MISCELLANEOUS RESOLUTION # 03120

IN RE: ENVIRONMENTAL INFRASTRUCTURE FUND REIMBURSEMENT FOR PROJECT IN
THE CHARTER TOWNSHIP OF COMMERCE — FISCAL YEAR 2001, 2002 AND 2003
ALLOCATION
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Chairperson, Ladies and Gentlemen:
WHEREAS the Oakland County Board of Commissioners established an
Environmental Infrastructure Funds and Disbursement Policy per
Miscellaneous Resolution #99093 in an effort to increase the share of
dollars flowing into infrastructure projects for the County and its
cities, villages and townships (CVTs); and
WHEREAS pursuant to the Disbursement Policy, the Charter Township
of Commerce has submitted a resolution of authorization to the County
for reimbursement of expenses incurred in connection with an eligible
environment remediation of improvement project; and
WHEREAS the Charter Township of Commerce is requesting
reimbursement for expenses directly related to connecting to the
Detroit water main; and
WHEREAS the FY 2001, FY 2002 and FY 2003 authorized amount of
funding for the Charter Township of Commerce is $117,321.87 annually
from the Environmental Infrastructure Fund as repayment to the Charter
Township of Commerce for expenses incurred in connection with
environmental remediation or improvement projects.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of
Commissioners approves the projects submitted by the Charter Township
of Commerce as eligible for reimbursement from the Environmental
Infrastructure Fund.
BE IT FURTHER RESOLVED that the Board authorizes a FY 2001, FY
2002 and FY 2003 appropriation in the amount of $117,321.87 annually
from the Environmental Infrastructure Fund (Account #90-263206-41000-
3985) to repay the Charter Township of Commerce for expenses incurred
in connection with environmental remediation or improvement projects,
once proper invoices are presented.
Chairperson, I move the adoption of the foregoing resolution.

Dear Tim:
On April 8, 2003 at a Regular Township Board Meeting, Item 11, B of the agenda,
Environmental Infrastructure Funds was brought to the Board of Trustees. Enclosed you
will find a copy of the Commerce Township Board of Trustee motion to approve the last
three years of the Environmental Infrastructure funds of $117,321.87 per year for a total
of $351,965.61 to be used, in part, to pay for a water tap fee required for a 42" Detroit
water main that will cost $1,204,000.00. The tap required will be located at Maple Road
and Benstein Road and it will be the source of city water to the south west portion of
Commerce Township.
We would appreciate the County's approval for the use of these funds for the above
project. We do not think we will be able to complete this project in the 2003 year so we
want to be sure these monies are allocated for its use.

B. Environmental infrastructure Funds
MOTION by Munro, supported by Gross, to draft a Resolution to the County of
Oakland approving the use of the last 3 years of the County Environmental
Infrastructure Funds in the amount of $117,321.87 per year for a total of
$351,965.61 to be used in part to pay for water tap fee required for a 42" Detroit
Water Main that will cost $1,204,000.00. MOTION CARRIED UNANIMOUSLY
C. Traffic Signal Re-timing
MOTION by Long, supported by Munro, to approve a Resolution for the Road
Commission for Oakland County supporting the Traffic Signal Retiming Project in
Commerce Township and authorize the clerk to sign the Resolution.

D. Flag for 52-1 st Court
MOTION by Sovel, supported by Maga!ski, to approve the purchase of one (1)
community flag and stand at a cost of $94.77 to be placed in the 52-1st
Courthouse. MOTION CARRIED UNANIMOUSLY
Job Description for Building/Zoning Director
MOTION by Sovel, supported by Gross, to approve the job description for
Building/Zoning Director at an annual starting salary of $55,000.00.

Pursuant to Rule XII-C of this Board, the Finance Committee has
reviewed the above referenced resolution and finds:
1. Annual funding of $117,321.87 is available in the
Environmental Infrastructure Fund for FY 2001, FY 2002 and
FY 2003 to reimburse the Charter Township of Commerce for
this project; no additional appropriation is required.
2. The Committee recommends adoption of this resolution.
