Page 1 of 4 LAKE ANGELUS CITY COUNCIL MINUTES December 11, 2018 Present: Mayor, Patrick McNew; Mayor Protem, Dennis Mitchell; Council members, Joe Hilger, Dan Jenaras, Gary Parlove; Treasurer Julie Frakes; Attorney Charles Kennedy III; LAPD, Chief Farley; Building Official, John Jackson; Clerk, Lee McNew; Absent: None Visitors, Residents: Jim Kinsler, Sarah Razzaque, Leslie DeSimone, Heidi Hoyles, Rosalie Lake, Jim Cortez, Peggy Kresge Visitors, Non-Residents: none Mayor McNew opened the meeting at 7:00 p.m. with the Pledge of Allegiance. Dennis Mitchell moved to approve the November 11, 2018 minutes as corrected. Gary Parlove seconded and the motion passed unanimously. Resident/Mayoral Comments/Pending Actions: -Leslie DeSimone and Heidi Hoyles presented 4 round tables and 32 chairs with a rack for storage as a $1468 gift to the City for the use in the barn. The gift is from the Women’s Club and is the first part of a planned total $2000 gift for lake projects from the Women’s Club -The lame duck session of the State Senate is of great concern regarding the seaplane bills 626/27. -Dennis Mitchell proposed the adoption of the NOHaz Interlocal agreement resolution also appointing Gretchen Hurbert as the Lake Angelus official representative to the NOHaz Advisory Board. Dan Jenaras seconded the motion and it passed unanimously. - Attorney Kennedy proposed a regulatory ordinance be adopted prohibiting marihuana establishments in the City of Lake Angelus. It is necessary for the City to opt out. A zoning ordinance will also need to be passed and will go to the Planning Commission at a public hearing on December 18th. Dennis Mitchell moved to approve an ordinance to amend the code of ordinances of the City of Lake Angelus to prohibit marihuana establishments and prohibit the public consumption of marihuana (ordinance # 146). Gary Parlove seconded the motion and it passed unanimously. - The Lake Angelus Police Department needs to have the Council approve the resolution for the Adoption of the Oakland County Hazard Mitigation Plan. Dennis Mitchell moved to adopt the resolution for the Oakland County Hazard Mitigation Plan. Joe Hilger seconded and the motion passed unanimously. - Assessor Kim Harper submitted the County recommended poverty exemption guidelines for 2019. Dennis Mitchell moved to adopt the 2019 Oakland County exemption guidelines. Dan Jenaras seconded and the motion passed unanimously. - It was recommended to reappoint Lee Embrey III to the Board of Review for the term from 2019-2021. Treasurer Frakes reported that we have been receiving road funds based on population for 67 years, since 1951. We use the funds on North Lake Angelus Road, berm Maintenance on Baldwin Rd, and Gallogly Rd. We use for gravel and chloriding as needed. In 2017-2018 we received $19,000 based on population from the state. MDOT wishes to withhold 2018-2019 funding. The city is working with the Road Commission of Oakland County and MDOT to resolve the problem. Page 2 of 4 Lake Angelus Police Department November 2018 Report: Chief Farley reported that officers are using the Oakland County Sheriff Department’s gun range for qualifications. He is reviewing applications for officers. Marine training will be needed in the future. Building Checks – 39 Boats launced/retrieved– 14 Dam inspection – Lake level 950.2, higher than usual Burglar Alarms – 4 Suspicious circumstance/person –3, encourage residents to report these to LAPD Ordinance violation – 1 Assist other law enforcement agency -3 Traffic complaint/Road Hazard – 3 Assist Fire Department - 1 Open Building – 1 Found Property – 1 Welfare Check - 1 Building and Permits: McKenna Associates/John Jackson/Brian Keesey Report from Brian Keesey, November 19 to November 30, 2018 New Building and Zoning Applications  A building permit was issued for a pavilion renovation at 2295 N. Lake Angelus Road. This project was initiated without review, and the permit and plans were submitted upon request. Ongoing Building and Zoning Activity 385 Gray Woods Lane – Ahlgren Residence Work is continuing as expected. 2360 Lake Angelus Lane – Matisse Residence Progress continues as expected. 2370 Lake Angelus Lane – Hemphill Residence Building plans are still under review and a permit will be issued when Building Official approval is granted. 2405 N Lake Angelus Road – Johnson Property We have confirmed a required grade change by Oakland County and have issued final site plan approval for the project. The site plan has been completed. 2445 N Lake Angelus Road – Fair Residence Progress continues as expected. 2485 N Lake Angelus Road – Former Mrsan Residence It came to our attention this week there was a dumpster located outside the home. The Building Official and Administrator are working with the homeowner to determine whether demolition plans and permits are required. It is our understanding that the new owner of the property intends to remove the existing structure and build new. 1165 N Lake Angelus Road - Staircase No changes have been noted. 2204 Lake Angelus Shores – Roth Residence Final C of O was issued on November 15th. There are no outstanding site plan compliance issues to address. Administrative Approvals- We have not issued administrative approvals during this reporting period. General Activity and Open Planning Items 1. Planning Commission heard input from the public this week on the Lakeside setback ordinance draft, and will incorporate feedback as appropriate. McKenna will be preparing map updates noted from the public and at the request of the Planning Commission. 2. Planning Commission set a date of December 18th to hold a public hearing on proposed language to prohibit commercial medical marijuana operations in the City. 3. Zoning Ordinance amendments for dock regulations, lot coverage maximums, and existing home dimension regulations have been drafted and will be on a future Planning Commission agenda. 4. We are still anticipating new applications in the near future for new builds/renovations at the following addresses: a. 681 Gray Woods Lane – new home b. 742 Lake Angelus Shores – new home c. 2485 N Lake Angelus Road – new home Page 3 of 4 The following items require additional follow-up or may be discussed for future consideration: a. Fee schedule update – Analysis ongoing b. Lighting Standards c. Noise nuisances d. Nonconforming Structure Ordinance – PC request to review this section of the ordinance e. Chapter 1220 – outdated Michigan Planning and Zoning act references. Will be addressed concurrently with other amendments because they do not require significant discussion. f. Short-term rental regulations g. Environmental quality considerations – potential amendments to consider to ensure water quality is maintained at a high level Planning Commission/Fire Committee – Gary Parlove -The Planning Commission meeting went over time one hour. More work needs to be done on the lakeside setbacks, maybe a cooling off period, and continued discussion. The wish is to preserve the beauty of Lake Angelus, our green terrain and the prevention of new houses moving closer to the lake and disturbing the natural beauty. -Jim Kinsler presented a letter with his requests for studies to support the justification for a new lake setback ordinance. Studies showing that houses are moving closer to the lake. He encourages attendance at the December 18 Planning Commission meeting. Dennis Mitchell moved to extend the meeting by 45 minutes to 9:45 p.m. Joe Hilger seconded and the motion passed unanimously. -The frame of the Lake Angelus firetruck is rusted. Waterford Fire is required to maintain the firetruck and instead are proposing an extension of the current contract and a new firetruck a part of the negotiation. Waterford Fire Department and Lake Angelus seemed to have reached a stalemate. Attorney Kennedy will draft a letter to Waterford Fire Department regarding their legal obligation. Clerk Report 1. From the Administrative Calendar for December and January as needed a. Publish in Angelus Remember no snowmobiles or all-terrain vehicles on the ice surface of Lake Angelus or on City property. (This ordinance needs to be rewritten) b. For January a reminder - All members of Council, the Treasurer, and Clerk submit a list of their duties and a list of their contacts so there is an historical reference available for new persons if needed. 2. Need approval for renewal of Clinton River Watershed Council membership for $500. Dennis might want to ask if any of his Environmental Board would like to become active in the Council. They help support water quality and natural resources in the watershed communities. Dennis Mitchell moved to approve renewal of the Clinton River Watershed Council membership for $500. Gary Parlove seconded and the motion passed unanimously. 3. Note the next Planning Commission meeting is the 3rd Tuesday of the month in December, December 18. 4. There is a public hearing at the next Planning Commission meeting on Tuesday, December 18, 2018 at 7 p.m. CITY OF LAKE ANGELUS, MICHIGAN PLANNING COMMISSION NOTICE OF PUBLIC HEARING The City of Lake Angelus Planning Commission will hold a Public Hearing at the Lake Angelus City Hall, 45 Gallogly Rd, Lake Angelus MI, 48326¸ on Tuesday, December 18, 2018 at 7 PM. The purpose of the Public Hearing is to consider a Zoning Ordinance amendment which will prohibit marihuana establishments under the Michigan Regulation and Taxation of Marihuana Act.The Public Hearing is being held pursuant to the City of Lake Angelus Zoning Ordinance and the Michigan Zoning Enabling Act, Act 110 of 2006, as amended. Interested parties are welcome to attend the Public Hearing and offer comments. Written comments will be accepted prior to the date and time of the Public Hearing by the City Clerk, 45 Gallogly Rd, Lake Angelus MI, 48326. They have been most responsive to our needs. Environmental Board – Dennis Mitchell There will be a meeting Wednesday, January 23, 2019. Fireworks – Dennis Mitchell The present fireworks contract runs through 2019. Some residents have asked to donate to the 2019 fireworks to keep the level of fireworks up to the level of last year (a make up for the 2017 problem).
