On June 16, 2016, the Board of Commissioners for Oakland County entered into an agreement per MR #16147 –
Department of Management and Budget/Equalization Division – Approval of Contract for Oakland County Equalization Division Assistance Services with the Charter Township of Orion.
As required by Urban Cooperation Act 7 of 1967 - MCL 124.510(4), a copy of the signed agreement with the County of
Oakland and the Charter Township of Orion and the authorizing Board of Commissioners Resolution are enclosed for filing by your office.

MINUTES, REGULAR MEETING, MONDAY, APRIL 4, 2016
1. CALL TO ORDER. The Charter Township of Orion Board of Trustees held a regular
meeting on Monday, April 4, 2016, at the Orion Township Hall, 2525 Joslyn Road, Lake Orion,
Michigan. Supervisor Barnett called the meeting to order at 7:00 p.m.
BOARD MEMBERS PRESENT: Chris Barnett, Penny Shults, Mike Flood, Neil Porter, and
John Steimel.
ABSENT WITH NOTICE: Mark Thurber, Donni Steele
OTHERS PRESENT:

2. INVOCATION AND PLEDGE
Trustee Flood, representing Gingelleville Church, gave the Invocation. All rose for the Pledge of
Allegiance.
3. RECOGNITIONS
A. Home Depot’s contribution in the Oakland County Sherriff’s Substation Kitchen
Remodel – Lieutenant Toth recognized the team from Home Depot and thanked the entire staff
for their efforts in remodeling the kitchen in the Oakland County Sherriff’s Substation.
B. Orion Township Citizen of the Month. Alaina Campbell was recognized as the Orion
Township Citizen of the Month. Supervisor Barnett recognized Ms. Campbell for her
contributions to the community.
4. PROCLAMATION
Severe Weather Awareness Week. Supervisor Barnett proclaimed the week of April 10-16,
2016 as Severe Weather Awareness Week, and is encouraging all Orion Township Citizens to
make sure they are properly prepared to deal with severe weather when it occurs.
5. APPROVAL OF BILLS. Moved by Clerk Shults, seconded by Trustee Porter to authorize
payment of bills in the amount of $437,955.19, and payrolls of $133,737.67, for a total
disbursement of funds in the amount of $570,329.91, as presented.
AYES: Flood, Barnett, Shults, Steimel, Porter NAYS: None ABSENT: Steele, Thurber

6. BRIEF PUBLIC COMMENT. Public comment was not heard.
7. APPROVAL OF AGENDA. Trustee Flood requested Item D and Item H moved from
Consent Agenda to Pending Business. Supervisor Barnett requested the addition of Police
Millage to Pending, and requested the addition of a Closed Executive Session. Supervisor
Barnett requested moving Reports before Pending Business.

8. CONSENT AGENDA
A. Minutes, Regular Board Meeting, Monday, March 21, 2016. Approve as presented.
B. Minutes, Public Hearing MDNR Grant Application, Monday, March 21, 2016. Approve
as presented.
C. New Investments. Receive and file New Investment report.
D. Oakland County Equalization Agreement. Approve the 2016-2019 Oakland County
Assessing Services contract with Oakland County Equalization, as submitted, and authorize the
Supervisor and Clerk to sign the agreement on behalf of the Township
E. Purchase SCBA Equipment – Fire Department. Approve the purchase of 20 Self
Contained Carbon Air Cylinders with valve assembly and a 45 minute rating and 30 year life and
thread protection covers from Argus-Hazco for a cost not to exceed $25,000.00 and authorize the
necessary budget adjustment.
F. Orion Township Public Library 2015 Audit. Receive and file the 2015 Orion Township
Library Audit Report, as presented.
G. Parks & Recreation Advisory Committee Bylaws. Approve the revised copy of the Parks
and Recreation Advisory Committee Bylaws.
H. MDOT Resolution: Silverbell Road. Approve the contract with the Michigan Department
of Transportation (MDOT) for the construction of an additional right turn lane on westbound
Silverbell Road at Lapeer Road (M-24) for an amount not to exceed $37,000.00, and authorize
Supervisor Chris Barnett and Clerk Penny Shults to sign Contract #15-5607 on behalf of the
Township.
I. Set Orion Township Corridor Improvement Authority Public Hearing. Set a Public
Hearing for the Orion Township Corridor Improvement Authority (CIA) for May 16, 2016 at
7:05 p.m. in the Township Hall Boardroom and authorize the Clerk to publish the proper notices.
J. Adopt Internship Program. Approve the Orion Township Intern Program, as amended.
Moved by Clerk Shults, seconded by Trustee Flood to approve the Consent Agenda, as amended.

A. Village Water System Update. Moved by Clerk Shults, seconded by Trustee Porter to
receive and file the Village Water Update report provided by the Village manager, as presented.

B. Orion Center Update. Moved by Clerk Shults, seconded by Trustee Steimel to receive and
file the Orion Center Update, as presented.
MOTION CARRIED
C. Township Engineering Standards. Moved by Clerk Shults, seconded by Trustee Flood to
receive and file the Township Engineering standards (with the understanding that this item will
be brought back before the board for final approval), as presented.

10. PENDING BUSINESS
A. Property Update. Realtor Kathleen Sanchez provided a Property Update. Moved by Trustee
Steimel, seconded by Clerk Shults to receive and file the property update, as presented.
MOTION CARRIED
Moved by Trustee Porter to make a counter offer to sell the property on Galaxy Way to Mr. Kase
for $250,000.00.
THE MOTION FAILED FOR LACK OF SUPPORT
Moved by Trustee Steimel, seconded by Trustee Flood to accept the offer to purchase the Galaxy
Way property, at the sale price of $242,000; should the sale at that price not be completed, a
secondary offer to purchase in the amount of $225,000 will be accepted. AYES: Steimel, Porter,
Flood, Barnett NAYS: Shults ABSENT: Thurber, Steele

B. Adopt Keatington Subdivision Road SAD Resolution. Moved by Clerk Shults, seconded
by Trustee Flood, to adopt the resolution applying for Road Commission SAD Improvement of
County Roads in Keatington Subdivisions 4 & 5, as presented.
AYES: Steimel, Porter, Flood, Barnett, Shults NAYS: None ABSENT: Thurber, Steele

C. Community Build: Public Restrooms. Moved by Clerk Shults, seconded by Supervisor
Barnett to authorize the Supervisor to work with the various agencies, including the Township’s
insurance agency, regarding the community build of public restrooms and bring back findings to
the Township Board of Trustees for further consideration.
AYES: Barnett, Shults, Steimel, Porter, Flood NAYS: None ABSENT: Thurber, Steele

D. Silverbell Road Pathway. Moved by Clerk Shults, seconded by Trustee Flood to approve a
budget of $24,750.00 to assist with Easement Acquisition costs and direct OHM to begin the

acquisition process for the purposes of completing the Silverbell Road Pathway, which will be

E. Watermain Improvements. Moved by Clerk Shults, seconded by Trustee Steimel to
approve proceeding with the Watermain Improvements for adequate fire protection and approve
OHM to proceed with the preparation to determine what action is needed to fix the flow
deficiencies for the locations at Orion Commerce Center, Brown Rd./Joslyn Rd. and
Northpointe. Board approval to allow OHM to secure easements and prepare bid documents and
proceed with the bid process. Engineering costs in the amount of $129,750.00, monies will come
from 592-556-971.001.
AYES: Flood, Barnett, Shults, Steimel, Porter NAYS: None ABSENT: Thurber, Steele

CLOSED EXECUTIVE SESSION: Discuss Attorney Opinion Letter.
Moved by Clerk Shults, seconded by Trustee Flood to go to Closed Executive Session to discuss
