BRIEF PUBLIC COMMENTS/AGENDA ITEMS ONLY (limit comments to 3 minutes each item): Bill Chatfield, Resident, Mallards Landing Private Road, Chairman of Lake Braemar management committee/volunteers (elected by SAD members). There is a process in place for the management of the lake, guidelines/expectations. Attempts have been made to put legal restrictions on the lake and it was determined not in the best interest of the lake residents to do so. Would like to make sure that marketing/promotion of the Mallards Landing lots do not indicate the lake as “All Sports”, it is a low impact, recreational lake (non-sports). Asking that the Board take these facts into consideration when making their “approval”. Unidentified Resident/Vice-President of “Association” asks how much money is in the performance bond. Board response $100,000.00. Resident confirms that any Mallards Landing residents will be included in the special land use. Jim Walters, Resident, lives on Tamryn Blvd. and thanks the Board for stipulating that the extension will not extend all the way to Parker Road. Resident reminds the Board that the lake has not been used as all-sports. Would like to entertain meeting with Mallards’ Landing representatives to discuss existing guidelines/restrictions in order to develop a harmonious relationship from the onset. UNFINISHED BUSINESS: A. Beebe Cemetery Fence Rose Township Cemetery Committee wishes to accept the low bid of Milford Fence in the amount of $27,948.00. The board will allocate $32,000.00 into the budget for July 1 Fiscal Year 2020. Moved by Scheib-Snider, seconded by Blaska, motion carried to award Milford Fence the bid, $32,000.00 to be allocated into the budget for July 1/Fiscal year 2020. Recreational Marijuana Business Establishment Opt-Out Ordinance Moved by Noble, seconded by Gambka, motion carried to approve ordinance as corrected. Clerk’s Election Specialist/Deputy Clerk – Clarification of Wages and Hours Board discusses Election Specialist position, concerned that the salary is more than current deputy positions. Miller explains that the current deputies receive benefits and this person is part-time with no benefits, the position is necessary and specialized. {00304180} Page 3 ROSE TOWNSHIP BOARD OF 5.8.2019 NEW BUSINESS: A. Private Road Mallards Landing at Lake Braemar Larry Rivington discusses past crime at Lake Braemar and road extension. Overall site plan submitted, showing extension, wet land impact, cul de sac added, including an “eyebrow” to accommodate turnaround in the middle. Dry hydrants. No intention of promoting this as all sports lake sites, promoting as large lots with some waterfront. Wants the best for the lake and would consider participating in any lake boards. Requesting that the road extension be approved. Moved by Noble, seconded by Gambka, motion carried to approve preliminary drawings titled Mallards Landing at Lake Braemar, drawings sheet 1-9, dated 2/15/2019, as recommended by the Rose Township Planning Commission with the following conditions: Planning Commission meeting, March 7, 2019: 1. A 66’ right of way; 2. $100,000.00 Performance bond for replacement of the ‘existing Tamryn Blvd. pavement damaged from Mallards at Lake Braemar private road construction. Damage/replacement of existing Tamryn Blvd. surface to be determined by Township Engineer based on commercial videotaping of pre and post construction; Delete/remove a notation on the plans “10x930 private easement for future road connection to private road known as Appomattox Rd. to be dedicated to the Township” from all drawings. 2. Rose Township Code: Land Division and Development, Division 4-6 Private Roads: Permits; construction and environmental; private road performance guarantee; competition bond amount by Township Engineer; maintenance agreements for private road and ‘onsite water systems; NOCFA well; private road easement sand other easement noted on the drawings. 3. Fireworks Permit for Lake Braemar Moved by Noble, seconded by Scheib-Snider, motion carried to approve the fireworks permit application. Regulate Peddling and Solicitation Ordinance Correct error, should read “The license shall not be issued for a period of time in excess of one (1) month” Moved by Scheib-Snider, seconded by Blaska, motion carried to hold a public hearing and consider adoption of ordinance at July 2019 meeting. Residential applications will fall under jurisdiction of the building department. Moved by Noble, seconded by Scheib-Snider, motion carried to adopt the solar energy systems ordinance resolution as developed by the Planning Commission. ROSE TOWNSHIP BOARD OF TRUSTEES 2019-05 RESOLUTION To Adopt Solar Energy Systems Ordinance WHEREAS, the Rose Township Planning Commission has prepared an amended ordinance to the Township Zoning Ordinance to include Solar Energy Systems; and WHEREAS, Rose Township Planning Commission has caused a notice of public hearing to be published in a newspaper of general circulation throughout the township; and WHEREAS, in accordance with the Michigan Planning Enabling Act, the Planning Commission held a public hearing on April 4th, 2019 to receive comments from the public; and WHEREAS, the Rose Township Planning Commission on April 4th, 2019 approved the amended Zoning Ordinance to include Solar Energy Systems; and WHEREAS, the Rose Township Board has determined that the amended Zoning Ordinance to include Solar Energy Systems has addressed the concerns and issued that had made the previous Zoning Ordnance lacking in its direction in regards to Solar Energy Systems; NOW, THEREFORE BE IT RESOLVED, that the Rose Township Board of Trustees hereby adopts the Rose Township amended Zoning Ordinance to include Solar Energy Systems as presented at the regular Township Board meeting of May 8th, 2019. Property Maintenance Code Ordinance Amendment Moved by Noble, seconded by Blaska, motion carried to adopt the amended Property Maintenance Code Ordinance. ROSE TOWNSHIP BOARD OF TRUSTEES 2019-06 RESOLUTION To Adopt Amended Property Maintenance Code Ordinance WHEREAS, the Rose Township Planning Commission has prepared an update to the Township Property Maintenance Code Ordinance; and WHEREAS, Rose Township Planning Commission has caused a notice of public hearing to be published in a newspaper of general circulation throughout the township; and WHEREAS, in accordance with the Michigan Planning Enabling Act, the Planning Commission held a public hearing on April 4th, 2019 to receive comments from the public; and WHEREAS, the Rose Township Planning Commission on April 4th, 2019 approved the amended Property Maintenance Code; and WHEREAS, the Rose Township Board has determined that the amended Property Maintenance Code Ordinance has addressed the concerns and issued that had made the previous Property Maintenance Code Ordnance antiquated; NOW, THEREFORE BE IT RESOLVED, that the Rose Township Board of Trustees hereby adopts the Rose Township amended Property Maintenance Code Ordinance as presented at the regular Township Board meeting of May 8th, 2019. Treasurer – Michigan State University Federal Credit Union Depository Approval Gambka is seeking Board approval to open an account in order to purchase CD’s on behalf of the Township. Moved by Noble, seconded by Scheib-Snider, motion carried to approve the Treasurer opening an account at Michigan State University Federal Credit Union. Assessing Services Contract Moved by Noble, seconded by Blaska, motion carried to approve the Oakland County Assessing Contract. House Bill 4095 Update This House Bill, if enacted, would amend the Michigan Zoning Enabling Act to allow 7 to 10 individuals to receive 24-hour care at a state licensed residential facility, as long as it is located on a parcel of at least 20 acres and a minimum of 1 mile aware from another licensed facility. It would preempt local zoning authority. Scheib-Snider states residents should contact their representatives as it greatly affects the Township in the future. K. Supervisor to Enter into Agreement for Property Line Adjustment. Noble states a review of the survey has discovered several encroachments that are being investigated and remedied. Moved by Noble, seconded by Gambka, motion carried to authorize Supervisor to negotiate and proceed with the agreement for the transfer of property pieces due to encroachment by the Township and by the property owner. Noble compliments the tabling of pension matter due to cost to taxpayers. B. Planning Commission – None. C. Holly Area Youth Assistance (HAYA) – Car shows in Holly every Wednesday, 5:30 p.m. – 8:30 p.m., popcorn sales. D. Cemetery Committee – Made fence selection. E. Parks and Recreation – None. F. Heritage Committee – Planning 2019-2020 events, bicentennial events partnering with Oakland County. G. Supervisor’s Report – Native plant sale, Headwaters 10-4. Received scholarship for grant management courses (grant writing courses, part 2). Attended meeting with OCRC regarding the issues with re-surface on Milford Road, Davisburg Road, discussed approach at Munger (possible spring issue). Engineers have been out to investigate. Grading and chloride applications began. Fire Department has free of charge carbon monoxide detectors for residents, they will install. Township should have ownership. Gisela Lendle King, Resident, Consumers Energy has proposed construction of a building, lighting solutions discussed, sky darkening lighting. Concerned as to the brightness caused by LED lights. Asks the board to consider the impact and how it would light up the sky.
