HomeMy WebLinkAboutResolutions - 2006.12.14 - 28099MISCELLANEOUS RESOLUTION #06238 DECEMBER 14, 2006 BY: Finance Committee, Chuck Moss, Chairperson IN RE: DEPARTMENT OF MANAGEMENT AND BUDGET / EQUALIZATION DIVISION - APPROVAL OF AMENDMENT 1 TO CONTRACT FOR OAKLAND COUNTY EQUALIZATION DIVISION ASSISTANCE SERVICES WITH THE TOWNSHIP OF HOLLY. TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Chairperson, Ladies and Gentlemen: WHEREAS Oakland County and the Township of Holly acknowledge the existence of a Contract for Oakland County Equalization Division Assistance Services executed on April 5, 2006 which expires on June 30, 2008, and said parties wish to modify the original Contract, keeping intact the original terms and conditions, and amend it, hereafter known as Amendment 1; and WHEREAS the County agrees under Amendment 1 to reappraise the commercial, industrial and residential real property in the Township of Holly which will update, list, appraise and establish current records for all real property subject to ad valorem taxation and the services to be rendered by the County shall be to review and reappraise all commercial, industrial and residential real property at its True Cash Value and to make any other corrections necessary to the appraisal records; and WHEREAS the reappraisal of the real property described herein in the Township of Holly shall be completed and be ready for the tax roll in the year 2008; and WHEREAS in consideration of the services of the County to undertake the reappraisal under the Amendment 1, the Township of Holly agrees to pay the County a fee of $30.00 per real improved property description payable in five (5) annual installments on the basis of the total parcel count of 4,025 with first installment payable on June 30, 2007 and the final installment due and payable on June 30, 2011; and WHEREAS Amendment 1 provides further that the original contract for Oakland County Equalization Division Assistance Services with the Township of Holly, which expires on June 30, 2008, is extended and shall now expire on June 30, 2011; and WHEREAS approval of said Amendment 1 is required from the Board of Commissioners. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners hereby approve entering into Amendment 1 to Contract for Oakland County Equalization Division Assistance Services with the Township of Holly. BE IT FURTHER RESOLVED that the Board of Commissioners' Chairperson is authorized to sign this Amendment 1. BE IT FURTHER RESOLVED that the Fiscal Year 2007 and FY 2008 budgets be amended as follows: GENERAL FUND (10100) Revenue 1020501-186020-631813 Reimb. AMENDMENT 1 TO CONTRACT FOR OAKLAND COUNTY EQUALIZATION DIVISION ASSISTANCE SERVICES WITH THE TOWNSHIP OF HOLLY OAKLAND COUNTY, a Michigan Constitutional Corporation ("County"), 1200 North Telegraph Road, Pontiac, Michigan 48341 and the TOWNSHIP OF HOLLY, a Michigan Constitutional and Municipal Corporation ("Municipality") whose address is 102 Civic Drive, Holly, Michigan 48442 entered into a contract for assistance services on April 5, 2006. The County and Municipality acknowledge the existence of the Original Agreement which expires on June 30, 2008. The County and the Municipality wish to modify the Original Agreement keeping intact the original terms and conditions, and amend it as follows: A) Update of Real Property Assessments - The County agrees to review and update assessments for the commercial, industrial and residential real property in the Municipality and will list, appraise and establish current records for all real property subject to ad valorem taxation. The services to be rendered by the County shall be to review and appraise all commercial, industrial and residential real property at its True Cash Value and to make any other corrections necessary to the appraisal records. The County will take into account the depreciated cost, market value and income approach to value of each commercial, industrial and residential parcel of real property and improvements which lie within the confines of the Municipality and to use similar methods and forms used by the Michigan State Tax Commission in the evaluations. B) Duration of the Project — This reassessment project shall be completed and be ready for the tax roll in the year 2008. C) Payment Schedule In consideration of the services of the County under this Amendment 1, the Municipality agrees to pay to the County a fee of $30.00 per real improved property description payable in five (5) annual installments computed on the basis of the Municipality's current real improved property parcel count of 4,025. Any increase or decrease in parcel count will be accounted for at the end of the project and paid for at the last installment. 2 The first installment shall be due and payable on June 30, 2007 and the final installment will be due on June 30, 2011. D) Extension of the Original Contract for Oakland County Equalization Division Assistance Services with the Township of Holly — The Original Agreement between the County and the Municipality which expires on June 30, 2008 is hereby extended and shall now expire on June 30, 2011. For and in consideration of the mutual assurances, promises, acknowledgements, warrants, representations, and agreements set forth in this Amendment 1 to Contract, and for other good and valuable consideration, the receipt and adequacy of which is hereby acknowledged, the undersigned parties hereby execute this Amendment 1 to Contract on behalf of the Parties, and by doing so legally obligate and bind the Parties to the terms and conditions of this Amendment 1 to Contract. IN WITNESS WHEREOF, Dale M. Smith, Supervisor of the Township of Holly, hereby acknowledges that he has been authorized by a resolution of the Board of Trustees of the Township of Holly, a certified copy of which is attached, to execute this Contract on behalf of the Municipality and hereby accepts and binds the Municipality to the terms and conditions of this Amendment 1 to Contract.
