As required by Urban Cooperation Act 7 of 1967 - MCL 124.510(4), a copy of the signed agreement with the County of Oakland and United States Department of Homeland Security’s Federal Emergency Management Agency (FEMA) and the authorizing Board of Commissioners Resolution are enclosed for filing by your office. PRESENT: Mayor Cathy Daldin, Councilmembers Stuart Bikson, Jeffrey Cuthbertson, Ben Giovanelli and Ann Peterson. ABSENT: None. Mayor Daldin led the Pledge of Allegiance. Councilmember Ray gave an update from the Historical Commission regarding funding for the Detroit United Railway (DUR) book being created by the Historical Commission. Proposed costs are $10,747.05 for 500 copies and $13,971.41 for 1,000 copies. The book would be sold for $39.95. No action was requested at this time. Councilmember Giovanelli commented on the use of GoFundMe and social media for Historic Book Funding. Councilmember Ray commented on the retail and fixed costs of the Historic Book and stated that funds from the Historic Book should be used for historical preservation within the City. Council received an update from RARA Executive Director Ron Jewell. Councilmember Russell commented on the Boards and Commissions reporting process. Mayor Daldin recognized Vanessa from Expert Human Resources to answer questions regarding the methodology of the wage survey. Mayor Daldin asked Vanessa about the comparison criteria and data collection for the survey. City Manager Wing noted that RARA Executive Director Ron Jewell had provided a timeline of the process. Mayor Daldin asked Ron Jewell about a budget amendment for RARA employee compensation. City of Rochester City Council Meeting Minutes July 10, 2017 Page 2 of 5 Councilmember Giovanelli commented on the comparably high compensation for RARA employees Councilmember Ray asked Ron Jewell about the process for choosing a service provider. Councilmember Bikson commented on the controversial nature of the RARA employee compensation budget. Urge to work out compromise…. Councilmember Russell asked about employee evaluations within RARA and percent of increase for Executive Director salary from 2016 forward. Councilmember Peterson commented on Rochester Hills involvement in budget process for RARA. Mayor Daldin opened the meeting for Public Comment. Jane Turner, Parkdale, commented on the demolition of a House on Elizabeth Street, the Notify Me feature on the City website, Special Event Permits, enforcement of signs on public Right-of-Way, and sewer bond. Councilmember Cuthbertson commented on the costs for upgrading the audio/visual to broadcasted meetings. Council considered approval of the Minutes of the Regular Meeting held June 26, 2017. Russell moved, Peterson seconded to approve the Minutes of the Regular Meeting held June 26, 2017. YES: Daldin, Russell, Bikson, Cuthbertson, Giovanelli, Peterson and Ray. NO: None. Motion Carried. Council considered two items on the Consent Agenda. Both were approved with one motion. Peterson moved, Russell seconded to approve the Special Event Application from Rochester Jaycees to hold Rally for Rochester 5K Fun Run on Sunday, August 20, 2017. YES: Daldin, Russell, Bikson, Cuthbertson, Giovanelli, Peterson and Ray. NO: None. Motion Carried. Peterson moved, Russell seconded to approve the Special Event Application from Crossroad Care Center of Auburn Hills to hold Bike for Life 2017 on September 16, 2017. YES: Daldin, Russell, Bikson, Cuthbertson, Giovanelli, Peterson and Ray. NO: None. Motion Carried. Deputy City Manager Banda provided information on Special Project Approval for 400 Water Street, Rewold Office Building. Council received a presentation from Stephen Auger regarding the Site Plan and Special Project Approval for 400 Water Street, Rewold Office Building. City of Rochester City Council Meeting Minutes July 10, 2017 Page 3 of 5 Frank Rewold commented on project givebacks for the City, including improvement of the habitat on Paint Creek. Councilmember Cuthbertson stated that Planning Commission minutes should be in Council packet when relevant to an agenda item, and that Planning Commission expectations of the 400 Water Street Special Project must be addressed. Jason Rewold of Frank Rewold & Son explained the role of grant funding for the Special Project. Councilmember Ray asked whether or not work would be conducted directly in the river. Deputy City Manager Banda replied no, explaining that soil contamination would prevent it. Eric James from Land Design Studio provided an overview of the Site Plan. Councilmember Cuthbertson asked about the plan for decaying root structure at the site. Eric James replied that landscaping will help create new root structures. Frank Rewold commented that they do not want project landscaping to disturb the natural environment or obstruct the view of the river. Councilmember Peterson commented that the area is too steep to open up additional viewpoints of the river and felt that the dirt should not be disturbed with new foliage. Mayor Daldin opened the meeting for Public Comment. Mayor Daldin closed Public Comment. Councilmember Giovanelli asked who would be responsible for maintenance of the creek bank, how soil will remain undisturbed by project landscaping, and about the wall. Deputy City Manager Banda said the property owner would be responsible and not the Michigan Department of Environmental Quality, and that there will be a vapor barrier and new soil so that new landscaping will not involve disturbing the original soil. He stated that the wall is in good shape. Frank Rewold commented that the City will have no responsibility in terms of the passage of water through the wall. Councilmember Peterson asked about distance between Paint Creek and proposed office building. City of Rochester City Council Meeting Minutes July 10, 2017 Page 4 of 5 Councilmember Russell commented on soil preservation of the soil at Paint Creek and leaving the area as natural as possible, and asked about the traffic study, parking requirements, and crosswalk. Deputy City Manager Banda said that the building meets its parking requirements, and stated that the crosswalk is meant to keep people from walking through parking lot aisles to access the Rewold Office Building. Councilmember Cuthbertson stated that a statement of approval should be obtained from the Brownfield Redevelopment Authority. Mayor Daldin commented on procedure Councilmember Cuthbertson stated that he would make a conditional motion, contingent upon obtaining a finalized landscaping plan, approvals from the Brownfield Redevelopment Authority, and a statement of approval that Brownfield plan is not approved and that site plan and special project is conditioned upon final approval of those instruments and a report of the final plan for Council and Planning Commission; also a condition that approvals from Brownfield and other environmental related approval per loan. Councilmember Russell asked if this could be postponed until the next meeting Scott Reynolds commented further on the plan for planting along the river. Cuthbertson moved, Giovanelli seconded to approve the Site Plan and Special Project for 400 Water Street, Rewold Office Building with two conditions; finalized riverbank stabilization plans to be considered by City Council and Planning Commission and contingent upon Brownfield Redevelopment Authority approvals per loan. YES: Daldin, Russell, Bikson, Cuthbertson, Giovanelli, Peterson and Ray. NO: None. Motion Carried. Giovanelli stepped out. Council considered an amendment to the City Code, Chapter 27, Section 27-3 and 27-4 Historic Districts – Second Reading and Adoption. Russell moved, Cuthbertson seconded to give Second Reading and Adoption to Ordinance 2017-08 an Ordinance Amendment to the City Code, Chapter 27, Sec. 27-3 and 27-4 Historic Districts. YES: Daldin, Russell, Bikson, Cuthbertson, Peterson and Ray. NO: None. ABSENT: Giovanelli. Motion Carried. Giovanelli returned. Council considered an interlocal agreement with Oakland County for Animal Control Services for 2017, 2018 and 2019. Peterson moved, Russell seconded to approve an Interlocal Agreement with Oakland County for Animal Shelter Services and Disposal for 2017, 2018 and 2019. YES: Daldin, Russell, Bikson, Cuthbertson, Giovanelli, Peterson and Ray. NO: None. Motion Carried. City of Rochester City Council Meeting Minutes July 10, 2017 Page 5 of 5 Council considered a Cost Participation Agreement for Local Road Improvement Matching fund Pilot Program for Letica Road. The grant is for $14,440 and requires the City to match that amount. Cuthbertson moved, Giovanelli seconded to approve a Cost Participation Agreement with Oakland County for a Letica Drive Improvement Matching Fund Grant, the grant in the amount of $14,440 with the City matching that amount. YES: Daldin, Russell, Bikson, Cuthbertson, Giovanelli, Peterson and Ray. NO: None. Motion Carried. Council reviewed the check register reports. Deputy City Manager Banda provided an update on the Sundial project. Councilmember Bikson announced a RARA tennis tournament. Councilmember Ray discussed Historic Preservation and suggested talking with neighbors or petitioning to the Historical District Commission to become a non-contiguous historic district. Councilmember Giovanelli commented on an email from a resident regarding water spending. Councilmember Russell commented on Boards and Commissions updates, Public Comment sign-up cards, maintenance of parking decks, and detailed minutes for Planning Commission meetings. Parking Advisory committee meeting, cars left parked for a long time, detailed minutes for planning meetings. Sue Ann Douglas commented on Historic District ordinance. Mayor Daldin homecoming event schedule will be sent to Council and married a Rochester Hills couple. Deputy City Manager Banda commented on Brownfield and environmental consultant for 400 Water Street project. Motion from Peterson, seconded by Russell to approve a request to go into Closed Session to Consult with Legal Counsel Regarding Trial or Settlement Strategy regarding Pending Litigation & Strategy and Negotiation Session Connected with negotiation of a Collective Bargaining Agreement.
