TO: OAKLAND COUNTY BOARD OF COMMISSIONERS
Chairperson, Ladies and Gentlemen:
WHEREAS funding was released under the U. S. Department of Homeland
Security, through the Office for Domestic Preparedness (ODP), for the State Homeland
Security Grant Program, Part II Training Grant; and
WHEREAS the 2003 ODP State Homeland Security Assessment and Strategy has
indicated a need for first responders to receive awareness-level terrorism training; and
WHEREAS the State of Michigan has awarded Oakland County reimbursement
for qualified training expenses up to, but not exceeding 960,810.79 for the period of
March 1, 2004 through February 28, 2005; and
WHEREAS the funds are to be used for DHS approved Awareness Level
Terrorism and Weapons of Mass Destruction (WMD) training, Chemical, Biological,
Radiological, Nuclear, and Explosives (CBRNE) Defensive Operations training, Unified
Incident Command System training, and attendance at the 2004 Michigan Homeland
Security Training Conference for Oakland County's first responder community; and
WHEREAS the Michigan Department of State Police Emergency Management
Division will serve as the administrating agency for this grant; and
WHEREAS the grant agreement has been reviewed and approved through the
County Executive Contract Review Process.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of
Commissioners accept the grant funding from the State of Michigan in an amount up to
$960,810.79.
BE IT FURTHER RESOLVED that the chairperson of the Board of
Commissioners is authorized to execute the grant agreement and to approve any grant
extensions or changes, within fifteen percent (15%) of the original award, which are
consistent with the original agreement as approved.
BE IT FURTHER RESOLVED that acceptance of this grant does not obligate the
County to any future commitment.

the foregoing resolution.

SUBJECT: Announcement of 2003 State Homeland Security Grant Program (SHSGP)
Part II Training Grant
Announcement: We are pleased to invite eligible local jurisdictions to participate in the 2003 State Homeland Security
Grant Program (SHSGP) Part II Training Grant. Now that data is available for the training solution area for local
jurisdictions that participated in the recently completed State Homeland Security Assessment and Strategy (SHSAS)
initiative, the state is allocating training funds under the 2003 SHSGP, Part II Training Grant.
Consistent with the Statewide Homeland Security Three Year Strategy and the Office for Domestic Preparedness (ODP)
Emergency Responder Guidelines, funding will be used for Awareness Level Terrorism and Weapons of Mass Destruction
(WMD) training, Chemical, Biological, Radiological, Nuclear, and Explosives (CBRNE) Defensive Operations training,
Unified Incident Command System training, and the 2004 Michigan Homeland Security Training Conference.
Target Audience: The target audience for training supported through the 2003 SHSGP, Part II Training Grant must be
emergency responders (fulltime, part-time, volunteer, reserve, and contractual), emergency managers, and public/elected
icials within the following disciplines identified by the Department of Homeland Security (DHS): VV V V VV Emergency Management Agency

Training Allocations: There is a total of $9,400,000 available for training under the 2003 SHSGP, Part II Training Grant.
The training monies are being distributed to jurisdictions based on the SHSAS. It will be the responsibility of the local
jurisdiction to prioritize the allocation of training monies within their jurisdiction. Jurisdictions are encouraged to distribute
monies among all 11 first responder disciplines. Jurisdictions may consider giving priority to Law Enforcement, Fire
Service, and Emergency Medical Services. Near the end of the grant period unexpended allocations will be redistributed
to insure full use of available grant monies. Please refer to the attached document for allocations by local jurisdiction.
Application Deadline: The application deadline to apply for the 2003 SHSGP, Part ll Training Grant is February 29, 2004.
All signed documents must be received or postmarked on or before this date. The grant application packet for local
jurisdictions is being distributed with this Informational Letter.
Performance Period: The performance period for the 2003 SHSGP, Part ll Training Grant is March 1, 2004 to
February 28, 2005. To be eligible for reimbursement, all training must be completed within the performance period.
Quarterly Reporting Requirements: Quarterly reporting and reimbursement requests for the 2003 SHSGP, Part II
Training Grant are to be received by June 18, 2004, September 17. 2004, December 17. 2004, and March 18, 2005.
Training Needs Identified: The recently completed SHSAS indicates that, across the 11 first responder disciplines, the
iitlreatest training need exists in the area of terrorism awareness level training.
Approved Training: To qualify for reimbursement, courses must be DHS approved. To meet the identified training
needs for first responders, the following training has been approved:

Reimbursable Training Costs: Reimbursement for student training costs will only be made for actual, documented
expenditures made by the local agency for:
Student over-time *
Student Back-fill *
Lodging for courses of more than one day in duration **
Mileage in excess of 50 miles round trip (most direct route of travel) **
Meals **
Institutional Costs: Participating training institutions will be required to establish a per student fee for each course.
The fee may include reasonable and customary charges for the following: Instructor fees; classroom use fees;
breaks; lunches; and expendable materials used in the conduct of training, e.g., paper, pencils, flip charts, name
badges, equipment rental, etc.
* Reimbursement for student overtime or backfill will only be paid if the student successfully completed the course
for which reimbursement is being requested. A copy of the student's certificate must be submitted with the completed
reimbursement documents to verify successful completion of each course.
* Reimbursement for "on-line" training costs will be made for actual, documented expenditures made by agencies
for student overtime or backfill costs needed to successfully complete an "on-line" course. (Not to exceed 4 hours per
student, per on-line course.) A copy of the student's certificate must be submitted with the completed reimbursement
documents to verify successful completion of each "on-line" course.
*" Reimbursement for lodging, mileage, and meals will be paid in accordance with the local agency guidelines as
long as the cost does not exceed the State's travel policy. If no local reimbursement guidelines exist then state

Billing and Reimbursement Procedures:
1. The training institution or instructor will bill the student's agency for the cost of attendance.
2. Each participating agency must maintain documentation of actual expenses for purposes of reimbursement.
3. The Agency Reimbursement Form will be available on the EMD web site at www.michioan.gov/emd.
4. Each calendar quarter, participating agencies must complete and submit the reimbursement form, along with
supporting documentation, to their respective Emergency Management Program for approval and tracking of
expenditures.
5. After review and approval, the local program will forward the agency reimbursement request and supporting
documentation to EMD. Upon final approval, payment will be made directly to the participating agency.

Training Delivery System:
Instructors - Michigan currently has many individuals who have attended Train the Trainers (T-T-T) for one or more of
the courses listed in the menu above. These individuals may be utilized to teach these courses within their own
agencies or agree to contract with others. Emergency Management Division has requested a list of these individuals
from DHS and upon receipt they wilt be posted on the EMD web site at www.michigan.gov/emd.
Train the Trainers — Only experienced instructors sponsored by a Police/Fire Regional Training Center, College or
University; or agency sponsored member instructors from among the 11 eligible disciplines will be considered.
1. Eligible agencies may contact their local emergency management program to apply for a T-T-T.
2. Note: The numbers of available T-T-T slots that may be allocated to agencies are limited. The local emergency
management program may recommend only the necessary number of qualified T-T-T candidates needed to meet
the overall training needs of the jurisdiction.
3. The local program will need to contact Sgt. Michael Johnson or other staff member at the EMD, Hazardous
Materials Training Center (HMTC) to register candidates for T-T-T courses; JohnsonMWa.michigan.qov or by
phone at (517) 322-1708.
4. The HMTC will send confirmation of T-T-T course acceptance or denial directly to the individual applicants.
5. Upon successful completion of the T-T-T, the new instructor's name will be posted on the EMD web site.
Dates for T-T-T's will be posted on the EMD web site at www.michinan.goviemd. Note: In order to attend the T-T-T's
for CBRNE Defensive Operations or Unified Incident Command System, applicants must verify completion of either
Hazardous Materials Operations or a CBRNE Operations level course by providing a copy of their certificate.
Training Institutions - Police/Fire Regional Training Centers, Colleges, and Universities are welcome to participate in
this initiative for the training of local first responders. A letter of invitation is being sent to these institutions and contact
information for local emergency management programs will be provided to them.
Instructor and Training Institution Procedures — The following procedures apply to class scheduling, administrative
paperwork and issuance of certificates.
1. The training institution or instructor, in cooperation with the local emergency management program, is responsible
to notify eligible agencies of classes scheduled.
2. Instructor Training Packets containing a list of allowable training costs, class rosters, certificates, and related
paperwork will be provided by contacting Sgt. Michael Johnson or other staff member at the HMTC;
JohnsonMWnmichigan.gov or (517) 322-1708.
3. The training institution or instructor will issue a certificate to students upon successful completion of each course.
Notification to First Responder Disciplines: An announcement of this initiative is being sent to agencies and
organizations representing the 11 first responder disciplines. They will be provided with a general overview of the 2003
SHSGP, Part ll Training Grant and how to go about scheduling training. These agencies will also receive directions to the
EMD web site for a listing of participating training institutions and local emergency management programs.

should be directed to your respective MSP-EMD, District Coordinator or Training and Exercise Coordinator.

This State Homeland Security Grant Program (SHSGP) Part II Grant Agreement is
hereby entered into between the Michigan Department of State Police, Emergency
Management Division (hereinafter called the Sub-grantor), and
Oakland County
(hereinafter called the Sub-grantee)
I. Purpose
The purpose of this Grant Agreement is to provide federal pass-through funds to the
Sub-grantee for completing training based on the State Homeland Security Needs
Assessment. This grant funding will serve to institutionalize terrorism awareness,
CBRNE Defensive Operations training, and Unified Incident Command System training
specifically for the following first responders and public/elected officials: Emergency
Medical Services, Emergency Management Agency, Fire Service, Governmental
Administrative, Hazardous Materials, Health Care, Law Enforcement, Private Security,
Public Health, Public Safety Communications, and Public Works. All training must be
ODP approved. Each jurisdiction has the discretion to determine which first responders
from the list above will be reimbursed.
II. Objectives
The principal objective of this Grant Agreement is to provide financial assistance for
allowable costs associated with completion of basic level preparedness training for first
responders and public/elected officials, including:
L Student over-time work performed by employees in excess of
established work week (usually 40 hours) & only in accordance to or
with approval of state or local agency. Dual compensation is not
allowed. Allowable fringe benefits are limited to FICA, Workers'
Compensation, Unemployment Compensation, and Retirement;
IL Student back-fill — another employee replaces student attending
training to continue student's job or job responsibilities & (i) (above)
applies for over-time hours as well. If the student has worked regular
hours, the following fringe benefits are also reimbursable: health,

dental, vision, & life insurance; workers compensation; retirement; and
social security;
iii. Institutional costs — room rental, instructor fee, audio/visual fee,
name badges, or any costs for expendable items 'related to the
development & delivery of approved State Homeland Security training;
iv. Lodging for courses over one day duration — costs must be in
accordance with a reasonable/normal (no high/over-priced hotel) room
expense;
v. Mileage in excess of 50 round trip miles — (utilizing most direct
route);
vi. Meals — must be reasonable with local jurisdiction's travel policy; and
vii. Per Diem (daily allowance) — allowed if used consistently and not in
combination with actual rates. Please refer to the following website for

Local travel policy may be used as long as the cost does not exceed State's travel
policy.
'Course fees and cost of materials are paid for by the Office of Domestic Preparedness'
Ill. Statutory Authority
Funding for the 2003 SHSGP is authorized by 1) Public Law 108-11, the Wartime
Supplemental Appropriations Act of 2003; 2) Public Law 107-56, the USA Patriot Act of
2001; and 3) Public Law 107-296, the Homeland Security Act of 2002. The Sub-
grantee agrees to comply with all program requirements in accordance with the
SHSGP, Office of Management and Budget Circulars A-87, A-102, and A-133 as
revised, the Michigan State Administrative Plan, and all other applicable federal and
state laws and regulations.
IV. State Homeland Security Grant Program Award Amount and Restrictions
The training award for Oakland County is $960,810.79, based on completion of required
elements.
This Grant Agreement designates SHSGP Partll funds for reimbursement of authorized
training costs. Grant Agreement funds shall not be used for other purposes. The funds
awarded in the Grant Agreement shall only be used to cover allowable costs that are
incurred during the Grant Agreement period. The funds must supplement, not
supplant, state or local funds. Federal funds must be used to supplement existing
funds, but should not replace (supplant) state or local funds that have been
appropriated for the same purpose. Federal funds cannot be used to replace a
reduction in non-federal funds. Potential supplanting will be the subject of application
review, as well as pre-award review, post-award monitoring, and audit. If an audit

reveals a potential presence of supplanting, the Sub-grantee will be required to supply
documentation demonstrating that the reduction in non-federal resources occurred for
reasons other than the receipt or expected receipt of federal funds.
V. Responsibilities of the Sub-grantee
The Sub-grantee agrees to comply with all applicable federal and state regulations,
including the following:
A. In addition to this SHSGP Part II Training Grant Agreement, Sub-grantees
shall complete, sign, and submit to Sub-grantor the following documents,
which are incorporated by reference into this Grant Agreement:
i. Assurances (OJP Form 4000/3)
Certifications Regarding Lobbying; Disclosure of Lobbying Activities;
Debarment, Suspension and Other Responsibility Matters; and Drug-
Free Workplace Requirement (OJP Form 4061/6)
Hi. Audit Certification Form
iv. Other documents that may be required by federal or state officials
B. All training activities must be completed by February 28, 2005, to be
eligible for reimbursement.
C. Submit the Request for Reimbursement forms and all required
documentation to the Sub-grantor for reimbursement of eligible expenses.
D. Comply with applicable financial and administrative requirements set forth
in the current edition of "U.S. Department of Justice Financial Guide,"
including the following provisions:
i. Account for receipts and expenditures, maintain adequate financial
records, and refund expenditures disallowed by federal or state audit.
ii. Retain all financial records, supporting documents, statistical records,
and all other records pertinent to the SHSGP Part ll for at least three
years after the final grant report, for purposes of federal and/or state
examination and audit.
iii. Perform the required financial and compliance audits in accordance
with the Single Audit Act of 1984, as amended, and OMB Circular,
A-133, "Audits of States, Local Governments, and Non-Profit
Organizations," as further described in OJP's "Financial Guide,"
Chapter 19. Random audits shall be performed to ensure compliance
with applicable provisions.
iv. Sub-grantor and Sub-grantee FY03 SHSGP Part ll information is
subject to requests made pursuant to the federal and state Freedom of
Information Act (FOIA), §5. USC 552 & MCLA 15.243, Section
13(1)(u)&(y). It is recognized that much of the information submitted in

the course of applying for funding under this program, or provided in
the course of its grant management activities, may be considered law
enforcement sensitive or otherwise important to national security
interests. This may include threat, risk, and needs assessment
information; and discussions of demographics, transportation, public
works, and industrial and public health infrastructures. Therefore, to
the extent provided by law, the Department of State Police will
determine which information is to be released on a case by case basis.
All applicants should be aware that any information created exclusively
for the purpose of applying for and monitoring grants hereunder is the
property of the U.S. Government, and shall not otherwise be disclosed
or released pursuant to state or local law or regulation.
VI. Responsibilities of Sub-grantor
The Sub-grantor, in accordance with the general purposes and objectives of this Grant
Agreement, will:
A. Administer the SHSGP Part II in accordance with all applicable federal
and state regulations and guidelines.
B. Provide direction and technical assistance to the Sub-grantee.
C. Provide any special report forms and reporting formats (templates)
required by the Sub-grantor for operation of the program.
D. Reimburse the Sub-grantee in accordance with this Grant Agreement
based on appropriate documentation submitted by the Sub-grantee.
E. Independently or in conjunction with the Office of Domestic Preparedness
(ODP), conduct random on-site reviews with Sub-grantee(s).
F. Sub-grantor and Sub-grantee FY03 SHSGP Part ll information is subject
to requests made pursuant to the federal and state Freedom of
Information Act (FOIA), §5. USC 552 & MCLA 15.243, Section
13(1)(u)&(y). It is recognized that much of the information submitted in the
course of applying for funding under this program, or provided in the

VII. Payment and Reporting Procedures
The Sub-grantee agrees to prepare the Request for Reimbursement Forms and submit
them quarterly to the Sub-grantor with supporting documentation containing all required
authorized signatures. The documentation requirements can be met by submitting
approved invoices (along with a copy of the corresponding check that paid the invoice),
sales receipts, travel expense vouchers, certificates of completion for those students
who finished the training courses, schedules, duty rosters, pay rates of student's over-
time and of back-fill employee, timesheets, and payroll registers of student and back-fill
employee. Purchase orders will not be accepted for reimbursements. In addition,
documentation of over-time policy, back-fill policy, and current travel regulations may be
required.
CALENDAR QUARTERS FOR THE GRANT PERIOD ARE AS FOLLOWS:

VIII. Employment Matters
Sub-grantee shall comply with the Elliott-Larsen Civil Rights Act, 1976 PA 453, as
amended, MCL 37.2101 et seq., the Persons with Disabilities Civil Rights Act, 1976 PA
200, as amended, MCL 37.1101 et seq., and all other federal, state and local fair
employment practices and equal opportunity laws and covenants that it shall not
discriminate against any employee or applicant for employment, to be employed in the
performance of this Grant Agreement, with respect to his or her hire, tenure, terms,

conditions, or privileges of employment; or any matter directly or indirectly related to
employment because of his or her race, religion, color, national origin, age, sex, height,
weight, marital status, or handicap that is unrelated to the individual's ability to perform
the duties of a particular job or position. Sub-grantee agrees to include in every
subcontract entered into for the performance of this Grant Agreement this covenant not
to discriminate in employment. A breach of this covenant is a material breach of the
Grant Agreement.
Sub-grantee shall ensure that no subcontractor, manufacturer, or supplier of Sub-
grantee on this Project appears in the register compiled by the Michigan Department of
Labor and Economic Growth, Commercial Enforcement Unit, pursuant to 1980 PA 278,
as amended, MCL 423.321 et seq. (State Contractors with Certain Employers
Prohibited Act).
IX. Limitation of Liability
Sub-grantor and Sub-grantee to this Grant Agreement agree that each must seek its
own legal representative and bear its own costs, including judgments, in any litigation
that may arise from performance of this contract. It is specifically understood and
agreed that neither party will indemnify the other party in such litigation.
This is not to be construed as a waiver of governmental immunity.
X. Third Parties
This Grant Agreement is not intended to make any person or entity, not a party to this
Grant Agreement, a third party beneficiary hereof or to confer on a third party any rights
or obligations enforceable in their favor.
Xl. Grant Agreement Period
This Grant Agreement is in full force and effect from March 1, 2004 through February
28, 2005. No costs eligible under this Grant Agreement shall be incurred before the
starting date of this Grant Agreement except with prior written approval. This Grant
Agreement consists of two identical sets simultaneously executed, each is considered
an original having identical legal effect. This Grant Agreement may be terminated by
either party by giving thirty (30) days written notice to the other party stating reasons for
termination and the effective date, or upon the failure of either party to carry out the
terms of the Grant Agreement. Upon any such termination, the Sub-grantee agrees to
return to the Sub-grantor any funds not authorized for use, and Sub-grantee shall have
no further obligation to make payments.

XII. Entire Grant Agreement
This Grant Agreement is governed by the laws of the State of Michigan and supersedes
all prior agreements, documents, and representations between Sub-grantor and Sub-
grantee, whether expressed, implied, or oral. This Grant Agreement constitutes the
entire agreement between the parties and may not be amended except by written
instrument executed by both parties prior to the termination date set forth in Paragraph
XI above. No party to this Grant Agreement may assign this Grant Agreement or any of
his/her/its rights, interest, or obligations hereunder without the prior consent of the other
party. Sub-grantee agrees to inform Sub-grantor in writing immediately of any proposed
changes of dates, budget, or services indicated in this Grant Agreement, as well of
changes of address or personnel affecting this Grant Agreement. Changes in dates,
budget, or services are subject to prior written approval of Sub-grantor. If any provision
of this Grant Agreement shall be deemed void or unenforceable, the remainder of the
Grant Agreement shall remain valid.
XIII. Business Integrity Clause
The Sub-grantor may immediately cancel the grant without further liability to the Sub-
grantor or its employees if the sub-grantee, an officer of the sub-grantee, or an owner of
a 25% or greater share of the sub-grantee is convicted of a criminal offense incident to
the application for or performance of a State, public, or private grant or subcontract; or
convicted of a criminal offense including but not limited to any of the following:
embezzlement, theft, forgery, bribery, falsification or destruction of records, receiving
stolen property, attempting to influence a public employee to breach the ethical conduct
standards for State of Michigan employees; convicted under State or Federal antitrust
statutes; or convicted of any other criminal offense which, in the sole discretion of the
Sub-grantor, reflects on the sub-grantee's business integrity.

Chairperson, Ladies and Gentlemen:
Pursuant to Rule XII-C of this Board, the Finance Committee has reviewed
the above-referenced resolution and finds:
1. Funding was released under the U.S. Department of Homeland Security,
through the Office for Domestic Preparedness (IDP), for the State
Homeland Security Grant Program, Part II Training Grant for first
responders to receive awareness-level terrorism training.
2. The State of Michigan has awarded Oakland County and its communities
reimbursement for qualified expenses up to, but not exceeding
$960,810.79 for the period of March 1, 2004 through February 28,
2005.
3. The funds will be used for Department of Homeland Security (DHS)
approved Awareness Level Terrorism and Weapons of Mass Destruction
(WMD) training, Chemical, Biological, Radiological, Nuclear, and
Explosive (CBRNE) Defensive Operations training, Unified Incident
Command System training, and attendance at the 2004 Michigan
Homeland Security Training Conference for Oakland County's first
responder community.
4. The Michigan Department of State Police Emergency Management
Division will serve as the administrating agency for this grant.
5. The State will pass through funds to the communities and Oakland
County will be the coordinating agency. Therefore no revenue will
be sent to Oakland County.
6. The grant agreement has been processed through the County Executive
Contract Review Process and the Board of Commissioners Grant
Acceptance Procedures.
