AMENDMENT
To the Oakland County Board of Commissioners
Chairperson, Ladies and Gentlemen:
WHEREAS the State of Michigan amended the Jail Reimbursement Program for FY 04 to exclude
OUIL III offenders with a sentencing guideline score in the intermediate range; and
WHEREAS the State set aside a portion of the actualized savings from that amendment to fund a
new initiative, "The Drunk Driver Jail Reduction and Community Treatment Program"; and
WHEREAS Oakland County's allocation of this fund is $760,050 for a full year and $570,038 for
the remaining nine (9) months of FY 04; and
WHEREAS this funding is being funneled through the State Office of Community Corrections;
and
WHEREAS any programs created through this fund will become part of the County's
Comprehensive Community Corrections Plan; and
WHEREAS PA 511 of 1988 requires that the "county board or boards of commissioners of the
county... shall approve the proposed comprehensive plan prepared by their advisory board..."; and
WHEREAS this application is an amendment to the existing comprehensive plan, and therefore
requires Board approval.
NOW THEREFORE BE IT RESOLVED that the proposal to request $570,038 from the State
Office of Community Corrections for the purpose of initiating the program contained within the grant
application for OUIL III offenders is hereby approved.

A. Program Overview
1. Please summarize the proposed local Drunk Driver Jail Reduction And Community Treatment Program.
The program established by Oakland County for the OUIL III offender seeks to accomplish the following
goals:
• - To reduce the length of stay in jail for this population (see #2 for more detail).
- To provide for a structured sentencing of these offenders that includes the appropriate level of
care/treatment and accountability.
- To eliminate the reoccurrence of future drunk driving offenses through monitoring of alcohol consumption
and treatment.
This:program targets OUIL III offenders who have an SGL that fails within an intermediate sanction cell.
Offenders with and SGL falling in the straddle cell range may be considered for the Adult treatment Court.
Regardless of SGL score, all offenders who are convicted for OUIL III will be required to submit to a NEEDS
assessment. All assessments will be conducted by current staff of the zero tolerance program on a fee for
service basis. For offenders who are in custody these assessments will take place ideally within the first 5
days of incarceration. These offenders will aiso be a priority to enter the Chemical Dependency Class while
at the jail. Results of the assessment, including the Level of Care (LOC) will be forwarded to the Probation
Department for inclusion in the PSI recommendation no later than 7 days prior to sentencing. Structured .
sentencing recommendations will be based on the defendants LOC(Appendix. 1), all sentence
recommendations will include: a short period of incarceration, a treatment phase,.eleCtronic alcohol
monitoring through SCRAM, and an aftercare component comprised of random PBTs and Support meetings.
Offenders will also be placed on an 18 month probationary term. Every offender coming out of residential
'treatment will be referred to the Step Forward program. The provider will send the Step Forward program a
copy of the offender's discharge and follow up plan. This will allow offenders to seamlessly continue their
treatment from one milieu to another. in addition, offenders will be able to access other services available at
Step Forward such as job training, a faith based group, etc. Technical violations detected through either the
SRAM system or through the random PBTs will be handled administratively. Graduated sanctions will
consist of 10, 20 and 30 days in Community Programs Incorporated, a forth violation will result in a formal
show cause before the respective Judge.
2. Provide an explanation of how drunk driving and drunk driving-related deaths will be reduced and/or how
the use of the local jail will be improved while maintaining public safety, as a result of the implementation
of the local Drunk Driver Jail Reduction And Community Treatment Program.
. In order to significantly impact drunk driving and drunk driving related deaths, offenders must receive
treatment in conjunction with their punishment. At present many of the OUIL III offenders in Oakland County
receive sentences to the work release program. While these sentences allow the offender to remain
employed in the community, they are not treatment focused. The emphasis is on employment first and
treatment is generally an after thought. Therefore, offenders are often destined to recidivate because they
• have not received the treatment, tools, and help they need to live a clean and sober lifestyle:
Assessing the offender's need for treatment prior to sentencing places the foods on the appropriate level of
treatment. The structured sentencing provides consistent monitoring that gradually lessens as the offender
gets closer to the end of the probationary period. This gives the offender parameters but also prepares
them for reintegration into the community on their own. This approach will better prepare offenders to lead a
• clean and sober lifestyle and reduce drunk driving and drunk driving deaths.
The utilization of the jail will be improved under this program. At present the average LOS for OLIIL III
offenders is 124 days (according to Oakland County Jail data). By limiting The amount of jail time an OWL LII
offender can spend in jail to no more than 90 days, we will be saving 34 days on each offender. When this
is multiplied by 300 offenders this results in savings of 10,200 jail days, which divided by 365 will yield,28
empty beds in a year. These beds can then . be filled with non-violent straddle cell offenders, thereby
reducing the prison commitment rate. All things being equal, this reduction would bring the straddle cell
commitment rate to 31% (from 34%) and lower the overall prison commitment rate from 22% to 21%.
Although the net number of offenders in the jail would remain the same an additional 28 straddle cell
offenders could generate $300,000-$400,000 in revenue from the Jail Reimbursement Fund. Public safety
will be maintained or improved due to the inOreased level of monitoring that will be required of each

• Proposed Budget:
Provide an explanation of the ,proposed budget, and attach a budget adjustment form relative to
amendments in the award of funds for FY 2004. - Please refer to the Drunk Driver Jail Reduction and
Community Treatment Program Fund spreadsheet (Appendix 2) to determine the maximum award
available.
The allocated monies will be used for a wide array of treatment services and monitoring equipment. The
budget is based on 300 offenders coming into the program over an 8 month period:

An existing staff member will monitor the offenders while- on the SCRAM unit. This cost will be charged to
the Intensive Supervision line item of the current P& S budget. It is estimated that she will spend 50% of her
time in this function for 6 months at a. cost of $14,544. Case managers in the Step Forward program are
already handling several of these offenders and therefore no changes to the budget will occur for this
function.

. To be eligible offenders will need to have a demonstrable substance abuse problem as verified through a
, comprehensive standardized assessment. The type and level of treatment for an individual will be based on how
the offender scores according to ASAM criteria. Offenders who score level 0 will be referred to educational
classes, offenders scoring level 1 will be referred to outpatient treatment, level 2 will be referred to an 10P, and only
level 3 will qualify for residential treatment.

, Program Description: .
Each offender referred to the Step Forward program is required to under go an intake. The intake process is an
assessment to determine the risk level of the offender as well as the "need" of the offender. In addition to a
standardized personal interview, the offender is given the NEEDS assessment by ADE. - The State Office of
Substance Abuse recognizes this instrument as a valid assessment tool, it provides a DSM IV diagnosis and a
LOCI (level of care Index) according to ASAM criteria. Based on the outcome of the assessment an individualized
supervision plan is drafted for each offender. The Step Forward program has its SARF (Screening, Assessment,
Referral, and Follow-up) license from the State of Michigan. All intake staff has a master's level education, is a
CAC (Certified Addictions Counselor), or has their C-ARMS (Certified Assessment and Referral Management
Specialist)..
Under the expanded program OUIL III offenders will be given the NEEDS as part of a comprehensive substance

abuse _assessment The assessments will be conducted by jail staff on a fee for service basis of $45.00 per
assessment. For offenders who are in custody this assessment will take place, ideally within the first 5 days of their
incarceration. This.assessment will also help target individuals who may be appropriate to enter the jail's Chemical
dependency class.

How does this,program reduce prison commitments, improve jail utilization, or impact recidivism? How. does the
• program relate to the goals and objectives developed within the strategic planning process?
To assess each offender referred into the program to determine the appropriate level of risk and needed services.
Through the appropriate matching of services offenders will have a higher likelihood or success thereby reducing
the risk of future recidivism and incarceration. .
The above objective remains the same for the expanded drunk driving assessments. Matching offenders with the
appropriate level of care is key to success.

During the initial 5 days in custody every effort will be made to provide these offenders with a drug and alcohol
assessment. Based on the outcome of this screening and assessment offenders may qualify for the in-jail
Chemical Dependency Class. Any program participation will be forwarded to the Probation Agent for -
consideration in a sentencing recommendation. '

The objective of the 5 day reimbursement is to assess offenders as quickly as possible upon their entrance
into the jail. Completion of such tasks on the front end ensure that sentencing and placement go smoothly
without wasting unnecessary jail days.

For a period of up to 180 days.

describe how offenders get into the program, e.g. who is responsible for assessing offenders risk/need,
referral and enrollment, development of service plan, monitoring progress, reporting to probation agents, etc.;
Provide information regarding instrument(s) used to determine eligibility and guide the development of
individualized service plans, determining eligibility policies and practices to maintain continuity of programming
if services are offered in the jail and other community settings. .
Offenders will have spent up to 90 days in jail. Some will then go to residential and then go on the SCRAM
unit, all others will go on the SCRAM unit directly (within 72 hours) upon release form jail. House Arrest
Services will be providing the equipment and tether installation. Currently HAS has an exclusive contract with
the manufacture of this equipment. HAS will notify Community Corrections personnel of all violations and
reports for action. Community Corrections staff will be monitoring reports and notifying agents as necessary.
This will ensure that there is consistency in the "interpretation" of the reports as well as keeping. the agents
workload from swelling. A portion of the money assigned to this line item ($324,000) will be used to pay for
part of the SCRAM cost. The remaining money will be used to pay 50% of the personnel cost for 6 months.

The objective of this program is to add another layer of monitoring and accountability. This system, although
not foolproof, offers for the first time the ability to monitor alcohol intake over long periods of time. Having the
offender on this system for up to 6 months will reinforce what the offender has learned in treatment and aid in
the behavior modification of the individual.

Program Description:
Licensed screening an assessment program which offers an array of client services within one location. Clients are
matched to appropriate services through an individualized supervision plan based on the result of a standardized
risk/needs assessment instrument (NEEDS) and a personal interview. Case managers act as mentors, monitor
client compliance' and report progress to the appropriate referral agency.
The main function of Step Forward will remain the same. The new monies will be used to contract for additional
. Level / and Level II groups at the Step Forward program for drunk drivers. This money will also fund lOPs for
offenders who do not have insurance or are under-insured. The contract will be a fee for service through the
Oakland County Substance Abuse Office (coordinating Office).

A recent policy change will require that all offenders leaving a PRC be referred to Step Forward for "aftercare" while
this may increase the number of clients in the program, the concept is to make the PRC and Step Forward appear
as one continuos program. Through this extension of service the judges may be more willing to reduce the LOS in
the jail on the front end.
In addition offenders who will no longer be eligible for PRC placement due to an ASAM LOCI of I will be referred to
Step Forward. This will allow Community Corrections to control the utilization of beds and still move offenders out
of the jail.
By having a more seamless transition form residential to community services offenders should be more apt to
succeed. By increasing the success rate and lowering the recidivism rate among this population jail beds will be
saved and in the long term prison beds as well.

residential provider. This will augment our current PRC beds available by 15, coded under H20-19.

offenders being referred as a result of the Drunk Driver program may require additional groups to be •
added. These groups will be contracted through the Oakland County Office of Substance Abuse and will
be a per service contract.

v $324,000 is being allocated to equipment to fund a portion of the SCRAM unit per diem cost. This will be a
contract with House Arrest Services to provide the equipment. At this time HAS has an exclusive contract
with the manufacture so this equipment is not available through any other vendor.

V. $65,250 will be used to reimburse the Oakland County Jail for housing costs of the OUIL III for the
allowable 5 days. During this time the jail will make offenders accessible for screening and assessment.
3. Evaluation: Briefly describe the program evaluation plan to monitor and/or modify the program.

Every offender who is assessed by the Sheriff's Department will be tracked through the system wether or not
they enter the program. Offenders Sentenced into the program will be compared with offenders who are not,
for differences in recidivism rates. Offenders who are in the program will be evaluated in each phase of the
program; completion of treatment, completion of SCRAM, completion of aftercare plans. Within each of these
phases the length of stay, progress, completion and number and type of violations will be monitored. All new
offense behaviors wine tracked however new drunk driving arrests will be the focus of the overall evaluation.
In addition the LOS in the..0akland County Jail for OUIL III offenders will be monitored. It its expected that there
will be a 28% reduction in the LOS.

Evaluation: * currently statistical information regarding the recidivism rate for OU1L III is not readily available. We will use the Statewide figure of 70% recidivism for
OUIL III as a benchmark. The number of Judges using the program will be monitored to determine if the educational presentations had any effect. All offenders will
be tracked through the program to determine successful completion as well as number of violations and 'any new arrests. The jail LOS for this population will be run
. monthly/ quarterly to determine if the,goal has been met.

All offenders convicted of Mil Ill that have sentencing guideline scores that fall into the
intermediate sanction cells would be required to submit to an alcohol assessment. The
assessment would be conducted using a standardized tool such as the NEEDS, which provides a
DSM IV diagnosis as well a Level of Care based on ASAM (American Satiety of Addiction
Medicine) criteria. The Level of care determines the intensity of treatment required: residential,
intensive outpatient, outpatient, or education. The assessment will be passed to the probation
agent for incorporation into the PSI recommendation. The following scenarios are based of these
levels of care.
Level 3 Residential Treatment
InCarceration 30-90 days •
Treatment phase Residential Trea:ment for up to 90 days/ upon release from residential up
to 180 days on the SCRAM unit
Aftercare Refer to Step Fol-ward for continuation of care follow through on
discharge plan, attendance at 12 step meetings
90 days random PBTs
18 months probation
Level 2 Intensive Outpatient Treatment
Incarceration 30-90 days
Treatment phase Intensive Outpatient (3-4 times per week up to 8 weeks)/ 12 step
meetings! up to 120 days SCRAM unit
Aftercare 60 days random PBTs and refer to Step Forward for on going support
