Chairperson, Ladies and Gentlemen:
The General Government Committee, having reviewed Miscellaneous Resolution
#03202 on August 4, 2003, reports with a recommendation that the resolution be
adopted.
Chairperson, on behalf of the General Government Committee, I move
acceptance of the foregoing report.

IN RE: WEST NILE VIRUS FUND REIMBURSEMENT FOR PROJECT IN THE VILLAGE
OF FRANKLIN - FISCAL YEAR 2003 ALLOCATION
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Chairperson, Ladies and Gentlemen:
WHEREAS the Oakland County Board of Commissioners established a
West Nile Virus Fund Disbursement Policy per Miscellaneous Resolution
403060 in an effort to assist cities, villages and townships (CVTs)
with mosquito control measures to prevent the spread of West Nile Virus
and to help protect the health, safety and welfare of the people of
Oakland County; and
WHEREAS pursuant to the Disbursement Policy, the Village of
Franklin has submitted a resolution of authorization to the County for
reimbursement of expenses incurred in connection with an eligible
mosquito control project; and
WHEREAS the FY 2003 authorized amount of funding for the Village
of Franklin is $1,290.18 from the West Nile Virus Fund as repayment to
the Village of Franklin for expenses incurred in connection with
mosquito control projects.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of
Commissioners approves the project submitted by the Village of Franklin
as eligible for reimbursement from the West Nile Virus Fund.
BE IT FURTHER RESOLVED that the Board authorizes the FY 2003
appropriation in the amount of $1,290.18 from the West Nile Virus Fund
(Account 490-210000-23030-9098) to repay the Village of Franklin for
expenses incurred in connection with the mosquito control project, once
proper invoices are presented.
Chairperson, I move the adoption of the foregoing resolution.

Dear Tim,
I have been in contact with Mr. Jon E. Stoppels regarding his West Nile Virus
Fund Reimbursement request for the Village of Franklin. At this time, he has been
informed that the dispensing of larvacide briquettes to his community is
allowable. However, each citizen must inform the Michigan Department of
Environmental Quality as to their use. Sylvia Heaton, the contact person at the
MDEQ, is responsible for water quality and has developed an on-line application
process for residents to fill out. There is no approval process, they just want to
keep track of where these briquettes are being used.
At this time, I would be inclined to approve the reimbursement amount requested
of $776.68. Should you have any questions, please direct them to me at 858-1410.

Dear Tim:
I am in receipt of a letter from a Mr. Jon E. Stoppels dated April 16, 2003, at which time he requested
West Nile Virus Fund reimbursement for the Village of Franklin. In his request, he is seeking
reimbursement for larvacide they have purchased from Specialty Chemical Applications Company in the
amount of $776.68. Mr. Stoppels has followed all of the guidelines as outlined in your sample cover
letter, including an attachment that lists the project description, the governing body resolution, as well as
the expense voucher or invoice. However, the part that I am questioning is the dispensing of larvacide
briquettes to villagers to use in their personal ponds, pool covers and wetland areas.
According to the Michigan Department of Environmental Quality (MDEQ), in order for anyone to use
larvacide a permit must be acquired from the MDEQ. I recently had a conversation with Sylvia Heaton,
who is in charge of this Division, at which time she indicated to me that there has been much confusion
over this issue. I contacted Mr. Stoppels on April 28 and informed him that he needs to contact Sylvia
Heaton to determine whether or not what he is doing with the larvacide is allowable under law.
Therefore, at this time, I am holding this reimbursement until I get clarification from the Michigan
Department of Environmental Quality as to whether or not this type of distribution will be allowed. When
I have a concrete answer, I will get with you on the approval or rejection of this request.

Village of Franklin hereby requests reimbursement under Oakland County's West Nile Virus
Fund Program for expenses incurred in connection with an eligible mosquito control activity by
our Village.

The Village understands that the review and processing of this reimbursement request will be
governed by the provisions of MR 03060, and certifies that all expenses submitted for

WEST NILE VIRUS FUND EXPENSE REMBURSMENT REQUEST
PROJECT DESCRIPTION:
The Village of Franklin purchased Larvacide briquettes from the Specialty
Chemical Applications Company for the amount of $776.68, received on April 9, 2003.
As noted in our March 2003 QUORUM (Village Council Newsletter to Villagers), these
items were purchased for the Villagers to use in their ponds, pool covers, and wetland
areas.

At a regular meeting of the Village Council of the Village of Franklin (the "Village"), held on the
1441 day of April, 2003.
Present: James Paulas, H. Fred Gallasch, Randy McElroy, Ralph Sosin, Brian Coyer
Absent: Florence Saltzman, Alan Harnisch
RESOLUTION AUTHORIZING WEST NILE VIRUS FUND
EXPENSE REIMBURSEMENT REQUEST
WHEREAS, upon the recommendation of the Oakland County Executive, the
Oakland County Board of Commissioners has established a West Nile Virus Fund
Program to assist Oakland County cities, villages and townships in addressing mosquito
control activities; and
WHEREAS Oakland County's West Nile Virus Fund Program authorizes Oakland
County cities, villages and townships to apply for reimbursement of eligible expenses
incurred in connection with personal mosquito protection measures/activity, mosquito
habitat eradication, mosquito larviciding or focused adult mosquito insecticide spraying
in designated community green areas; and
WHEREAS the Village of Franklin, Oakland County, Michigan has incurred
expenses in connection with mosquito control activities believed to be eligible for
reimbursement under Oakland County's West Nile Virus Fund Program.
NOW THEREFORE BE IT RESOLVED that this Council authorizes and directs
its Manager, as agent for the Village of Franklin, in the manner and to the extend
provided under Oakland County Board of Commissioner Miscellaneous Resolution
03060, to request reimbursement of eligible mosquito control activity under Oakland
County's West Nile Virus Fund Program.

reviewed the above referenced resolution and finds:
1. Funding of $1,290.18 is available in the West Nile Virus
Fund for FY 2003 to reimburse the Village of Franklin for
this project; no additional appropriation is required.
2. The Committee recommends adoption of this resolution.
