Molnar, Commissioner, District #13 IN RE: DEPARTMENT OF INFORMATION TECHNOLOGY/CLEMIS - INTEGRATED BIOMETRIC IDENTIFICATION SYSTEM GRANT ACCEPTANCE To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS CLEMIS of Oakland County and other participating law enforcement agencies request to implement a program for a wireless on-the-street identification system; and WHEREAS this program would test the feasibility and operational features required to remotely capture fingerprint, photographic and demographic information for on-the-street suspect identification through the use of a portable biometric identification unit; and WHEREAS a hand held device would be utilized to capture the biometrics information. Suspects can be identified from a patrol car, or other location, based upon a wireless identification system; and WHEREAS CLEMIS has solicited and received federal funding under Fiscal Year 2005 U.S. Department of Justice - Office of Community Oriented Policing Services Congressionally Mandated Award from the U.S. Department of Justice in the amount of $1,243,170 for the period of December 7, 2004 through December 7, 2007; and WHEREAS the grant award includes funding for equipment and supplies of $841,500 and contracted services of $401,670; and WHEREAS the grant award has been processed through the County Executive's Contract Review Process and the Board of Commissioners Grant Application Procedures; and WHEREAS the U.S. Department of Justice - Office of Community Oriented Policing Services will fund the implementation of the wireless on-the-street identification system, and the completion of this program will be recognized by the CLEMIS fund as a capital asset. The ongoing maintenance costs will be included in the CLEMIS operating budget. The method of recovery will be determined at such time. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners accepts grant funding from the U.S. Department of Justice in the amount of $1,243,170 with no County Match requirement. BE IT FURTHER RESOLVED that the FY2006 Budget be amended as specified below: Law Enforcement Grants — Fund 272 Revenue 23-130103-xxxx-0113 Grants-Federal $1,243,170 Expenditure 23-230103-xxxx-3348 Professional Svcs $ 401,670 23-230103-xxxx-9154 Capital Outlay-Computer Equip $ 841,500 -O- BE IT FURTHER RESOLVED that acceptance of this grant does not obligate the County to any future commitment and is contingent upon sufficient levels of grant funding. BE IT FURTHER RESOLVED that the Chairperson of the Board of Commissioners is authorized to execute the contract agreement and that the Chairperson may approve amendments and extensions up to a fifteen (15%) percent variance from the award, consistent with the original agreement as approved. PROJECT SYNOPSIS The Oakland County Sheriff's Office along with CLEMIS (Courts and Law Enforcement management Information Systems) will be providing to law enforcement agencies participating in this project, a remote wireless biometric identification tool. Department of Justice Office of Community Oriented Policing Services Grant Terms and Special Conditions By signing the Award Document to accept this Technology Initiative grant, your agency agrees to abide by the following grant conditions: 1. The grantee agrees to comply with the COPS statute (42 U.S.C. §3796dd); OMB Circulars A-87, A-21, A-122 or the Federal Acquisition Regulations, as applicable (governing cost principles), OMB Circulars A-102 (28 C.F.R. Part 66) or A-110 (28 C.F.R. Part 70), as applicable (Uniform Administrative Requirements for Grants and Cooperative Agreements); OMB Circular A-133 (governing audits), and with all applicable program requirements, laws, orders, regulations, or circulars. 2. The grantee agrees to comply with the Assurances and Certifications forms that were signed and submitted as part of its Technology Initiative application. 3. The grantee acknowledges that the funding under this project is for the payment of approved costs for the continued development of technologies and automated systems to assist state and local law enforcement agencies in investigating, responding to and preventing crime. The allowable costs are limited to those listed on the budget clearance memorandum, included in your agency's award packet. 4. The grantee acknowledges that Technology Initiative grant funds must be used to supplement, and not supplant, state, local or Bureau of Indian Affairs funds already committed for the grant purpose (hiring, training, purchases, and/or activities) that would exist in the absence of the grant. 5. The grantee acknowledges that it may request an extension of the grant award period to receive additional time to implement its grant program, and that such extensions do not provide additional funding. Only those grantees that can provide a reasonable justification for delays will be granted no-cost extensions. 6. The grantee acknowledges that all grant modification requests must be approved, in writing, by the COPS Office prior to their implementation. The COPS Office will not approve any modification request that results in an increase of federal funds. 7. The grantee acknowledges that the COPS Office may conduct monitoring or sponsor national evaluations of the COPS Technology Initiative Grant Program, and agrees to cooperate with the monitors and evaluators. 8. The grantee will be responsible for submitting periodic progress reports and quarterly financial reports. 9. The grantee acknowledges that the Department of Justice performs various functions to ensure compliance with all grant requirements and to provide technical assistance to grantees. The grantee agrees to cooperate with any requests for grant-related documentation or other relevant information. 10. Grantees that have 50 or more employees and grants over $500,000 (or over $1,000,000 in grants over an 18-month period) must submit an acceptable Equal Employment Opportunity Plan (EEOP) or EEOP short form, if required to submit an EEOP under 28 C.F.R. 42.302, that is approved by the Office of Justice Programs, Office of Civil Rights, within 60 days of the award start date. 11. The grantee agrees to comply with 28 C.F.R. Part 23 if Technology Initiative funds are used to operate an interjurisdictional criminal intelligence system. The grantee acknowledges that it has completed, signed and submitted with its grant application the relevant Special Condition certifying its compliance with 28 C.F.R. Part 23. 12. The grantee acknowledges that travel costs for transportation, lodging and subsistence, and related items are allowable under the Technology Initiative program with prior approval from the COPS Office. Payment for allowable travel costs will be in accordance with Circular A-87 (Cost Principles for State, Local anti Indian T-ibal Governments), Circular A-I 22 (Cost Principles for Non-Profit Organizations), or Circular A-21 (Cost Principles for Educational Institutions), as applicable. 13. The grantee agrees to comply with appropriate federal procurement rules. If applicable, grantees that have been awarded funding for the proem ement of an item in excess of $100,000 and plan to use a non-competitive procurement process must provide a written sole source justification to the COPS Office for approval prior to obligating, expending, or drawing down grant funds for that item. 14. The grantee agrees to submit one copy of all reports and proposed publications resulting from this grant 20 days prior to public release. Any publications (including written, software, visual, or sound, but excluding press releases, newsletters, and issue analyses), whether published at the grantee's or government's expense, shall contain the following statement: "This document was prepared by the Oakland County Sheriff's Department supported by 2005CKWX0192, awarded by the U.S. Department of Justice. Officers will be equipped with a wireless hand held device capable of capturing fingerprint and mugshot images. This device will in turn transmit this information back to a regional AFIS and mugshot imaging system for "backend" identification processing. Once the analysis is complete, the AFIS will return an identification response back to the officer via the portable I.D. device. While the initial search will be conducted against the data stored in the regional AFIS, a companion search will be conducted using the "facial recognition" capabilities of the CLEMIS imaging system. As mentioned, the initial suspect identification query will be sent to a regional AFIS and facial recognition imaging system for purposes of decreasing the response time back to the officer in the field. However, in order to ensure that the regional AFIS contains an accurate record of those individuals previously arrested and fingerprinted in the State of Michigan, an interface will be created to share data with the Michigan State Police AFIS. As such, arrest information coming in to the State AFIS from anywhere in Michigan will be send in real time to the CLEMIS regional AFIS. In turn, this information will be available to the officer on the street through the use of a Portable I.D. device.
