MISCELLANEOUS RESOLUTION # 06023

IN RE: OAKLAND COUNTY DEPARTMENT OF FACILITIES MANAGEMENT REQUEST TO
GRANT RECIPROCAL CROSS ACCESS EASEMENT TO THE CITY OF ROCHESTER
HILLS — 52-3 DISTRICT COURT (TAX PARCEL NO. 15-26-377-002)
TO: The Oakland County Board of Commissioners
Chairperson, Ladies and Gentlemen:
WHEREAS, the County of Oakland is the owner of 52-3 District Court and Sheriff Substation
property located at 700 and 750 Barclay Circle in the City of Rochester Hills; and
WHEREAS, Pursuant to the terms and conditions of the present sublease agreement between
the County of Oakland and the City of Rochester Hills dated August 22, 2002 for the construction and
leasing of the new Sheriff Substation located at 750 Barclay Circle the County is required to apply to
the City for a parcel split to separate the courthouse property and the substation property; and
WHEREAS, City has granted the parcel split subject to the County and the City granting a
Reciprocal Cross Access Easement over the Courthouse and Substation properties. The purpose of
the easement is to provide for common ingress and egress over the properties and for the
construction, operation, maintenance and repair of the parking areas and driveways located on the
properties; and
WHEREAS, the Departments of Facilities Management and Corporation Counsel have
reviewed and/or prepared all necessary documents related to the granting of the easement.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners
hereby authorizes and approves the granting of the attached Reciprocal Cross Access Easement to
the City of Rochester Hills for the sum of one dollar.
BE IT FURTHER RESOLVED that the Oakland County Board of Commissioners hereby
directs its Chairperson or designee to execute the attached easement.

RECIPROCAL CROSS ACCESS EASEMENT
Know all men by these presents, that the City of Rochester Hills, a Michigan Municipal Corporation
Owner of Parcel "A" (Sheriff's Substation), whose address is 1000 Rochester Hills Drive, Rochester Hills, Michigan 48309
and the County of Oakland, a Michigan Constitutional Corporation Owner of Parcel "B" (Courthouse), whose address is
1200 North Telegraph Road, Pontiac, Michigan 48341 do hereby grant and convey a perpetual non-exclusive reciprocal
easement for purposes of ingress, egress, construction, operation, maintenance and repair over the parking lot areas
inclusive of secured parking areas and driveways to and from Barclay Circle for the consideration of ($1.00).
Parcel "A" (Sheriff's Substation) is described as follows: Sidwell # 15-26-377-003.

Said easement area (s) parking areas and the driveway facilities therein will conform to the Site Plan approved by the City
of Rochester Hills, and no changes or alterations in the easement or the driveway facilities on this site will be made without thc
approval of the City of Rochester Hills.

Chairperson, Ladies and Gentlemen:
Pursuant to Rule XII-C of this Board, the Finance Committee has
reviewed the above referenced resolution and finds:
1. Terms of the sublease agreement between Oakland County and
the City of Rochester Hills for the Sheriff Substation
require the County to apply to the City for a parcel split
to separate Courthouse and Substation property.
2. The City of Rochester Hills has granted the parcel split
subject to the County and the City granting a Reciprocal
Cross Access Easement over the Courthouse and Substation
properties.
3. The purpose of the easement is to provide for common
ingress and egress over the properties and for the
construction, operation, maintenance and repair of the
parking areas and driveways located on the properties.
4. The resolution authorizes and approves the granting of a
Reciprocal Cross Access Easement to the City of Rochester
Hills for the sum of one (1) dollar.
5. No General Fund/General Purpose amendment is required.
