Crawford, Chairperson IN RE: SHERIFF'S OFFICE - BULLETPROOF VEST PARTNERSHIP PROGRAM GRANT FY 2004 ACCEPTANCE To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS the Bureau of Justice Assistance, Office of Justice Programs, U.S. Department of Justice has awarded the Oakland County Sheriff's Office grant funding for the Bulletproof Vest Partnership Program in the amount of $21,975.74 for the period of October 1, 2003 through September 30, 2004; and WHEREAS the Bureau of Justice Assistance, Office of Justice Programs, U.S. Department of Justice did not award any grant funds for the Bulletproof Vest Program for FY 2003 covering the period October 1, 2002 through September 30, 2003; and WHEREAS Oakland County has been awarded a grant totaling $21,975.74 comprised of Federal funds with no County match, which is a 89.56% reduction from the grant application amount of $210,591.00 per attached Schedule A, for the grant period covering October 1, 2003 through September 30, 2004; and WHEREAS this grant will be used to continue to fund bulletproof vests for the officers of the Oakland County Sheriff's Department; and WHEREAS the grant agreement has been processed through the County Executive Contract Review Process and the Board of Commissioners' Grant Acceptance Procedures. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners accepts grant funding from the U.S. Department of Justice, Office of Justice Programs, Bureau of Justice Assistance in the amount of $21,975.74 covering the grant period October 1, 2003 through September 30, 2004. BE IT FURTHER RESOLVED that the Chairperson of the Board of Commissioners is authorized to execute the grant agreement and to approve any grant extensions or changes, within fifteen percent (15%) of the original award, which are consistent with the agreement as approved. BE IT FURTHER RESOLVED that acceptance of this grant does not obligate the County to any further commitments in the Bulletproof Vest Partnership Program and is contingent upon continued future levels of grant funding. When combined with our appropriation of $25 million and the statutory requirement to provide priority funding to jurisdictions under 100,000 in population, all available resources were committed to the smaller jurisdictions. Hence, this year we will not be able to provide any additional funding to support the purchase of NIJ approved vests for your jurisdiction. The Bureau of Justice Assistance (BJA) has a long and distinguished history of supporting the diverse and challenging missions of state and local law enforcement and public safety agencies. Since BVP began in 1999, BJA has provided $118 million to support the purchase of more than 400,000 vests nationwide. With continuing congressional support, BJA anticipates additional funding opportunities for vest purchases in the coming years and will keep you posted on these opportunities and others. The Bureau of Justice Assistance (BJA) is working with the Office of the Comptroller to create the necessary financial files to support your forthcoming payment requests. We hope to have this completed by mid-June and will send you an email with additional instructions and information at that time. Once the financial records have been created to support your FY04 award, we will begin processing your online payment requests. In the meantime, please feel free to continue making payment requests against prior year awards (if applicable) and with placing orders for new vests contained in your recently approved application, to the extent the purchases are supported by BVP resources (noted above and not to exceed 50% of the total purchase price) with the remaining funds provided by the jurisdiction. Have Your Vest Needs Changed? BJA recognizes that law enforcement agency operational and equipment needs may change. Consequently, participating agencies are not required to purchase the exact number, type or model of vests contained in the approved application. Vests may be purchased at any threat level, make or model, from any distributor or manufacturer, as long as the vests have been tested and found to comply with applicable National Institute of Justice ballistic or stab standards. The original application cannot be changed; any changes in actual purchases are reflected in the online Receipt of Vests, as you prepare an online payment request. All payments are made after applicable vests have been ordered and received. Eligible Officers: Only law enforcement officers may receive vests through this program. According to the Act, "law enforcement officer" means any officer, agent, or employee of a State, unit of local government, or an Indian tribe authorized by law or by a government agency to engage in or supervise the prevention, detection, or investigation of any violation of criminal law, or authorized by law to supervise sentenced criminal offenders. Eligible officers may be full-time, part-time, paid or volunteers. FY 04 Funds Available for Multiple Years: Jurisdictions may request payments from this year's award through September 30, 2008. However, BJA encourages you to utilize available funds promptly, since your application reflects your most immediate vest needs. Payments of federal funds can be requested whenever vests are received. If your jurisdiction received an FY2004 LLEBG award, you may not purchase vests in FY2004 using both LLEBG and BVP funds. Audit Requirements: Procurement transactions and payments are subject to audits by a variety of agencies and organizations. Jurisdictions must follow their local procurement policies and procedures, including maintenance of reliable and accurate accounting systems, record keeping, and systems of internal control. Recipients of federal funds are expected to retain documentation supporting all program transactions for at least three years after the closure of audit reports related to such findings. If any litigation, claim, negotiation, audit, or other action involving records has been started before the expiration of the three-year period, the records must be retained until completion of the action and resolution of all related issues, or until the end of the regular three year period, whichever is later. The Bureau of Justice Assistance Programs, U. S. Department of Justice has awarded the Oakland County Sheriff's Department grant funding in the amount of $21,975.74 covering the period October 1, 2003 through September 30, 2004. 2.
