MISCELLANEOUS RESOLUTION #04 311 October 21, 2004

IN RE: Sheriffs Office-Contract Amendment #2 for Law Enforcement Services in the Charter
Township of Commerce
To the Oakland County Board of Commissioners
Chairperson, Ladies and Gentlemen:
WHEREAS the Charter Township of Commerce has contracted with the Oakland County Sheriffs
Department to provide law enforcement services for the Township (MR. #03349); and
WHEREAS paragraph 24 of this Contract provided that an amendment to this Contract must be
approved by concurrent resolutions of both the Oakland County Board of Commissioners and the Charter
Township of Commerce Board; and
WHEREAS the Charter Township of Commerce has approved a proposed amendment to the
contract (Schedule A and A-1, Sheriffs Deputies Contracted) which would add one (1) Detective
Sergeant, one (1) Patrol Investigator and three (3) Deputy II (no-fill) and bring the total number of
contracted positions to twenty-nine (29); and
WHEREAS the Sheriff has agreed to add one (1) Detective Sergeant, one (1) Patrol Investigator
and three (3) Deputy II (no-fill) for the Charter Township of Commerce under the terms of this contract.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners
approves an amendment to the original Schedule A and A-1 (Sheriff Deputies Contracted) of the Oakland
County Sheriffs Department 2004-2008 Law Enforcement Services Agreement with the Charter
Township of Commerce to add one (1) Detective Sergeant, one (1) Patrol Investigator and three (3)
Deputy II (no-fill).
BE IT FURTHER RESOLVED that two unmarked vehicles (with mobiles & preps) and one
marked vehicle (with mobile, prep, and MDC) be added to the County fleet.
BE IT FURTHER RESOLVED that one (1) Sergeant and four (4) Deputy II positions be created
in the Contracted Patrol Unit, Patrol Services Division of the Sheriffs Office.
BE IT FURTHER RESOLVED that this amendment will take effect on January 1, 2005.
Chairperson, on behalf of the Public Services Committee, I move the adoption of the foregoing
resolution.

2004-2008 LAW ENFORCEMENT SERVICES AGREEMENT WITH
CHARTER TOWNSHIP OF COMMERCE
Amendment 2
Pursuant to paragraph 24 of the 2004-2008 Law Enforcement Services Agreement
between the COUNTY and CHARTER TOWNSHIP OF COMMERCE, the parties hereby agree
to amend said contract in accordance with the attached Schedule A and A-1.
All other contractual provisions, of the 2004-2008 Law Enforcement Services Agreement
not otherwise affected by the attached Schedule A, remain in full force and effect.
FOR AND IN CONSIDERATION of the mutual assurances, promises, acknowledgments, set
forth in this Amendment 2 to the 2004-2008 Law Enforcement Services Agreement, ("Amendment") and
for other good and valuable consideration, the receipt and adequacy of which is hereby acknowledged,
the undersigned hereby execute this Amendment on behalf of the Parties, and by doing so legally
obligate and bind the Parties to the terms and conditions of this Contract.
IN WITNESS WHEREOF, THOMAS K. ZONER, SUPERVISOR, of the Charter Township of
Commerce, hereby acknowledges that he has been authorized by a resolution of the Township
Board, to execute this Amendment on behalf of the Municipality and hereby accepts and binds
the Municipality to the terms and conditions of this Amendment.

additional cost to the MUNICIPALITY, provide a substitute (i.e., FILL-IN) SHERIFF'S DEPUTY to provide
LAW ENFORCEMENT SERVICES to the MUNICIPALITY whenever a PATROL DEPUTY II (WITH FILL-
IN) is absent from the MUNICIPALITY during any 80 hour bi-weekly period for any reason except those
reasons enumerated in Paragraph 5(a)(1) through Paragraph 5(a)(5) above.
NOTE: No Trainees shall be assigned by the 0.C.S.D. to perform the duties of any SHERIFF'S DEPUTY
contracted for and assigned to perform LAW ENFORCEMENT SERVICES under the terms of this

IN RE: SHERIFF'S OFFICE - CONTRACT AMENDMENT #2 FOR LAW ENFORCEMENT SERVICES
IN THE CHARTER TOWNSHIP OF COMMERCE
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Chairperson, Ladies and Gentlemen:
Pursuant to Rule XII-C of this Board, the Finance Committee has
reviewed the above referenced resolution and finds:
1. The Charter Township of Commerce has requested an amendment to
the contract between the Charter Township of Commerce and the
Oakland County Sheriff for law enforcement services beginning
January 1, 2005.
2. This amendment would create one (1) Sergeant and four (4) Deputy
II positions in the Contracted Patrol Unit, Patrol Services
Division, of the Sheriff's Office.
3. Operating revenues and expenses will equal $378,647 for Fiscal
Year 2005 and $532,182 for Fiscal Year 2006.
4. The amendment adds two (2) unmarked vehicles (with mobile and
prep radio) and one (1) marked vehicle (with mobile, prep and
MDC) to the county fleet at a cost of $93,009. Funding will come
from contingency.
5. A budget amendment to the FY 2005 and FY 2006 budget is
recommended as follows:
