HomeMy WebLinkAboutResolutions - 2003.09.04 - 27360MISCELLANEOUS RESOLUTION #03220 BY : Christine Long, District #7 IN RE: ENVIRONMENTAL INFRASTRUCTURE FUND REIMBURSEMENT FOR PROJECT IN THE CHARTER TOWNSHIP OF MILFORD - FISCAL YEAR 2003 ALLOCATION TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Chairperson, Ladies and Gentlemen: WHEREAS the Oakland County Board of Commissioners established an Environmental Infrastructure Funds and Disbursement Policy per Miscellaneous Resolution #99093 in an effort to increase the share of dollars flowing into infrastructure projects for the County and its cities, villages and townships (CVTs); and WHEREAS pursuant to the Disbursement Policy, the Charter Township of Milford has submitted a resolution of authorization to the County for reimbursement of expenses incurred in connection with an eligible environment remediation of improvement project; and WHEREAS the Charter Township of Milford is requesting reimbursement for expenses directly related to the following projects: Wastewater Treatment Plant and Collection System, Stormwater Management and Landfill Monitoring Wells; and WHEREAS the FY 2003 authorized amount of funding for the Charter Township of Milford is $39,164.29 from the Environmental Infrastructure Fund as repayment to the Charter Township of Milford for expenses incurred in connection with environmental remediation or improvement projects. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approves the project submitted by the Charter Township of Milford as eligible for reimbursement from the Environmental Infrastructure Fund. BE IT FURTHER RESOLVED that the Board authorizes the FY 2003 appropriation in the amount of $39,164.29 from the Environmental Infrastructure Fund (Account #90-263214-41000-3985) to repay the Charter Township of Milford for expenses incurred in connection with Wastewater Treatment Plant and Collection System, Stormwater Management and landfill Monitoring Wells projects, once proper invoices are presented. Soave, Manager Project Description Environmental Infrastructure Fund Milford Township Dear Mr. Soave: Pursuant to Oakland County Board of Commissioners Miscellaneous Resolution 99093, Milford Township hereby requests reimbursement under Oakland County's Environmental Infrastructure Fund Program for expenses incurred in connection with eligible Environment Remediation or Improvement Projects. We are requesting the balance of our available funds be allocated to the following projects: Wastewater Treatment Plant and Collection System We have hired our consulting engineers, Hubbell, Roth and Clark, Inc. (MC) to do a finalized version of the wastewater treatment plant and collection system. The entire system has been evaluated to include 31/2 miles of collection system and wastewater plant expansion by lmgd. The cost estimate is between $22,000 and $30,000. Stormwater Management Milford Township has met the DEQ requirements to date for Stormwater Phase II and is in the process of setting up sampling and enforcement. Other processes are being required by the DEQ and our engineers calculate these fees to be between $3,000 and $10,000. Landfill Monitoring Wells Milford Township has a landfill that is listed on the Super Fund Clean Up, and we all Re: 1100 Atlantic Street • Milford, Michigan 48381-2000 • (248) 685-8731 • Fax (248) 685-9236 Website: milfordtownship.com know there is no money left in this fund. We are in the process of installing monitoring wells at several specific locations in the area. On going sampling will be required and the initial cost estimate is between $65,000 and $90,000. The Township understands that review process of this reimbursement request will governed by the provisions of Resolution 99093 and certifies that all expenses submitting for reimbursement will be in accordance with a connection to a qualifying environmental remediation or improvement project. We anticipate spending the remainder of the Environmental Infrastructure Fund will be expended with these projects. Subject to the approval of these projects by the Board of Commissioners, invoices showing the expenses incurred by the Township will be forwarded to your office along with our request for reimbursement. Booth, File REGULAR BOARD MEETING MAY 21, 2003 CHARTER TOWNSHIP OF MILFORD PAGE 10 ADOPTION, TOWNSHIP REQUIREMENTS FOR COMMUNITY SEWER SYSTEMS Supervisor Green stated that HRC has prepared a guidance package for developers that states the Township's requirements for community sewer systems. Treasurer Dagenhardt moved, Trustee Worrell seconded to approve the Adoption of the General Guidance for Community Sewer Systems as presented by HRC and approved by the Township Attorney. Vote unanimously carried. JOINT DEFENSE AND CONFIDENTIALLY AGREEMENT, FORMER MILFORD SANITARY LANDFILL Supervisor Green stated this document, if approved, would state the Township's intent to partner with Milford Village to fulfill whatever remediation the DEQ determines is necessary. Mr. Seglund said the agreement would show that the Township is working with the Village in good faith to clean up the site. Treasurer Dagenhardt moved, Trustee Wiltse seconded to approve the Joint Defense and Confidentiality Agreement for the Former Milford Sanitary Landfill. Vote unanimously carried. RESOLUTION ENVIRONMENTAL INFRASTRUCTURE FUND DISTRIBUTIONS Supervisor Green explained that the Township can apply to the County for reimbursement of certain eligible expenses incurred for environmental remediation or ground/surface water, water pollution control, sewer/drainage improvement projects. Trustee Mazzara moved, Treasurer Dagenhardt seconded to approve the Resolution Authorizing Environmental Infrastructure Fund Expense Reimbursement Request. Vote unanimously carried. INTRODUCTION, ORDINANCE AMENDMENT 156-A-103, NONCONFORMING USE Treasurer Dadenhardt moved, Clerk Schwartz seconded to introduce Ordinance Amendment 156-A-103, Nonconforming Use. Vote unanimously carried. INTRODUCTION, ORDINANCE 25a, KENSINGTON METROPARK ORDINANCE Mr. Richard Shafer, Park Superintendent, explained that HCMA is seeking consistency, by Ordinance, with the swimming policy posted and enforced at all Metroparks, which is driving the request for the change in the Ordinance. FISCAL NOTE (M.R. #03220) September 4, 2003 BY: FINANCE COMMITTEE, CHUCK MOSS, CHAIRPERSON IN RE: ENVIRONMENTAL INFRASTRUCTURE FUND REIMBURSEMENT FOR PROJECT IN THE CHARTER TOWNSHIP OF MILFORD - FISCAL YEAR 2003 ALLOCATION TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Chairperson, Ladies and Gentlemen: Pursuant to Rule XII-C of this Board, the Finance Committee has reviewed the above referenced resolution and finds: 1. Annual funding of $39,164.29 is available in the Environmental Infrastructure Fund for FY 2003 to reimburse the Charter Township of Milford for this project; no additional appropriation is required. 2. The Committee recommends adoption of this resolution. FINANCE COMMITTEE C FINANCE COMMITTEE Motion carried unanimously on a roll call vote.
