On April 21, 2016 the Board of Commissioners for Oakland County entered into an agreement per MR #16072 – Sheriff’s
Office – Marine Patrol Services Agreement in the Charter Township of Orion 2016-2018.
As required by Urban Cooperation Act 7 of 1967 - MCL 124.510(4), a copy of the signed agreement with the County of Oakland and the Charter Township of Orion, and the authorizing Board of Commissioners Resolution are enclosed for
filing by your office.

1. CALL TO ORDER. The Charter Township of Orion Board of Trustees held a regular
meeting on March 21, 2016, at the Orion Township Hall, 2525 Joslyn Road, Lake Orion,
Michigan. Supervisor Barnett called the meeting to order at 6:15 p.m.

3. INVOCATION AND PLEDGE
Pastor Steve Sanders from the Lake Orion Baptist Church gave the Invocation. All rose for the
Pledge of Allegiance.
4. RECOGNITIONS
A. March 8, 2016 Election Assistance – Building and Grounds Employees. Clerk Shults
publicly recognized Adam Peelish, David Raferty, and Al Bothwell for their great efforts and
hard work in making the March 8, 2016 Presidential Primary a success.

B. Orion Township Citizen of the Month. Fire Chief Bob Smith recognized Firefighter Brian
Reynolds as this year’s Firefighter of the Year. Supervisor Barnett recognized Brian Reynolds
as the Orion Citizen of the Month for his service to the citizens of Lake Orion.
Supervisor Barnett encouraged everyone in the community to support the recovery of Emily
Schueren, Lake Orion High School student who recently suffered a brain hemorrhage.
5. PUBLIC HEARING: MDNR Grant Application – Clarkston Road, Phase 1B Pathway

7. APPROVAL OF BILLS. Moved by Clerk Shults, seconded by Trustee Porter to authorize
payment of bills in the amount of $1,485,239.09, and payrolls of $116,303.25, for a total
disbursement of funds in the amount of $1,601,542.34, as presented.

8. BRIEF PUBLIC COMMENT. Public comment was heard.
9. APPROVAL OF AGENDA. Supervisor Barnett requested the addition of the Sale of
Property, under Pending. Also the addition of the Michigan Natural Resources Trust Fund Grant
Resolution will be added under Pending. Clerk Shults requested moving Item PC-2014-36,
Meridian Commons PUD – Concept Plan to the first order of business under Pending, 11A.
Treasurer Thurber corrected item 10C, Accept Employee Resignation – the effective date should
read April 4, 2016.
Moved by Trustee Flood, seconded by Trustee Steele to approve the agenda, as amended.

A. Minutes, Regular Board Meeting, Monday, February 29, 2016. Approve as presented.

C. Accept Employee Resignation. Accept the resignation from Matt Duda, effective April 4,
2016.
D. 2016 Road Commission Chloride Program. Award the 2016 Chloride contract to the Road
Commission for Oakland County in the amount of $.29375/ft. for 5 applications for a total of
$52,080.70, and approve the necessary budget adjustment.
E. Goose Round-Up/Nest Destruction Program. Adopt the resolution and authorize the
Supervisor to correspond with the USDA Wildlife Services to request Goose Round-Up/Nest
Destruction in the Township upon written receipt by the USDA Wildlife Services of a request
from the residents and/or homeowners association governing that lake or a portion of it, for a
five year time period (2016-2020). “The Charter Township of Orion approves all lakes within its
boundaries for both of the Canadian Goose Egg & Nest Destruction and Round Up/Translocation
Programs. We realize the geese may be relocated with the State or killed. This Resolution is
passed for the years 2016-2020.”
F. License Agreement for the Use of McConnell Park. Approve the License Agreement for a
period from April 2, 2016 to April 1, 2016 and to authorize the Supervisor to sign it on behalf of
the Township.
G. Peddler/Solicitor License Application: Ice Cream Sales from a Truck, Peters. Approve
Mr. Peters’ application and issue a new peddler’s license under Ordinance 95.
H. METRO Act Permit Extension: McLeod USA (Windstream). Approve the permit
application, direct the Supervisor to execute the agreement, and notice the Michigan Public
Service Commission of the Board’s action.
I. Notice of Transfer under Ordinance 76, The Kroger Company. Receive and file the
notice.
J. Hire Full Time Maintenance Worker. Hire Conner Reiter as a Park Maintenance Worker, a
Level 5 Clerical Union Position at $17.12 per hour, full-time, 40 hours per week, full benefits,
contingent upon meeting all the pre-employment requirements, effective Wednesday, March 23,
2016.
K. NOCWA Engineering Services. Approve the increase to the blanket purchase
order/contract for NOCWA Engineering Services to OHM in the amount of $120,000 for a new,
not-to-exceed amount of $275,000 for a three year period to expire on March 31, 2018. Orion
Township DPW cost not to exceed $30,000 ($10,000 per year).
L. 2015 Year-end Financial Report. Receive and file the report.
M. WRAP (Wholesale Residential Assistance Program) Participation. Authorize the
Supervisor to sign the agreement to participate in the WRAP Program. (For low-income water
customers)

N. Request for Proposals for Township properties for fertilization and weed treatment.
Approve the request to advertise for sealed bids for fertilization and weed treatment on Township
properties.
O. Michigan Department of Transportation – Silverbell Add-on. Approve the contract with
MDOT for the construction of an additional right turn lane on westbound Silverbell Road for a
cost not to exceed $37,500, make the necessary budget adjustments, and authorize the Supervisor
to sign on behalf of the Township.
P. 2016 Marine Patrol Agreement. Approve the 2016 – 2018 Oakland County Sheriff’s Marine
Patrol Agreement, and authorize the Supervisor and Clerk to sign on behalf of the Township.
Moved by Trustee Steimel, seconded by Trustee Steele to approve the Consent Agenda, with
corrections.

25-400-033); from REC-2 to PUD, a vacant parcel south of 3350 Kern Road (Sidwell #09-25-
400-031); from SF to PUD; part of 3846 Kern Road, vacant parcel (part of Sidwell # 09-25-400-
027) from SF to PUD (for that portion of the parcel described in the final PUD plans); 1201 E.
Silverbell Road (Sidwell #09-25-400-016) from SF to PUD and, 1169 E. Silverbell Road

C. Second Reading: PC-2015-38, Skalnek Ford Conditional Rezone Request and
Agreement. Moved by Trustee Steele, seconded by Trustee Porter, to declare the second reading
held and deny PC-2015-38, Skalnek Ford Conditional Rezoning Request and Agreement to
conditionally rezone parcel 09-11-477-031 from General Business & Single Family Residential-
3 (R3) to General Business (GB); parcels 09-11-477-029 (862 Markdale) & 09-11-477-030 (874
Markdale) from R3 to GB, on the following basis: Reasons listed in the recommendation of
denial from the Planning Commission on December 16, 2015.
Clerk Shults stated that the Township received letters and an updated petition to deny rezoning
of PC-2015-38, Skalnek Ford Conditional Rezone Request and Agreement. The petition was
presented to the Board tonight from Jacqueline Carlson, 850 Markdale. 287 signatures were
included as part of the petition. Clerk Shults stated that letters of objection to the proposal were
received

confirm it is in favor of OHM providing services to PATMC, at no cost to the Township, for the
purpose of facilitating a handicapped parking area site plan.

E. Schedule Joint Meeting. Moved by Trustee Steele, seconded by Trustee Flood to schedule a
joint Township Board/Planning Commission/ZBA meeting for 6:00 p.m. on Wednesday, April
27, 2016 in the Township Hall Board Room, and authorize the Clerk to post as an open meeting.

H. Sale of Property. Trustee Steele asked the Board to be recused from voting on the Sale of
Property, due to a conflict of interest.
Moved by Trustee Porter seconded by Trustee Flood to accept the offer for $215,000.00 for the
property on Galaxy Way, as presented.
MOTION WITHDRAWN
Moved by Treasurer Thurber to withdraw the property from the market and come back to the
Board with recommendations on an alternative process.
THE MOTION FAILED FOR LACK OF SUPPORT
Moved by Treasurer Thurber to reject the offer of $215,000.00 for the property on Galaxy Way.
