recommendation that the resolution be adopted.

ASSISTANCE GRANT (JAG) INTERGOVERNMENTAL AGREEMENT AND GRANT APPLICATION
To the Oakland County Board of Commissioners
Chairperson, Ladies and Gentlemen:
WHEREAS the Sheriff's Office, Prosecutor's Office, City of Southfield
and City of Pontiac wish to apply to the U.S. Department of Justice, Office
of Justice Programs for fo.nding under the Byrne justice Assistance Grant
Program for the period June 1, 2005 through May 31, 2007; and
WHEREAS the grant application requires the adoption of an
intergovernmental agreement between the local units of government; and
WHEREAS an agreement has been drafted (as attached) by the County's
Corporation Counsel; and
WHEREAS State statute (ACL 45.556P) states that the Board of
Commissioners has the authority to enter into agreements with other
governmental or quasi-governmentai entities.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of
Commissioners approves the attached intergovernmental agreement and that the
Board Chairperson, on behalf of the County of Oakland, 7'_s authorized to
execute said agreement.
BE IT FURTHER RESOlgED that one original intergovernmental agreement be
filed with the Michigan Department of State, Office of the Great Seal.

ASSISTANCE GRANT (JAG) APPLICATION
The Fiscal Services Division has reviewed the above referenced grant
application and finds:
1) This is the 1st year of grant application with the U.S.
Department of Justice, Office of Justice Programs. The grant
provides funding to purchase equipment and supplies for law
enforcement purposes.
2) The grant period is June 1, 2005 through May 31, 2007.
3) The funding requested equals 8307,854. Oakland County will
receive $55,876, the City of Southfield $100,175 and the City of
Pontiac $151,803. No local match is required.
4) The grant application requires the adoption of an
intergovernmental agreement between the County, City of
Southfield and City of Pontiac.
5) Application and acceptance of this grant program does not
obligate the county to any future commitment and continuation of
the grant program is contingent upon continued future levels of
grant program funding.

This Intergovernmental Agreement (Agreement) is made between the County of Oakland, a
Constitutional and Municipal Corporation, 1200 N. Telegraph Road, Pontiac, Michigan, 48341 (the
County), the City of Southfield, a Municipal Corporation, 26000 Evergreen Road, Southfield,
Michigan 48076 (Southfield) and the City of Pontiac, a Municipal Corporation, 47450 Woodward
Avenue, Pontiac, Michigan 48342 (Pontiac). In this Agreement, the County, Southfield and Pontiac
may be referred to individually as "Party" or jointly as "Parties."
In consideration of the mutual promises, obligations, representations and assurances in this
Contract, the Parties agree as follows:
1. Purpose of Agreement
Pursuant to the requirements of the Edward Byrne Memorial Justice Assistance
Grant (JAG) that, in order to make application for grant funds that may be available,
the jurisdictions certified as disparate must submit a joint application for the
aggregate of funds allocated to them, specifying the amount of the funds that are to
be distributed to each of the units of local government and the purposes for which the
funds will be used, the Parties enter into this Agreement to set forth the information
described above for the purpose of making application for grant funds for fiscal year
2005.
1.1.
Definitions
2.1. "Oakland County," "City of Pontiac" and "City of Southfield" shall be defined to
include any and all departments, divisions, commissioners, elected and appointed
officials, directors, board members, council members, commissioners, authorities,
committees, employees, agents, subcontractors, volunteers and/or any such persons'
successors.
2.2. "Edward Byrne Memorial Justice Assistance Grant" means the grant program of
the U.S. Department of Justice, Office of Justice Programs, Bureau of Justice
Assistance, by which Federal funds are made available to support a broad range of
activities to prevent and control crime based on local needs and conditions within
specific Purpose areas defined in the grant application and other grant information.
3. Terms
3.1. The Parties agree that any and all funds granted pursuant to their grant application
will be used only for equipment that will serve the purposes defined in the grant.
3.2. The County agrees to act as fiduciary for any funds granted to the Parties pursuant to
their joint grant application.

3.3. The County agrees that it will complete reports and provide other information
required in order to fulfill grant requirements.
3.4. Southfield and Pontiac agree to comply with the County's reporting and fiscal
management policies to the extent necessary to provide required information to the
Department of Justice regarding use of any funds granted to them and any other
information required pursuant to the grant application.
3,5. The County agrees to procure and pay for the agreed upon equipment according to
the County's purchasing and financial management policies and procedures.
3.6. All equipment purchased with grant funds will be delivered to the individual
requesting Party. Title to each ordered item, unless otherwise required by the
conditions of the grant, will transfer to the requesting Party upon delivery. The
requesting Party assumes all responsibility for inspecting and accepting ordered
equipment.
3.7. Southfield and Pontiac will notify the County's Grant Manager upon acceptance of
equipment. The County's Grant Manager will authorize payment according to the
County's policies and procedures.
3.8. If problems with equipment arise, the Parties will coordinate their communication,
strategies and other actions to correct the problems.
3.9. Allocation of Funds. Any funds granted to the Parties by the Department of Justice
under the JAG shall not be used for administrative costs and shall be allocated as
follows:
3.9.1. To the City of Pontiac: the sum of $151,803
3.9.2. To the City of Southfield: the sum of $100,175
3.9.3. To the County of Oakland: the sum of S55,876
3.10. Duration. This Interlocal Agreement shall be for a term of the grant.
3.11. The County will file a copy of this agreement with the Clerk of the County of
Oakland and the Office of the Great Seal of the State of Michigan, as required by
MCL 124.510.
3.12. Termination. Either Party may terminate this Agreement on 7 days written notice
for any reason provided such termination is not contrary to the terms and conditions
of the JAG grant application and/or any other conditions imposed upon acceptance
of grant funds, if any.
3.13. No Employee-Employer Relationship. Nothing in this Agreement shall be
construed as creating an employer-employee relationship between the County
(including any of its employees), Southfield (including any of its employees) and
Pontiac (including any of its employees).

3.14. No Indemnification. Each Party shall be responsible for the acts and/or omissions
of its employees. Nothing in this Agreement shall be construed as creating an
obligation to indemnify or defend the other Parties for any claim, damage or liability
arising out of or stemming from the use of the grant funds managed pursuant to this
Agreement.
3.15. No Third Party Beneficiaries. Except as provided for the benefit of the Parties, this
Agreement does not and is not intended to create any obligation, duty, promise,
contractual right or benefit, right to indemnification, right to subrogation and/or any
other right in favor of any other person or entity.
3.16. Reservation of Rights. This Agreement does not, and is not intended to impair,
divest, delegate, or contravene any constitutional, statutory, and/or other legal right,
privilege, power, obligation, duty or immunity of the Parties.
3.17, Agreement Modifications or Amendments. Any modifications, amendments,
recessions, waivers, or releases to this Agreement must be in writing and agreed to
by the Parties.
3.18. Entire Agreement. This Agreement represents the entire Agreement between the
Parties and supercedes all other Agreements between the Parties governing the
matters described here. The language of this Agreement shall be construed as a
whole according to its fair meaning, and not construed strictly for or against any
Party.
3.19. The Parties have taken all actions and secured all approvals necessary to authorize
and complete this Agreement. The persons signing this Agreement on behalf of each
Party have legal authority to sign this Agreement and bind the Parties to the terms
and conditions contained here.

Program Narrative - Attachment 1
Project: City of Pontiac - Community Policing Initiatives
The Pontiac Police department will use the JAG to continue the support current
programs, to enhance our community policing initiatives and to maintain federal
requirements. 1) We will purchase a Digital Recording System for 911 phone lines,
including a multi-year service contract. Our current system is an analog system and it is
outdated. 2) The purchase of four (4) Harley Davidson Motorcycles, replaces leased
units currently in our fleet, which are due to be returned to the leasing agent. 3) The
purchase of a PD OnScene UlCS (Unified Incident Command Software, a service
contract and training for eight (8) sworn personnel, who will then train the remaining
patrols. This software tracks personnel involved in critical incidents and fulfills a federal
requirement. 4) A laser measuring device for accident investigations and the
reconstruction software will enhance our investigative performance at vehicular accident
scenes. 5) Our CATT (Community Area Target Team) has been receiving continuous
complaints involving traffic enforcement of 4-wheelers and ATV's. The purchase of
Two (2) ATV's will render us capable of making pursuit of these violators in our wooded
areas and parks. 6) Our SRT (Special Response Teams), NES (Narcotics Enforcement
Section) and the Surveillance Teams is currently using out of date night vision goggles.
The purchase of six (6) goggles would ensure that each unit maintains at least two sets
with their respective units.
Project: City of Southfield - Digital In-Car Video Camera Project
The funds will be utilized to purchase digital in-car video camera systems, which will be
installed in the police vehicles, The cameras will aide the criminal justice system in the
prosecution of criminal offenders, as well as the police department for investigating
internal complaints. Additionally, the in-car systems provide an added safety measure to
the police officers in the performance of their duties
Project: City of Southfield - Police Records Bureau Live Scan System
The funds will be utilized to purchase a Live Scan System for the Police Records Bureau.
The Records Bureau is responsible for fingerprinting all applicants for employment
background checks and individuals applying for a weapons permit. The State of
Michigan has mandated electronic fingerprint submission for these types of applicants.
Compliance will be required in 2006.
Project: County of Oakland - Prosecutor Laptop Acquisition
Capital equipment for this project is to utilize available funding to replace outdated
laptop computers for Assistant Prosecutors. The new laptops are needed for courtroom
presentations to juries for detailed graphics, such as crime scenes depictions,
photographs, and training law enforcement officers.
Project: County of Oakland - Cell Extraction Team Gear
Project is for jail inmate cell extraction including tactical gear and team equipment
needed for safe and effective extraction.

Governing Body Review and Public Opportunity to Comment
City of Pontiac Project: The Public Hearing for the 2005 JAG was held March 1, 2005
at 4:00 p.m. at the Pontiac Police Department. A legal notice with the above information
was placed in the Oakland Press prior to the hearing. The notarized public notice is
maintained in our files.
City of Southfield Projects: Email and hard copies of the FY 2005 JAG grant release
were sent to all City administrative official and all City Council members February 24,
2005. Public Hearing was held March 21, 2005 at 7:30 p.m. in the City Council
Chambers.
Oakland County Projects: Electronic email notification was sent all County
Department heads and County Commissioners on February 11, 2005. Grant internal
review notification was send to all County Departments on February 28, 2005. Public
Hearing was held March 25, 2005 at 9:30 a.m. in the County Oakland County
Commissioners Auditorium.

STANDARD ASSURANCES
The Applicant hereby assures and certifies compliance with all applicable Federal statutes, regulations,
policies, guidelines, and requirements, including OMB Circulars A-21, A-87, A-102, A-110, A-122, A-133;
Ex. Order 12372 (intergovernmental review of federal programs); and 28 C.F.R. pts. 66 or 70
(administrative requirements for grants and cooperative agreements). The applicant also specifically
assures and certifies that:
1. It has the legal authority to apply for federal assistance and the institutional, managerial, and
financial capability (including funds sufficient to pay any required non-federal share of project
cost) to ensure proper planning, management, and completion of the project described in this
application.
2. It will establish safeguards to prohibit employees from using their positions for a purpose that
constitutes or presents the appearance of personal or organizational conflict of interest, or
personal gain.
3. It will give the awarding agency or the General Accounting Office, through any authorized
representative, access to and the right to examine all paper or electronic records related to the
financial assistance.
4. It will comply with all lawful requirements imposed by the awarding agency, specifically
including any applicable regulations, such as 28 C.F.R. pts. 18, 22, 23, 30, 35, 38, 42, 61, and 63.
5. It will assist the awarding agency (if necessary) in assuring compliance with section 106 of the
National Historic Preservation Act of 1966 (16 U.S.C. § 470), Ex. Order 11593 (identification and
protection of historic properties), the Archeological and Historical Preservation Act of 1974 (16
U.S.C. § 469 a-1 et seq.), and the National Environmental Policy Act of 1969 (42 U.S.C. § 4321).
6. It will comply (and will require any subgrantees or contractors to comply) with any applicable
statutorily-imposed nondiscrimination requirements, which may include the Omnibus Crime
Control and Safe Streets Act of 1968 (42 U.S.C. § 3789d); the Victims of Crime Act (42 U.S.C. §
10604(e)); The Juvenile Justice and Delinquency Prevention Act of 2002 (42 U.S.C. § 5672(b));
the Civil Rights Act of 1964 (42 U.S.C. § 2000d); the Rehabilitation Act of 1973 (29 U.S.C. § 7
94); the Americans with Disabilities Act of 1990 (42 U.S.C. § 12131-34); the Education
Amendments of 1972 (20 U.S.C. §§1681, 1683, 1685-86); and the Age Discrimination Act of
1975 (42 U.S.C. §§ 6101-07); see Ex. Order 13279 (equal protection of the laws for faith-based
and community organizations).
7. If a governmental entity:
a. it will comply with the requirements of the Uniform Relocation Assistance and Real
Property Acquisitions Act of 1970 (42 U.S.C. § 4601 et seq.), which govern the treatment
of persons displaced as a result of federal and federally-assisted programs; and
b. it will comply with requirements of 5 U.S.C. §§ 1501-08 and §§ 7324-28, which limit
certain political activities of State or local government employees whose principal
employment is in connection with an activity financed in whole or in part by federal
assistance.

CERTIFICATIONS REGARDING LOBBYING; DEBARMENT, SUSPENSION AND OTHER
RESPONSIBILITY MATTERS; AND DRUG-FREE WORKPLACE REQUIREMENTS
Applicants should refer to the regulations cited below to determine the certification to which they are
required to attest. Applicants should also review the instructions for certification included in the
regulations before completing this form. Signature of this form provides for compliance with certification
requirements under 28 CFR Part 69, "New Restrictions on Lobbying" and 28 CFR Part 67, "Government-
wide Debarment and Suspension (Nonpro-curement) and Government-wide Requirements for Drug- Free
Workplace (Grants)." The certifications shall be treated as a material representation of fact upon which
reliance will be placed when the Department of Justice determines to award the covered transaction,
grant, or cooperative agreement.
1. LOBBYING As required by Section 1352, Title 31 of the U.S. Code, and implemented at 28 CFR Part
69, for persons entering into a grant or cooperative agreement over $100,000, as defined at 28 CFR Part
69, the applicant certifies that:
(a) No Federal appropriated funds have been paid or will be paid, by or on behalf of the undersigned, to
any person for in-fluencing or attempting to influence an officer or employee of any agency, a Member of
Congress, an officer or employee of Congress, or an employee of a Member of Congress in con-nection
with the making of any Federal grant, the entering into of any cooperative agreement, and the extension,
continuation, renewal, amendment, or modification of any Federal grant or cooperative agreement;
(b) If any funds other than Federal appropriated funds have been paid or will be paid to any person for
influencing or attempting to influence an officer or employee of any agency, a Member of Congress, an
officer or employee of Congress, or an employee of a Member of Congress in connection with this
Federal grant or cooperative agreement, the undersigned shall complete and submit Standard Form-
LLL, "Disclosure of Lobbying Activities," in accordance with its instructions;
(c) The undersigned shall require that the language of this cer-tification be included in the award
documents for all subawards at all tiers (including subgrants, contracts under grants and cooperative
agreements, and subcontracts) and that all sub-recipients shall certify and disclose accordingly.
2. DEBARMENT, SUSPENSION, AND OTHER RESPONSIBILITY MATTERS (DIRECT RECIPIENT)
As required by Executive Order 12549, Debarment and Suspension, and implemented at 28 CFR Part 67,
for prospective participants in primary covered transactions, as defined at 28 CFR Part 67, Section
67.510
A. The applicant certifies that it and its principals:
(a) Are not presently debarred, suspended, proposed for debarment, declared ineligible, sentenced to a
denial of Federal benefits by a State or Federal court, or voluntarily excluded from covered transactions
by any Federal department or agency;
(b) Have not within a three-year period preceding this application been convicted of or had a civil
judgment rendered against them for commission of fraud or a criminal offense in connection with
obtaining, attempting to obtain, or performing a public (Federal, State, or local) transaction or contract
under a public transaction; violation of Federal or State antitrust statutes or commission of embezzlement,
theft, forgery, bribery, falsification or destruction of records, making false statements, or receiving stolen
property;
(c) Are not presently indicted for or otherwise criminally or civilly charged by a governmental entity
(Federal, State, or local) with commission of any of the offenses enumerated in paragraph (1)(b) of this
certification; and (d) Have not within a three-year period preceding this application had one or more public
transactions (Federal, State, or local) terminated for cause or default; and
B. Where the applicant is unable to certify to any of the statements in this certification, he or she shall
attach an explanation to this application.
3. DRUG-FREE WORKPLACE (GRANTEES OTHER THAN INDIVIDUALS)
As required by the Drug-Free Workplace Act of 1988, and implemented at 28 CFR Part 67, Subpart F, for
grantees, as defined at 28 CFR Part 67 Sections 67.615 and 67.620
A. The applicant certifies that it will or will continue to provide a drug-free workplace by:
(a) Publishing a statement notifying employees that the unlawful manufacture, distribution, dispensing,
possession, or use of a controlled substance is prohibited in the grantee's workplace and specifying the
actions that will be taken against employees for violation of such prohibition;
(b) Establishing an on-going drug-free awareness program to inform employees about
(1) The dangers of drug abuse in the workplace;
(2) The grantee's policy of maintaining a drug-free workplace;
(3) Any available drug counseling, rehabilitation, and employee assistance programs; and
(4) The penalties that may be imposed upon employees for drug abuse violations occurring in the
workplace;
(c) Making it a requirement that each employee to be engaged in the performance of the grant be given a
copy of the statement required by paragraph (a);
(d) Notifying the employee in the statement required by paragraph (a) that, as a condition of employment
under the grant, the employee will
(1) Abide by the terms of the statement; and
(2) Notify the employer in writing of his or her conviction for a violation of a criminal drug statute occurring
in the workplace no later than five calendar days after such conviction;
(e) Notifying the agency, in writing, within 10 calendar days after receiving notice under subparagraph
(d)(2) from an employee or otherwise receiving actual notice of such convic-tion. Employers of convicted
employees must provide notice, including position title, to: Department of Justice, Office of Justice
Programs, ATTN: Control Desk, 633 Indiana Avenue, N.W., Washington, D.C. 20531. Notice shall include
the identification number(s) of each affected grant;
(f) Taking one of the following actions, within 30 calendar days of receiving notice under subparagraph
(d)(2), with respect to any employee who is so convicted
(1) Taking appropriate personnel action against such an employee, up to and including termination,
consistent with the requirements of the Rehabilitation Act of 1973, as amended; or
(2) Requiring such employee to participate satisfactorily in a drug abuse assistance or rehabilitation
program approved for such purposes by a Federal, State, or local health, law enforcement, or other
appropriate agency;
(g) Making a good faith effort to continue to maintain a drug-free workplace through implementation of
paragraphs (a), (b), (c), (d), (e), and (f).

the above certifications.
