MISCELLANEOUS RESOLUTION 106203 October 19, 2006 BY: Public Services Committee, Jeff Potter, Chairperson IN RE: SHERIFF'S OFFICE - FY 2006 HIGHWAY SAFETY CHALLENGE AWARD GRANT ACCEPTANCE To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS the Sheriff's Office applied to the Michigan State Police, Office of Highway Safety Planning, for $5,003 in grant funding to purchase law enforcement related equipment at a total cost of $5,980; and WHEREAS the Michigan State Police awarded Oakland County with a grant in the amount of $5,000; and WHEREAS county funds, available in the Sheriff's budget, in the amount of $980 are necessary to purchase the equipment; and WHEREAS the acceptance of this grant does not obligate the County to any future commitment; and WHEREAS the continuation of this program is contingent upon future levels of grant funding. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approves the FY 2006 Highway Safety Challenge Award Grant from the Michigan State Police in the amount of $5,000 and that the Board Chairperson, on behalf of the County of Oakland, is authorized to execute said agreement as attached. In my March 15, 2006 e-mail, I stated "The above-referenced grant application is approved with modification. I will call the Michigan State Police —Office of Highway Safety and Planning to attempt to change the language in paragraph 9 of the 'Grant Management Requirements'. Paragraph 9 addresses indemnification. This paragraph requires the County to be liable for the acts of subcontractors and 'indirect employees' (whatever that might be) to the extent provided by law. I want to see this language changed to be consistent with the language we have in other grants regarding liability." Back on March 21, 2006, I sent a fax to Pat Eliason of the Office of Highway Safety explaining the issue and sending a copy of the 2004 Homeland Security Grant Program Agreement from the Emergency Management Division of the State Police. At that time, I requested that the language be made consistent with the other grants 10/3/2006 Page 2 of 2 from the Michigan State Police and specifically the EMD Division. I never heard back from Pat Eliason, so I followed up with Pat Eliason yesterday and she said the State would not be changing the language. This grant is approved with the following condition(s): 1. A grant orientation conducted by OHSP is mandatory for all grant project directors. Please contact your program coordinator to schedule an orientation. The orientation and the on-line report training can be conducted at the same time via telephone or in person. 2. Any grant revision request that adds or deletes objectives and/or activities must have OHSP approval. Electronic progress and financial reports are due on: October 30, 2006, and November 15, 2006 respectively. However, reports can be submitted once the equipment has been purchased.
