Patterson, Chairperson IN RE: DEPARTMENT OF CENTRAL SERVICES — OAKLAND COUNTY INTERNATIONAL AIRPORT — 2005 GRANT PROGRAM ACCEPTANCE FOR SOUND ATTENUATION - ADOPTED PER MR #05041 — AMENDATORY CONTRACT To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS the County of Oakland is in receipt of Michigan Department of Transportation Grant Amendment, Contract No. 2005-0103/A1, Federal Project No. C-26-0079-3704, for State funds in the amount of $577,303.00, for the development and improvement of Oakland County International Airport; and WHEREAS the project consists of sound attenuation; and WHEREAS the Michigan Department of Transportation shall act as agent on behalf of the County in the administration of the project; and WHEREAS the development project as offered and approved by the Michigan Department of Transportation requires a local grant match of $14,802.00, which is available from the airport fund; and WHEREAS the Airport Committee has reviewed the project and recommends acceptance of the grant contract; and WHEREAS the attached contract has been approved in accordance with the County Executive's review process; and WHEREAS no application was requested from Oakland County; therefore, the application provisions of M.R. #95098, do not apply. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners accepts the amendatory contract in an amount not to exceed $592,105.00. BE IT FURTHER RESOLVED that the Chairperson of the Oakland County Board of Commissioners is authorized to execute the grant contract. Department of Management and Budget: Approved.- Laurie Van Pelt (10/17/2005) Department of Human Resources: Approved. - Nancy Scarlet (10/18/2005) Risk Management and Safety: Approved By Risk Management - Julie Secontine (10/19/2005) Corporation Counsel: There are no outstanding legal issues concerning the above grant. - Joellen Shortley (10/21/2005) CONTRACT NO. 2005-0103/A1 AGENDA: DAB MICHIGAN DEPARTMENT OF TRANSPORTATION COUNTY OF OAKLAND AMENDMENT THIS AMENDATORY CONTRACT is made and entered into this date of by and between the Michigan Department of Transportation, hereinafter referred to as the "DEPARTMENT," and the County of Oakland, hereinafter referred to as the "SPONSOR," for the purpose of amending Contract No. 2005-0103, dated March 16, 2005, hereinafter referred to as the "CONTRACT." WITNESSETH: WHEREAS, the CONTRACT provides for sound attenuation at the Oakland County International Airport; and WHEREAS, the parties desire to amend the CONTRACT to increase the amount by $592,105 in state and local funds because of a change in the funding split; NOW, THEREFORE, the parties agree that the CONTRACT be and that the same is amended as follows: 1. In order to set forth the revised amounts, Exhibit 1 of the CONTRACT, dated February 3, 2005, is replaced with Revised Exhibit 1, dated July 28, 2005, attached hereto and made a part hereof, and all references in the CONTRACT to Exhibit 1 will be construed to mean Revised Exhibit 1, dated July 28, 2005. 2. In order to increase the CONTRACT amount by Five Hundred Ninety-Two Thousand One Hundred Five Dollars ($592,105.00), for a revised total CONTRACT amount of Three Million Seven Hundred Fifty Thousand Dollars ($3,750,000.00), Section 11 of the CONTRACT is amended to read as follows: "11. The PROJECT COST participation is estimated to be as shown below and as in Revised Exhibit 1. Revised Exhibit 1 is to be considered an estimate. This Amendatory Contract will become binding on the parties and of full force and effect upon signing by the duly authorized representatives of the SPONSOR and the DEPARTMENT and upon adoption of a resolution approving said Amendatory Contract and authorizing the signature(s) thereto of the respective representative(s) of the SPONSOR, a certified copy of which resolution will be sent to the DEPARTMENT with this Amendatory Contract, as applicable. Oakland County has received Michigan Department of Transportation Grant Amendment, Contract No. 2005-0103/A1, Federal Project No. C-26-0079-3704, for State funds in the amount of $577,303 and a required local grant match of $14,802 for the development and improvement of Oakland County International Airport. 2. The total original contract amount was $3,157,895 with $3,000,000 of the cost from Federal funds, $78,947 of the cost from State funds, and $78,948 of the cost from the Airport fund resources for the grant match. 3. This amendment increases the contract by $592,105 to a total of $3,750,000, which includes $577,303 from State funds and $14,802 from the Airport fund resources for the grant match. 4. The amendatory contract provides additional State funds for sound attenuation of approximately 14 additional homes located north, east and west of the airport as part of the airport's noise mitigation program. 5. The Airport Committee has reviewed the project and recommends acceptance of the grant contract. 6. The funding period of the grant is 36 months from the date of the award. 7. The Michigan Department of Transportation shall act as agent on behalf of the County in the administration of the project. 8. No General Fund appropriation is required.
