Wilson, District #3 IN RE: ENVIRONMENTAL INFRASTRUCTURE FUND REIMBURSEMENT FOR PROJECT IN THE CHARTER TOWNSHIP OF OAKLAND - FISCAL YEAR 1999, 2000, 2001, 2002 AND 2003 ALLOCATIONS TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Chairperson, Ladies and Gentlemen: WHEREAS the Oakland County Board of Commissioners established an Environmental Infrastructure Funds and Disbursement Policy per Miscellaneous Resolution 499093 in an effort to increase the share of dollars flowing into infrastructure projects for the County and its cities, villages and townships (CVTs); and WHEREAS pursuant to the Disbursement Policy, the Charter Township of Oakland has submitted a resolution of authorization to the County for reimbursement of expenses incurred in connection with an eligible environment remediation of improvement project; and WHEREAS the Charter Township of Oakland is requesting reimbursement for expenses directly related to the Twin Lakes Well House and Knorrwood Knolls Well House Connection, Gallagher Road Water Main, and Water Treatment at the Plum Creek Well House Projects; and WHEREAS the FY 1999, FY 2000, FY 2001, FY 2002 and FY 2003 authorized amount of funding for the Charter Township of Oakland is $55,185.61 annually from the Environmental Infrastructure Fund as repayment to the Charter Township of Oakland for expenses incurred in connection with environmental remediation or improvement projects. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approves the projects submitted by the Charter Township of Oakland as eligible for reimbursement from the Environmental Infrastructure Fund. BE IT FURTHER RESOLVED that the Board authorizes the FY 1999,- FY 2000, FY 2001, FY 2002 and FY 2003 appropriations in the amount of $55,185.61 annually from the Environmental Infrastructure Fund (Account #90-263217-41000-3985) to repay the Charter Township of Oakland for expenses incurred in connection with the water treatment, water main, and water connection projects, once proper invoices are presented. Telegraph Road Pontiac, Michigan 48341 Re: Environmental Infrastructure Fund Reimbursement Request Dear Mr. Ott: Pursuant to Oakland County Board of Commissioner Miscellaneous Resolution (MR) 99093, the Charter Township of Oakland hereby requests reimbursement under Oakland County's Environmental Infrastructure Fund program for expenses incurred in connection with an eligible environmental remediation of improvement project under by our Township. Attached please find project descriptions (3) and the May 25, 2004 minutes referencing the Charter Township of Oakland Board of Trustees action. The Township understands that the review and processing of this reimbursement request will be goVemed by the provisions of MR 99093, and certifies that all expenses submitted for reimbursement were incurred in connection with a qualifying environmental remediation of improvement project. Creech Township Superintendent ATTACHMENT A PROJECT DESCRIPTION Twin Lakes Well House and Knorrwood Knolls Well House Connection This project will connect two (2) independently operating well houses; each serving its own subdivision. Approximately 2000 lineal feet of 12 inch diameter water main is proposed, which includes the replacement of approximately 950 lineal feet of 8 inch diameter water main. The connection will provide reliability and redundancy to the existing Township Water Supply System. Flow characteristics will be improved by providing more volume and reliable system pressures. Fire fighting capabilities will be improved. In the event that one of the well systems is shut down for 'any reason, the other well system will be able to serve both subdivisions on a temporary basis. The estimated project cost is $187,757.00. No costs have been incurred at this time. ATTACHMENT A PROJECT DESCRIPTION Gallagher Road Water Main This project will bring public water main and fire protection to the Goodison Area located at Orion Road and Collins Road and will also serve the Oakland Township Municipal complex on Collins Road. Residents in the area are currently utilizing individual on-site wells and there is no fire protection in the area. The estimated project cost is $350,000.00. No costs have been incurred at this time. ATTACHMENT A PROJECT DESCRIPTION Water Treatment at the Plum Creek Well House This project would treat water at the Plum Creek Well House site to reduce concentrations of iron and arsenic. The estimated project cost is $500,000.00. No costs have been incurred at this time. CHARTER TOWNSHIP OF OAKLAND BOARD OF TRUSTEES ***DRAFT*** May 25, 2004 The May 25, 2004, meeting of the Charter Township of Oakland Board of Trustees was called to order at 7:06 p.m. in the Township Hall. Clerk Platz called the roll. PRESENT: Susan Hoffman, Supervisor Lisa Platz, Clerk Amy Boltz, Trustee Marc Edwards, Trustee Jeffrey Phillips, Trustee James Creech, Manager Kristin Bricker Kolb, Attorney ABSENT: Sharon Creps, Treasurer James Derian, Trustee A quorum was present. PLEDGE OF ALLEGIANCE Supervisor Hoffman led those present in the Pledge of Allegiance. APPROVAL OF MINUTES MOVED BY BOLTZ, SECONDED BY PHILLIPS, to approve the minutes of the May 11, 2004, meeting as presented. MOTION CARRIED. AMENDMENTS TO AND APPROVAL OF AGENDA There were no proposed changes to this evening's agenda. MOVED BY PLATZ, SECONDED BY EDWARDS, to approve the agenda as presented. MOTION CARRIED. CITIZENS: Janine Saputo — Friends of Bald Mountain Janine Saputo of 2303 W. Predmore Road was present. She stated that on June 3 rd at 7:30 p.m., the Friends of Bald Mountain will be hosting a meeting with Anna Sylvester, the District Supervisor, regarding plans for the park. Ms. Saputo invited those present to attend. She noted that this is a particularly good time to learn more about the Bald Mountain park plans as Oakland Township is in the process of updating its master plan. 26 J CHARTER TOWNSHIP OF OAKLAND BOARD OF TRUSTEES ***DRAFT*** May 25, 2004 Trustee Edwards noted that this year the Curamus Terram, the foot race held in conjunction with the Goodison Good Tyme event, will go through Bald Mountain State Park. He would like to contact the Friends of Bald Mountain for volunteers to help guide runners through the park during the race. ENVIRONMENTAL INFRASTRUCTURE FUND Manager Creech stated that the Environmental Infrastructure Fund is a program operated through the Oakland County Board of Commissioners and is funded from the interest and penalties in the Delinquent Tax Revolving Fund. There is $275,928 available in this fund for Oakland Township. He noted that, by waiting until the last year of the program, Oakland Township avoided the six percent discount per year for using the monies in advance, and therefore Oakland Township is eligible to use the full fund amount. Township Engineer Kalinowski has indicated that there are a number of projects that should be eligible for funding through this program. Oakland Township must apply for project authorization by August 2004, and expenditures must take place before September 2005. Manager Creech said that he anticipates these projects can be completed, substantially completed or engineered prior to that time, and Oakland Township's requests for reimbursement will use all of the available funds. The Board reviewed the proposed projects. MOVED BY PHILLIPS, SECONDED BY BOLTZ, to submit for project approval under Oakland County's Environmental Infrastructure program the Twin Lakes Well House and Knorrwood Knolls Well House connection, the Gallagher Road Water Main, and the Plum Creek Well House Wter Treatment improvements as described in the two documents entitled "Attachment A," found in Township Engineer Mike Kalinowski's letter of April 22, 2004. MOTION CARRIED. HISTORIC DISTRICT COMMISSION APPOINTMENTS Historic District Commission (hereinafter "HDC") Chairperson Donna Cherry was present along with Jeanne Phillips and Diana Borrusch, whose terms on the HDC expire this month. Supervisor Hoffman stated that the Board of Trustees needs to decide how it will fill the positions on the HDC held to this point by Ms. Phillips and Ms. Borrusch. Ms. Borrusch has indicated that she would like to continue to serve on the HDC. Jeanne Phillips has also indicated that she would be willing to continue to serve on the HDC, but only until the Board can find a replacement for her who is the owner of a historic home. 27 ' CHARTER TOWNSHIP OF OAKLAND BOARD OF TRUSTEES ***DRAFT*** May 25, 2004 Supervisor Hoffman said that the Board has received notice from Susan Knudsen, who is a historic homeowner, that she would be interested in again serving on the HDC. Trustee Edwards said that he feels it is important to have historic homeowners represented on the HDC. In the past, there have been some concerns about how Ordinance No. 37A, the Historic District Ordinance, was administered. He felt that a historic homeowner might have a better understanding of the challenges faced by historic resource owners and use this to guide them while administering the Ordinance. Diana Borrusch presented a letter dated May 25 th to the Board, which she also read. She is a charter member of the HDC and continues to serve the historical interests of the Township through the Historic District Study Committee and the Oakland Township Historical Society. She was upset that the Board is "removing" her from the HDC and asked that the Board instead consider renewing her term. Supervisor Hoffman explained that Ms. Borrusch's term on the HDC has expired; therefore, if the Board were to choose not to reappoint Ms. Borrusch, they would not be removing her from the HDC. The Board reviewed the members currently on the HDC. Commissioners Kroger and Zmich are owners of resources protected by Ordinance No. 37A; Commissioner Zmich is also an architect. Commissioners Borrusch, Cherry, Derry, Phillips, and Williams- Workings are not historic homeowners. If Susan Knudsen were appointed, she would be an owner of a historic home, although not a home protected by the Ordinance. Trustee Edwards reiterated his sentiment that the HDC membership should include owners of historic homes. Trustee Boltz, who lives in a home that is protected under the Historic District Ordinance, said that she has firsthand experience that a seemingly simple project can turn out to be a major project with an old house. She said she has always been a strong supporter of having historic homeowners serve on the HDC, as well as having staggered terms. Board members said that they appreciate Ms. Borrusch's work on the HDC. They noted that there are still many opportunities for Ms. Borrusch to remain involved with Oakland Township's history, and they hope that she will continue to share her knowledge and expertise whether she is a member of the HDC or not. Clerk Platz added that she would consider Ms. Bomisch to fill a vacancy in the future. Ms. Borrusch responded that if she is "removed" from the HDC, she does not wish to serve in the future. Trustee Phillips said that he understands the need to have historic homeowners on the HDC, and expressed his regret that there are not enough seats on the Commission for all who are interested in serving, but acknowledged that at this time it may be in the best interest of the Township to have a historic homeowner on the HDC. 28 jr • CHARTER TOWNSHIP OF OAKLAND BOARD OF TRUSTEES ***DRAFT*** May 25, 2004 MOVED BY BOLTZ, SECONDED BY PLATZ, to reappoint Jeanne Phillips to a serve three year term on the Historic District Commission. MOTION CARRIED. MOVED BY BOLTZ, SECONDED BY EDWARDS, to appoint Susan Knudsen to serve a three year term on the Historic District Commission, filling the position previously held by Diana Borrusch. MOTION CARRIED. MOVED BY BOLTZ, SECONDED BY HOFFMAN, to develop a resolution thanking Diana Borrusch for her work for Oakland Township through the Historic District Commission. MOTION CARRIED. Mrs. Boriusch stated that a resolution of thanks is not necessary and, in fact, she would prefer that the Board not do this. Nonetheless, Trustee Boltz will prepare a resolution for the Board's consideration at the next meeting. TOWNSHIP MANAGER'S REPORT Improvements to Intersection of Adams Road and Orion Road Trustee Boltz inquired about the status of this project. Manager Creech responded that he met with a representative from the Road Commission for Oakland County. The contractor for this project went bankrupt and pulled out of the project. Mr. Creech asked the Road Commission to clean up the intersection. The Road Commission has indicated that they will try to complete the project this summer. Audit Manager Creech reported that the Township audit is going well and should be completed later this week. ATTORNEY BRICKER KOLB'S REPORT Recent Case Regarding Rezoning — Need to Exhaust Administrative Remedies Attorney Bricker Kolb stated that the court in a recent Ann Arbor Township case held that a party seeking rezoning must exhaust all administrative remedies before seeking recourse through the court system. Mr. Bricker Kolb said she feels that this will encourage parties to try to resolve issues before bringing a law suit. 29 CHARTER TOWNSHIP OF OAKLAND BOARD OF TRUSTEES ***DRAFT*** May 25, 2004 TRUSTEE PHILLIPS'S REPORTS Markers in Parks to Locate Individuals Trustee Phillips stated that recently there was a situation in Bald Mountain State Park where emergency personnel had difficulty locating an individual who needed medical attention. He said that there is a marker system along the Paint Creek Trailways, and questioned if there should be more markers there. He also suggested that the Township consider having a marker system in place in its various parks. Supervisor Hoffman said that the Fire Department has detailed maps, and this marker system could be coordinated with their maps. Trustee Phillips noted that the next generation of cellular telephone service (anticipated to be completed by the end of 2004) will allow an individual calling from a cellular telephone to be pinpointed to within 60 feet. Improvements to Intersection of Silver Bell Road and Adams Road Trustee Phillips asked how traffic will be impacted during this project. Manager Creech stated that traffic will continue to be able to travel north and south, but will not be able to travel east and west on Silver Bell Road. Silver Bell Road will be closed for between two and three weeks this summer. Trustee Phillips wondered if it would be good to mail postcards to residents advising them of the upcoming construction. Manager Creech felt it would be more effective to post signs at the intersection in advance of the construction. Also, he anticipates that the local newspapers will contain articles about this work. TRUSTEE EDWARDS'S REPORT Household Hazardous Waste Day Trustee Edwards reported that Household Hazardous Waste Day, which took place on Saturday, May 22w, went very well. One hundred and sixty Oakland Township households participated. Improvements at Oakland Christian Church Trustee Edwards reported that a special Planning Commission meeting was held on May 24th with representatives from the Road Commission for Oakland County and Oakland Christian Church regarding the proposed improvements to the church, and specifically where the curb cuts will be on Silver Bell Road. The Road Commission has advised that it is best to have curb cuts across the street from each other (in this situation, across from 30 CHARTER TOWNSHIF' OF OAKLAND BOARD OF TRUSTEES ***DRAFT*** May 25, 2004 the curb cuts to access The Commons shopping center). There will not be a traffic light as this area is too close to the intersection of Silver Bell Road and Adams Road. Master Plan Update The Master Plan Advisory Committee has finished their work on preparing a draft Master Plan. Now the Planning Commission is reviewing the draft and may make modifications to the document before forwarding it to the Board of Trustees. The Board of Trustees will then review the document and may suggest further modifications before it is circulated to the surrounding communities for 90 days to receive comments. During this 90 day period, an open house will be held, which will probably occur towards the end of July. Thereafter, the draft will go back to the Planning Commission for adoption or recommendation, depending on whether or not the Board of Trustees wishes to take authority to adopt the Master Plan, which they can do by resolution. SUPERVISOR HOFFMAN'S REPORTS Introduction of Set. Tony Spencer Supervisor Hoffman introduced Sgt. Tony Spencer, who has been with Oakland Township for approximately one week. Sgt. Spencer said that he looks forward to working with Oakland Township. Memorial Day Activities Supervisor Hoffman stated that there will be a World War II veterans' memorial service held on Saturday morning at the City of Rochester Hills' municipal complex; she will attend. The greater Rochester area Memorial Day parade will take place on Monday morning. Women's Fund Annual Meeting There will be a Women's Fund annual meeting held on June 16 th .
