Re: A.D.A. Sidewalk Ramp Improvements
Please accept the attached recommendation for consideration and approval for the 2016 *A.D.A. sidewalk ramp improvement project. This project consists of removing existing sidewalk ramps located on street corners in the northwest section of the city and replacing them with new A.D.A. compliant ramps. This project will be done simultaneously to our annual sidewalk replacement program this spring in the same area. The City Clerk’s office received sealed bids for this project on the submission deadline of March 3rd, 2016. Plan specification packets were picked up by three contractors. A public bid opening occurred at 10:00 a.m. on March 3rd, 2016 at the City Clerk’s office. Upon reviewing the submissions of the three bidders and subsequent background checks, I concur with the recommendation from Mr. Michael Smith from Anderson, Eckstein and Westrick. I recommend that the City Council award the bid to the lowest, qualified bidder; Lacaria Concrete Construction of Detroit. Funding for this project will come from the CDBG Grant Program, as well as City of Clawson sidewalk funding. Construction is anticipated to begin in early spring. Residents will receive a letter prior to construction with additional information. We are fortunate that the lowest bidder on this project is the same contractor that is doing our regular sidewalk replacement program. PLANS AND SPECIFICATIONS
Plans and specifications are on file and copies may be secured on Tuesday, February 16, 2016, after 1:00pm, at the offices of Anderson, Eckstein and Westrick, Inc., 51301 Schoenherr
Road, Shelby Township, Michigan 48315. A fee of $15.00 will be required for each set of
proposed plans and specifications and will not be refunded. A mailing fee of Fifteen Dollars
($15.00) to cover handling and postage will be charged to anyone wishing to receive the plans
and specifications via U.P.S.
Bidders wishing to download the Plans and Specifications at NO COST may do so by registering as a planholder with AEW over the phone at (586) 726-1234 and obtaining
download instructions.
BID SECURITY A certified check, bank draft, or satisfactory bid bond, executed by the bidder and a surety
company, payable to the City of Clawson, in the amount equal to five percent (5%) of the
bid, shall be submitted with each bid.
WITHDRAWAL OF BIDS No bid may be withdrawn for a period of sixty (60) calendar days after the receipt of bids.
This time frame may be adjusted through mutual agreement between the Owner and Contractor.
FEDERAL REQUIREMENTS
The Contractor and Subcontractors on this project must comply with HUD contract
provisions 24CFR part 85.36(i), the Davis-Bacon Act, Nondiscrimination, Equal
Employment Opportunity, Affirmative Action, Section 3 requirements, Anti-Kickback Act, Federal Occupational Safety and Health Act and Department of Labor Standards and
Regulations as set forth in the Contract Bid Documents. This municipality is an equal

AWARD OF CONTRACT The City of Clawson will award the contract to the lowest responsible bidder; however, it

fund - Mr. Pollock stated that the CDBG would be 2 years of funding at $52,262.00 and
the City Sidewalk Funding would be $44,226.60 - will be working in the northwest area
of the city.

Our Understanding of the Project:
Zoning is one of the City’s most effective tools for implementing
the recommendations of the Master Plan.
With a new Downtown Master Plan in place, the City of Clawson
seeks to amend the Zoning Ordinance to provide a framework for
development and redevelopment opportunities that are consistent with the Downtown Master Plan.
Clearzoning offers the following proposal to assist the City of Clawson with Zoning Ordinance amendments
specifically focused on downtown:
Downtown Zoning District and Site Standards. Replace the existing City Center zoning district and
related zoning standards, contained in Division 23, Sections 34-1191 through 34-1196 with three new zoning
districts as described and outlined in the Downtown Master Plan. New zoning standards will include:
• Three form-based zoning districts that align with the land use envisioned for the three downtown
areas. The form-based zoning ordinance elements will establish regulatory standards for a vibrant,
cohesive, and pedestrian-oriented downtown based on desired physical design elements and building
form.
• Uses and use standards will address non-residential, non-office uses for upper floors that preserve
the character of downtown, such as dance and martial arts studios, artist and craft space, and
galleries.
• Additional use standards will allow the City to permit innovative uses such as shared kitchens, pop-
ups, and entrepreneurship incubators.
• Standards that extend the lives of historic residential structures by permitting adaptive reuse for
non- residential uses that are generally compatible with the surrounding neighborhood.
• Site standards to improve screening requirements to buffer parking areas, rooftop equipment, and
trash containers from view.
Deliverable: The above-described new sections of the Zoning Ordinance will be presented in a format similar
to the Clearzoning format typically used for an entire City Ordinance. It will include illustrations and
hyperlinks where needed to assist the reader with better understanding of the required zoning standards.
The final document will be in an electronic file (PDF format) that can be incorporated into the City’s online
coding system (Municode) using a hyperlink. Timeline & Cost: Four months $18,000
(Professional fee includes two meetings with the Planning Commission)

Consideration of a Proposal to update the zoning and related ordinance in order to reflect the changes made in the Downtown Master Plan.
After discussion with the Development Team we determined that changes to both the
City Master Plan and the DDA Master Plan need to be approved by City Council. Since Clearzoning completed the DDA Master Plan, we determined it would make sense to have Clearzoning complete the ordinance changes, zoning changes, and codification
changes for the plan in which they completed and the DDA Board and Council
approved. Approving both of these proposals will allow both McKenna and Clearzoning
to work in conjunction with one another in order to update our Master Plan in its entirety throughout the entire City. Greg will work with his team at McKenna and coordinate with Clearzoning to make the necessary changes at the same time. Clearzoning submitted
the proposal included in your packet to assist with Zoning Ordinance amendments
specifically focused on downtown.
Under the proposal the existing City Center zoning district and related zoning standards will be replaced with three new zoning districts as described and outlined in the
Downtown Master Plan. The new sections of the Zoning Ordinance will be presented in
a format similar to the Clearzoning format typically used for an entire City Ordinance. It
will include illustrations and hyperlinks where needed to assist the reader with better understanding of the required zoning standards. The final document will be in an electronic file that can be incorporated into the City's Municode system using a
hyperlink. The timeline is a four month process at a cost of $18,000.00. My
recommendation is to approve the proposal submitted by Clearzoning to review and
update the Downtown Master Plan in the amount not to exceed $18,000.00. This project will be funded completely by the DDA and is pending approval by the DDA Board subsequent to Council approval.

Rod Arroyo, Clearzoning, was present to review the proposal to update the zoning and
related ordinances to reflect the changes made in the Downtown Master Plan - draft
completed within a 4 month period.
Mayor Luebs questioned how this will work with the City Master Plan – it was stated that the DDA Master Plan has been adopted as a part of the City Master Plan.
Councilmember Wooley questioned if clean-up of the ordinances will take place - Mr.
Pollock stated that is the proposed plan. Mr. Pollock stated the $18,000 is the responsibility of the DDA. Also, stated how the
DDA obtains their funding - explained the tax income from the DDA properties - County
and City dollars are captured - which are put back into the DDA.

Dear Mr. Pollock:
We have prepared the attached task descriptions and schedule for updating the City’s Master
Plan. We propose tasks and schedules to achieve efficiencies in project management and
adoption processes and effectively collaborate with the Administration, City Council and
Planning Commission on this effort. Our approach continues to maximize the assets of the
City and seeks to capitalize on new opportunities.
COMPETITIVE CITY
What residents and investors (current and future) expect from a city in terms of their day-to-
day experiences and the amenities offered changes. Now, more than ever, people and
businesses want to locate in quality places. That is, they seek places that are walkable, have
access to transit, offer diverse and quality housing options, have convenient day-to-day
services close to cultural amenities and recreation opportunities. The City’s commitment to
promoting high-quality development and supporting attractive residential neighborhoods
will keep it competitive in the region. A fresh look, updated master plan with corresponding
projects gives the community a chance to assess its competitor’s position and a plan to act.
BUDGET SENSITIVITY
The Master Plan Update scope of services is a strategic approach which will meet the 5 year
statutory requirements of the State Planning Act (Act 33 of Michigan Public Acts of 2008, as
amended).
Master Plan implementation concerns expressed by City leadership, development procedures, and plan inconsistencies will involve the elected and appointed officials, stakeholders from the City.
UPDATE
The City’s development pattern is established; the pattern, functions, and major structure of
the City, such as its block pattern, open space, public rights-of-way, etc. likely will not change
much in the next 10 years. For the most part, it is also safe to say that the City’s residential
areas will, to a great degree, remain residential and local commercial corridors will remain
predominantly commercial. But no City is static especially given the effect of the housing
disaster of the past 7 – 8 years. Also, there are opportunities for the continued
implementation of the Downtown Plan, the vision for Rochester Road, Crooks, 14 and Main
and the integration of the Wayne States Capstone project plan from last Fall and
consideration of reports on South Rochester Road.
An up-to-date Master Plan is also a requirement for the State of Michigan’s “Redevelopment Ready” certification, a designation that is very helpful for State grants and other funding.
PUBLIC INPUT ON UPDATES Clawson has many amenities (location in Oakland County, vital retail, growing nightlife, walkable neighborhoods) that make places interesting, great and attractive to new residents and business owners. Our approach to updating the Master Plan and is not to start with a blank slate; instead, our approach is to capitalize on what is working in the City and to facilitate potential, an approach that includes appropriate, but meaningful public participation and collaboration with City organizations and stakeholders.
TEAM
I will be personally involved as the Project Director. Mr. Greg Elliott, Principal Planner will
function as Project Manager assisted by Senior Planner Brian Keesey. Carrie Wakulat, Senior
Graphic Designer will be responsible for the document graphics. Our assembled team has
produced graphically rich, effective and thoughtful plans for many Midwest communities.
We are confident Clawson leaders will be very pleased with the final result of the mutual
efforts.
All services are provided according to the American Planning Association Code of Ethics.
SCHEDULE, END PRODUCTS AND FEE
The fee for updating the Clawson Master Plan update is $18,500, invoiced monthly based on
percent complete, with payment due in 30 days. The fee includes copies of all draft materials
for the Planning Commission; final, hard, library copies of the documents will be provided at
cost of reproduction. The fee also includes one digital copy and one hard copy of the final
documents and is based on the expectation that much of the work with the Planning
Commission will be accomplished at regular Planning Commission meetings. The proposed
public participation meetings and survey are also included in the fee. The anticipated twelve
month schedule with tasks is attached; if the project is approved, we can begin April, 2016
and be ready for final adoption by the City in early 2017.
AUTHORIZATION If the approach, tasks and compensation are acceptable, please have this agreement signed below and forward an executed copy to us for our files.

Title and Description of Task Tentative
Project Schedule
Planning Goals and Vision
Review and in some cases, revise the goals, objectives and policies of the
current plan. Some goals are no longer valid; others have been addressed,
and new goals will be established based upon input obtained from the
public. Potential new goals to consider are planning for a mix of uses that
maintain a viable tax base to ensure quality municipal service to Clawson
residents and addressing MEDC “Redevelopment Ready Community”
criteria. Additionally, the plan will incorporate the goals and placemaking
strategies emerging from public engagement. Per State regulation,
notice of the planning process will be provided to adjacent communities.
Issues related to such as “tiny houses”, house sharing (Airbnb) water
smart small lots, leveraging density for “planning gain” for the City, impacts
of increasing rental of detached single family dwelling units will be
presented and assessed.
First
Inventory and Analysis
Update socio-economic data based on the latest American Community
Survey updates of 2010 U.S. Census of Population and Housing and
SEMCOG projections. Current existing land use and public facilities
including parks and recreation changes will be mapped and updated as
well. McKenna will also review and incorporate projects that the City has
accomplished since the last Master Plan Update and Land Use
implications assessed.
Second
Transportation
Public rights-of-way represent a major land use (obviously under public
control) and offer great potential for mature cities upgrades. A future
transportation plan will be added to address transportation policy options
for Clawson. As required by Michigan Planning Enabling Act, a “Plan for
Complete Streets” in the City will be created and recommendations for all
street users (auto, bus, bike, and pedestrian) and their abilities will be
provided.
“Complete Streets” are a critical component of a successful community,
particularly communities with commercial corridors like Clawson.
McKenna will also integrate recommendations (including downtown
pedestrian islands) resulting from any relevant study of transit options for
the City.
Third - Continued
Neighborhoods
The benefits of the continued improvement to the quality, appearance
and identity of Clawson neighborhood areas will be analyzed and
alternatives explored. Techniques to address foreclosed, abandoned,
vacant and blighted properties will be examined and a plan to stem and
reverse any decline in property tax base.
A survey of properties that could be an opportunity for new flexible
neighborhood uses and strategies to preserve, protect, and selectively
transform City neighborhoods will be recommended.
Fourth
Sub-Area Plans
The Master Plan provides the opportunity to visit plans for strategic
redevelopment of sub-areas of the City, including undeveloped areas. The
Planning Commission may identify key issues in these sub-areas areas to
be explored early in the Master Plan process.
Future land use recommendations will be provided, and as funding permits,
general site plans (and some 3-D renderings) of potential reuses may be
created. These plans will help the City communicate a vision for any areas
for future investment.
Fifth - Sixth
Future Land Use Plan
This chapter requires extensive rewrite. While some of the corridor areas
envisioned in the current Master plan have translated into reality in the
form of the BRD-1, BRD-2 and West Gate Districts, other areas are
neglected and may have growth potential such as West 14 Mile corridor
between Bywood and Marais, north and south Rochester Road corridors,
West Maple between Livernois and Selfridge, North Main north of
downtown. The Master Plan needs to identify these corridors and a long
range vision for them, while tweaking the language on existing corridors.
The future land use plan text and maps will be updated to reflect the
updated goals, and recommendations resulting from the tasks performed
for the transportation, recreation and parks, neighborhoods, and any sub-
areas. Future land use categories including areas of recent new zoning
districts will be mapped and described and new categories created or
eliminated, as necessary.
Seventh
Implementation Plan
The Planning Commission and City Council have accomplished some of
the tasks listed in the Implementation Plan; therefore, some revision is
necessary to update it based on the new goals and corridor redevelopment
plans.
McKenna will identify new tasks that evolve from the Master Plan
update. An implementation matrix that describes implementation
projects, priority, timeframe, and responsible parties will be included as
part of this chapter.
Eighth
Zoning Plan
The Michigan Planning Enabling Act now requires a Zoning Plan, which
includes explanation of how the land use categories on the future land use
map relate to the districts on the zoning map. The Zoning Plan will also
include any potential new zoning district recommendations.
Ninth
Public Engagement
A successful master plan requires resident and stakeholder buy-in. The
single required public hearing at the end of the planning process may not
be sufficient to get the input and buy-in necessary for the preparation of
a successful plan update. We propose to engage the public in the
beginning, middle, and end of the process.
Although the final format of public participation will be developed in
consultation with the Planning Commission and City Administration, we
propose the following:
• Community Wide Visioning Session
• Online Public Engagement - Survey / Forum
• Public Open House to Review the Draft Plan
First - Twelfth
Review of Plan
City Council approval of distribution: to adjacent municipalities and regional
agencies for 63 day comment period and Public Hearing (15 day notice)
by Planning Commission; review of all comments and adoption.
Tenth - Twelfth
Meetings
McKenna will meet with the Planning Commission and the City
Administration on a regular basis throughout the master plan process. A
final schedule of meetings will be developed in consultation with the
Planning Commission and City Administration.
Ongoing
Plan Graphics
Graphics make subtle plan concepts easier to comprehend, more
attractive, and more likely to obtain buy-in from the public. The new
master plan will include suitable maps and some graphics to communicate
plan concepts.

Phil McKenna, McKenna Assoc., was present and introduced the new project manager Gregory Elliott for the City of Clawson and Master Plan update. Also, reviewed the
process of updating the Master Plan - focusing on the commercial corridors - potential
improvement to other areas of the City outside of the downtown. Focus on reinvestment
and redevelopment within the city. The process will take approximately one year will involve the residents and the Planning Commission.
Councilmember Wooley asked if there would be an overview of the previous Master
Plan - possible presentation to the residents. Mr. McKenna stated there will be a review
and assessment of the current plan.

the Michigan Liquor Control Commission to transfer ownership and location of a Class C liquor license to be located at 303 S. Main, Clawson. Woodpile is owned equally by four partners, Timothy Idzikowski, Michael Moloney, Brandon Hannish, and Zachary

Woodpile is a smoked BBQ restaurant specializing in traditional bar-b-que. Woodpile has been operating at this location without the sale of alcohol since December 2015.
Woodpile’s hours of operation are generally from 11:00 am to 9:00 pm from October to April and 11:00 am to 10:00 pm from May to September, 7 day’s week.

According to the ordinance and policy for new and/or renewal of a Class C Liquor License, businesses must make application for their new/renewal licenses to the City
Clerk's Office each year with a public hearing to be held at the first Council meeting in
January. Clawson's Woodpile BBQ Shack, LLC has applied to the Michigan Liquor
Control Commission and to the City of Clawson, to transfer ownership and location of a Class "C" Liquor License to be located at 303 S. Main. Under administrative rule R 436.1105, the Commission shall consider the opinions of the local residents, local
legislative body, or local law enforcement agency with regard to the proposed business

limited hours - some liquor but not full bar - 5-6 beer on tap - will have some live music.

The existing assessing contract between Oakland County Equalization and the City of Clawson will expire on June 30, 2016. In anticipation of a renewal of the contract, we have

the renewal document, our office has reproduced the provisions of the existing contract
except for the following provisions: The cost per parcel has been adjusted by a 3% increase. If you recall, the existing cost per parcel has remained fixed for the last 3 renewals or a total of at least 8 years now.
In summary, the cost per parcel to the City will go up from $13.60 to $14.00 (rounded) for

Councilmember Ulbrich questioned the impact of 3% - Mr. Pollock stated the City has
5,347 real parcels and 514 personal property parcels - currently paying $79,092.80
annually will increase to $81,437.20 - which would be an additional $2,344.40. City Attorney Kingsepp stated he has reviewed the contract and has worked with the
County on several occasions.
Mr. Pollock stated the contract includes the Board of Review and Tribunal - the only additional cost is $2,500 for postage.

other Oakland County municipalities to declare April to be Child Abuse Prevention and
Awareness Month. This is an excellent opportunity for your municipality to demonstrate its support in ending child abuse and to support the numerous victims who are among us.
We would be honored if you would sponsor an official proclamation which would recognize the month of April as a way of educating the public on the seriousness of violence against our
children. CARE House of Oakland County, as you may know, has been working tirelessly to
provide the community with prevention, intervention, and therapy programs for child victims and their families. On March 30 at 6:00 p.m., we are hosting the planting of a pin wheel garden at
the Oakland County Court House as part of our effort to bring awareness to the
accomplishments that have been made and the work that still needs to be done. We hope you or an official representative will join us. If you are unable to attend, we ask that your

is needed in the community; and
WHEREAS, CARE House of Oakland County works to break the cycle of child abuse
and neglect; provides a protective circle of light and hope for a better life; and advocates
for the safety and protection of children; and

Women's Club Federation Day and celebrating the GFWC Clawson Women's Club 48th
Anniversary in the City of Clawson.
Each year, GFWC clubs celebrate this important day in their local communities, states, and across the nation. The Clawson Women's Club, the local division of the General
Federation of Women's Clubs (GFWC), were formed in February 1968 but trace their
origins to the 1940s, when they met as the Clawson Senior Women's Club. The
Clawson Women's Club sponsors the kiddie/pet parade, rides at the Clawson Fourth of July celebration, summer library parties, Lunch with Santa, Bunny Brunch, etc. The club also raises funds to help support several nonprofit organizations in the area including
large donations to help make the Wedding Exhibit and General Store display to the
Museum as well as a large donation to the Goodfellows and Food Bank this past year.
My recommendation is that April 24, 2015 be recognized as GFWC Federation Day and that we join in celebrating the 47th Anniversary of the founding of GFWC Clawson Women's Club.

for our fires and countless other wood products; and
WHEREAS, trees in our city increase property values, enhance the economic vitality of business areas, and beautify our community; and

CITY ATTORNEY'S REPORT
City Attorney Jon Kingsepp gave the following report:
• New city prosecutor will be present at the next meeting to discuss the new
ordinance and amendments to be updated
• Will be presenting for 1st reading Noise Ordinance - Disturbing the Peace ordinance to be amended - will be an objective standard to measure
• Court is satisfied with new prosecutor and revenues have increased
Councilmember Ulbrich questioned the clean-up/update of ordinances that are obsolete
- Mr. Kingsepp stated that the administration can be directed to review and update the
ordinances - if council has suggestions they can be directed to City Attorney.
CITY MANAGER'S REPORT
City Manager Mark Pollock gave the following report:
• Budget workshop dates have been set for - Wednesday, April 20, Monday, April 25 and Tuesday April 26 from 7-10pm - Will be a 3 year budget format
• Recycle bins located at all the parks - will confirm with Doug - rubbish bin next to
recycle bin - bins marked well for recycling Councilmember Airriess stated that compost begins tomorrow April 6th - for yard waste
Mayor Luebs questioned if the DPW Open House is scheduled for June 4th - Mr.
Pollock will confirm the date with Mr. Ballard - paper shredding will be included. SOCRRA is preparing for Single stream recycling in 2017 - talking about updates to
facilities at Coolidge - same carriers with single stream recycling
Mr. Pollock stated that Red Oaks can be used as a transfer station and holding facility Mayor Luebs proposed hosting a City of Clawson Roundtable Meeting with the
Businesses - the City Department heads can give an update of their department - April
27 at 8:30-9:30am. Mr. Pollock stated he will make it mandatory.

Councilmember Wooley addressed the changes to cable channel – it states to refer to
city website for further information - when will a schedule of events be available on the cable channel Mr. Pollock stated that Dave is working on a schedule to be placed on the
website and possibly in the newsletter.

coming back - 12-8pm need volunteers
Councilmember Wooley stated the Alumni Drill Team is coming back for the parade
contact Kim Brown on Clawson Facebook - looking for an Alumni Band.
PUBLIC DISCUSSION - ITEMS NOT ON THE AGENDA
Ray Krokos, 1563 N. Bywood, commented about the regulation on bicycles - questioned
about regulations for drones.
Councilmember Horton stated he has received a call and email from a group of
Clawson residents - Judy Phillips - group collecting and making new blankets and
bedding – he recommended they contact Haven - they delivered the donations - thanks
to those that have donated.
