interested in constructing an outlet storm sewer from a seven acre wetland system located on Clarkston School District property which has caused ditch, street, yard, and house flooding in the Clarkston Garden Subdivision the last three years requiring emergency pumping; and WHEREAS, the Charter Township of Independence does recognize that only those expenses directly related to construction of a drainage system would be eligible for consideration of reimbursement. NOW, THEREFORE, BE IT RESOLVED that the Charter Township of Independence does hereby authorize its Finance Director to submit a proposal to the Oakland County Board of Commission- ers to use Environmental Infrastructure Funds for a storm water drainage project in Clarkston Gardens Subdivision, and that this resolution authorizes the appropriate budget adjustments. Mr. Carlisle said that he anticipates that it will be completed within the next 6-9 months if he can get started immediately. He noted that there are still outstanding right-of-way issues that need to be dealt with. Mrs. McCrary asked who the members of the steering committee would be. Mr. Stuart suggested that the committee would consist of two members of the Board members, two members of the Planning Commission, and two owners of property in that area. Mr. Kelly asked if this streetscape would then come back to the Board for approval. Mr. Carlisle said that it will have to have Board approval due to some of the costs involved. Resolution: Oakland County Environmental Infrastructure Fund Mr. Stuart presented a resolution regarding infrastructure funding available to the Township for the Almond Lane drainage project. He said that Oakland County is aware of the request, but requires this resolution to be approved by the Township. Mr. Wenger did not agree with the wording in the third paragraph. He suggested that the words "which have" be changed to "may have" or they could be eliminated completely. Mr. Stuart said that this paragraph does not read to say that that is the one and only cause. He would not support altering the language to suggest that there is some question as to whether the Clarkston School District property has caused this drainage problem. He said that it gives some credence as to why we are dealing with constructing an outlet storm sewer and it is to drain the property from the school district property. Mr. Wenger said that there has not been a definitive decision made as to who is at fault and therefore the wording should be changed. Mr. Kelly said that he reads it to mean that the wetland system located on the Clarkston School District property has caused this and that is not debatable. Mr. Stuart reiterated that there was not a need to change the language. Resolution in Relation to Detroit Metropolitan Airport Mrs. McCrary said that this is being submitted for discussion purposes. She said that she had received many requests from M.T.A. for support in legislation that would not take away local authority. The Charter Township of Brownstone recently adopted a resolution opposing the creation of a State Oversight Contracting Board in relation to Detroit Metropolitan Airport and any other legislation that weakens the "home rule" or usurps the authority of local elected officials. They have asked that we in turn adopt the same resolution. After much discussion it was decided that the consensus of this Board is not to move forward with this resolution and to pass without action. 6. Pension Plan Mrs. McCrary explained that Manulife has submitted a Pension Plan Amendment for consideration as a result of federal IRS changes that have come about. The Township Labor Attorney agrees to the amendment. Motion by Travis, supported by Wenger, to authorize the Clerk as Plan Administrator to sign, on behalf of the Charter Township of Independence, the amendment to the pension plan. The motion carried unanimously. Motion by Travis, supported by Wagner, to enter into closed session at 9:02 p.m. to discuss property negotiations and pending litigation: Carter/Dean. The motion carried unanimously. Motion by Travis, supported by Kelly, to reopen the Regular Meeting at 10:23 p.m. The motion carried unanimously.
