As required by Urban Cooperation Act 7 of 1967 - MCL 124.510(4), a copy of the signed agreement with the County of
Oakland and the Charter Township of Independence, and the authorizing Board of Commissioners Resolution are

Supervisor Kittle called the meeting to order at 6:00 p.m. at the Independence Township Hall, 6483 Waldon
Center Drive, Clarkston, Michigan.

3. Report: Supervisor’s Update
a. Tentative Road Project Plans: Supervisor Kittle recently met with the Road Commission for Oakland
County and reported that tentatively 6 miles of road improvements are scheduled for 2019 (Clintonville
Road; South Sashabaw Road, Flemings Lake / Walters Roads and Eston) and 7 miles for 2020. (N.
Sashabaw Road and Waldon Road). Supervisor Kittle advise that this schedule is subject to change.
b. Board of Trustee Resignation: Supervisor Kittle reported that Trustee Schroeder will submit her
letter of resignation since being elected as the 43rd District State Representative at the November
6, 2018 General Election. He indicated that an ad soliciting applicants will appear in the November
28th and December 5th editions of the Clarkston News. Applications are due by 4:00 p.m. on December
12th. He further stated that the chairs of the Planning Commission, Zoning Board of Appeals, Senior
Community Center Advisory Committee in addition to Board of Trustee member Ron Ritchie will serve
on the selection committee. It is expected that their recommendation will be made to the Township
Board at their December 18th Regular Meeting.

CHARTER TOWNSHIP OF INDEPENDENCE
2019 General Appropriations Act
RESOLUTION NO. 2018-020
A resolution to establish a general appropriations act for Independence Township; to define the powers and
duties of the Independence Township officers in relation to the administration of the budget; and to provide
remedies for refusal or neglect to comply with the requirements of the resolution.
The Independence Township Board resolves:
SECTION 1: Title
This resolution shall be known as the Independence Township 2019 General Appropriations Act.
SECTION 2: Chief Administrative Officer
The Supervisor shall be the Chief Administrative Officer and shall perform the duties of the Chief
Administrative Officer enumerated in this act.
SECTION 3: Fiscal Officer
The Clerk shall be the Fiscal Officer and shall perform the duties of the Fiscal Officer enumerated in this
act.
SECTION 4: Public Hearing on the Budget
Pursuant to MCLA 42.26, notice of a public hearing on the proposed budget was published in a newspaper
of general circulation on October 31, 2018 and a public hearing on the proposed budget was held on
November 13, 2018.
SECTION 5: Millage Levy
The Independence Township Board shall cause to be levied and collected the general property tax on all
real and personal property within the Township upon the current tax roll an amount equal to 9.6770 mills as
authorized under state law and approved by the electorate, allocated as follows: Township operating millage
of 0.9800; Voter-authorized millages of 3.3972 mills for fire operating, 2.8678 mills for police operating,
0.4320 for safety path operating and 2.0000 for road infrastructure operating.
SECTION 6: Adoption of Budget by Cost Center
The Independence Township Board adopts the 2019 fiscal year budgets for the various funds by cost center.
Township officials responsible for the expenditures authorized in the budget may expend Township funds
up to, but not to exceed, the total appropriation authorized for each cost center, and may make transfers
among the various line items contained in the cost center appropriation, as stated in Section 7.

For all governmental funds except for the Fire Fund, no official shall make, or obligate the Township to pay
any expenditure in excess of $5,000 without prior approval from the Township Supervisor nor any
expenditure in excess of $10,000 without prior approval from the Township Board. For all enterprise funds and the Fire Fund, no official shall make, or obligate the Township to pay any
expenditure in excess of $10,000 without prior approval from the Township Supervisor nor any expenditure
in excess of $25,000 without prior approval from the Township Board.
SECTION 7: Transfer Authority
The Chief Administrative Officer shall have the authority to approve transfers within the various cost centers
without prior board approval, if the amount to be transferred does not exceed $10,000 for all funds. No
transfers shall be made to increase or decrease personnel or capital costs without prior approval from the
Township Board. Transfers shall not increase or decrease the total cost center appropriations.
SECTION 8: Appropriation not a Mandate to Spend
Appropriations will be deemed maximum authorizations to incur expenditures. The fiscal officer shall
exercise supervision and control to ensure that expenditures are within appropriations and shall not issue
any town order for expenditures that exceed appropriations.
SECTION 9: Limit on Obligations and Payments
No obligation shall be incurred against, and no payment shall be made from any appropriation account
unless there is a sufficient unencumbered balance in the appropriation and sufficient funds are or will be
available to meet obligations.
SECTION 10: Approval and Payment of Claims, Filing and Preservation of Accounts;
Authorized Payment
Pursuant to MCLA 41.75, the Independence Township Board shall approve claims (bills) against the
Township and authorize payment of allowed claims. Accounts approved by the Township Board shall be
filed and preserved by the Township Clerk. The payments authorized shall be paid by the Township
Treasurer, on the order of the Township Board, signed by the Township Clerk. The Township Clerk and
Treasurer may pay certain claims prior to approval by the Township Board to avoid late penalties and late
charges. The Township Board shall receive a list of paid claims (bills) prior to release for approval at the
next Board meeting.

SECTION 12: Budget Monitoring
Whenever it appears to the Chief Administrative Officer or the Township Board that the actual and probable
revenues in any fund will be less than the estimated revenues upon which appropriations from such fund
were based, and when it appears that expenditures will exceed an appropriation, the Chief Administrative
Officer shall present to the Township Board recommendations to prevent expenditures from exceeding
available revenues or appropriations for the fiscal year. Such recommendations shall include proposals for
reducing appropriations, increasing revenues or both.
SECTION 13: Periodic Financial Reports
The Chief Administrative Officer shall submit to the Township Board, on a monthly basis, data showing the
relation between the estimated and actual income and expenses to date; and if it shall appear that the
income is less than anticipated, the Township Board may reduce appropriations, except amounts required
for debt and interest charges, to such a degree as may be necessary to keep expenditures from exceeding
expected revenue/cash income.
SECTION 14: Violations of This Act
Any obligation incurred, or payment authorized in violation of this resolution shall be void and shall subject
any responsible official(s) or employee(s) to disciplinary action as outlined in PA 621 of 1978.
SECTION 15: Board Adoption

Service Amendment PY 2017 between Clarkston Area Youth Assistance and Charter Township of
Independence for the reimbursement of Community Development Block Grant Program Year 2017 remaining
funds in the amount of $5,092.54 (current contract expires December 31, 2018) and DIRECT the Supervisor
to sign the contract as an authorized representative of the Township. Seconded by Trustee Ritchie. VOTE:

RESOLUTION 2018-021
WHEREAS, The northern cities, villages, and townships in Oakland County are committed to protection
of the natural environment and preventing toxic materials from entering our waterways and landfill
resources.
WHEREAS, The improper handling and disposal of toxic and poisonous household chemicals also poses
a health risk to our citizens.
WHEREAS, Recognizing there is a need to provide regular and easily accessible household hazardous
waste collection services to North Oakland County residents.
WHEREAS, Collection events for household hazardous waste have become widely accepted as the best
way to provide citizens with a safe method of disposal of these toxic and poisonous household chemicals,
and for the communities to realize the economies of scale.
WHEREAS, Oakland County, through its Waste Resource Management Division, has joined these
northern Oakland County communities in creating the North Oakland Household Hazardous Waste
Consortium (NoHaz).
WHEREAS, The NoHaz Consortium has developed a household hazardous waste collection program.
WHEREAS, A NoHaz Interlocal Agreement has been drafted to address necessary legal, liability, and
responsibility issues for both the County and the participating communities, and identifies Oakland
County’s role in administering and managing the NoHaz program, and
WHEREAS, The NoHaz Interlocal agreement establishes a NoHaz advisory board to assist and advise
Oakland County in the development of the NoHaz program.
NOW THEREFORE BE IT RESOLVED, That our community, The Charter Township of Independence,
hereby approves the attached NoHaz Interlocal Agreement and authorizes its signature, and
BE IT FURTHER RESOLVED, That we will charge residents $10 to participate in NoHaz events in 2019,
and
BE IT FURTHER RESOLVED, That we hereby appoint David McKee, DPW Director as our official
representative to the NoHaz Advisory Board, to work with the Oakland County Waste Resource
Management Division as needed to plan the NoHaz program for 2019.
