Voice Vote: Ayes: Unanimous Nays: None MOTION APPROVED APPROVAL OF AGENDA Supervisor Dolan noted Feldman Auto Body Shop is removed from the agenda at the applicant’s request. He would like to move the approval for the Sheriff Radar item to the top of the agenda and add the 11 Mile Pathway discussion to the end of the agenda. Voice Vote: Ayes: Unanimous Nays: None MOTION APPROVED ANNOUNCEMENTS & COMMUNICATIONS Jennifer Redford – She is the founder of South Lyon History and Ghost Tours. She announced that she would like to do a Lyon Township historical tour. Proposing to do this on September 20, 2019, Friday, from 6 p.m. to 8 p.m. With the success of the South Lyon tour, they did it from May-September and had about 200 people who attended. This year so far, they have had about 80 people. Judge Travis Reeds and Judge David Law provided a brief overview of their duties and explained they like to keep the lines of communication open. They see about 45-50,000 cases a year including civil and criminal cases. They are also the only court that can marry people. They both spoke about the Consequences of Decision-Making Program which can be brought to the high school and middle schools and can be very impactful. Supervisor Dolan noted he would like to see that program happen in the area schools. CALL TO THE PUBLIC Tony Verbiscus, 21855 Currie Road - He provided a petition since the road is going to be paved, concerning the speed limit on Currie Road. The petition shows what the residents want for the speed limit and they would like no passing signs and a bike lane. In the worst case they would like the road to be reclassified to follow that of Wixom Road which is a major road through a residential district. Paul Vandenheede, 23727 Pointe O’Woods Court – Lyon Township has seen transformational development in the last 10 years. The elected official’s job is to protect the citizens’ rights and their property. Several years ago, the speed limit went from 25 to 55 mph overnight. This is a completely residential road. Heavy trucks and heavy vehicles have increased. This starts at 5:30 a.m. 6 days per week and goes on till 7:30 p.m. There are tanker trucks running up and down Currie. He explained it takes 6 seconds to stop. Oakland County Sheriff agrees with them, it’s a dirt road. He respectfully asked to disallow heavy commercial traffic on Currie Road, it’s 100% residential, he suggested rerouting around the Township. Napier Road has 6 owner occupied houses on it, take the commercial traffic there. Drop the speed limit to 35 mph. Charter Township of Lyon Board of Trustees August 5, 2019 Page 3 Ed Leslie, 23001 Currie Road – He asked how soon will the road be paved. Supervisor Dolan thought the end of 2021. He also asked why the speed limit is so fast. Supervisor Dolan explained the State sets the speed limit. Mr. Leslie stated 55 mph is much too fast for this dirt road. Emily Davis, 22000 Currie Road – She explained she has 5 children and they are asking for the speed limit to be lowered, they just don’t feel safe. Ms. Zawada explained that it’s set by State law at 55 mph, the only way to change it is to request a speed study. Ms. Davis is asking for that study to be done now. Ms. Zawada stated it is a public road and she hasn’t heard of an example of moving truck traffic. Ms. Zawada stated the Township can request a speed study. Ms. Davis stated they haven’t gotten answers from the Oakland County Road Commission and they have put their home on the market because they don’t feel safe on Currie Road. They have a hard time getting their mail. She would like it lowered immediately and she requested the Township request a speed study. Ms. Zawada stated she can request it but she can’t guarantee that it will be done while it’s a gravel road. Paul Vandenheede 23727 Pointe O’Woods Court – He has spoken to a number of people at Oakland County and one of them said there is one township that did lower the speed limit on their dirt roads. The Road Commission might own the roads, but the Township represents the citizens. Elwood Metzler, 55290 Autumn Ridge Dr. – He explained he has a unique property on Autumn Ridge Drive that has 3 houses on it. It’s a challenge for him to go left or right, it’s a very dangerous road. He questioned what about stop signs, since there are 5 different intersections. He will pay for the stop sign at Autumn Ridge Drive going both ways. He questioned using a round about. He asked if there will be a cost to the homeowners. Supervisor Dolan stated only if they want a bike path. REPORTS DDA – Ms. Archer provided status updates of the businesses in the DDA. She also announced some new business’s that have opened or are opening in the future. FIRE – Chief Van Sparrentak reported that they have the Lucas 3 Machine, one at each rescue. They had their first save using this CPR machine. The patient is now in stable condition and doing great. The 3 firefighters were commended for their work; Kelly Blades, Allen Clymer and Miranda Andrews. SHERIFF – None PLANNING COMMISSION – Treasurer Carcone brought the Board up to date regarding the last Planning Commission’s meetings. ZBA – Trustee Blades provided an update regarding the last ZBA meeting. PARK ADVISORY BOARD – Mr. Swain provided an update regarding the last Park Advisory meeting. Recommending the replacement and relocation of the disc golf fee box. The items were discussed for capital improvement plan. Charter Township of Lyon Board of Trustees August 5, 2019 Page 4 DPW – Mr. Martin reported they are in the midst of highest usage of water right now and it’s monitored every day. They just completed copper and lead testing for 20 homes in the Township and reported to the DEQ and every home passed with flying colors. UNFINISHED BUSINESS A. Artesian of Pioneer Water Discussion Mr. Martin explained they are moving quickly at the South Hill treatment plant. There is a crew there every day working, all the walls and ceiling will be up by the end of the month, ready to go online by end of the year. The tower should be completed in the fall. He commented how much they appreciated the cooperation from the residents in the Township. Trustee Enlow inquired about the softening. Supervisor Dolan confirmed Mr. Kidston is still working on the softening component but has some hurtles to overcome. B. Consideration of the adoption of an Amendatory Ordinance 10-19 for the Charter Township of Lyon of a Final Review for Aspen Trails (Formerly known as Aspen Gate) Planned Development; AP-17-40 Mr. Keesey explained nothing has changed. Trustee Blades commented that she appreciated Mr. Elkow’s work with the neighboring parcels. Motion by Carcone, second by Hicks To approve AP-17-40 Final review for Aspen Trails, formerly known as Aspen Gate, Planned Development. Voice Vote: Ayes: Unanimous Nays: None MOTION APPROVED C. Consideration of the adoption of an Ordinance 08-19 for the Charter Township of Lyon to replace in its entirety Chapter 32, Peddlers, Canvassers & Solicitors, & Adopt a New Chapter 32, Peddlers, Solicitors & Canvassers, to regulate Peddlers, Solicitors & Canvassers; & to provide Penalties for Violation thereof. Consideration of the Adoption of an Amendatory Ordinance 09-19 for the Charter Township of Zoning Ordinance Text Amendment on Swimming Pools; AP19-16. Motion by Blades, second by Hicks To approve AP-19-16 Zoning Ordinance Text Amendment on Swimming Pools, Ordinance Number 09-19. Voice Vote: Ayes: Unanimous Nays: None MOTION APPROVED NEW BUSINESS A. Approval of the Sheriff’s Radar and Speed Detection Device Sargent Whitfield provided quotes for a full mounted graphic display sign and said it’s a good tool to use as a deterrent and direct enforcement efforts. There was also a proposal for a hand-held speed measurement device. Both of these will be very useful tools. The hand-held speed measurement device will cost $2,386.00 and the pole mounted speed sign will cost $3,516.00. Motion by O’Neil, second by Blades To approve both items in the amount not to exceed $6,000.00. Voice Vote: Ayes: Unanimous Nays: None MOTION APPROVED B. Local Government Approval for Teresita Mexican Grill Resort License Ms. Archer explained the owners have expanded the restaurant into the suite next to them, and the change will include both addresses. Request is the resolution reflecting both addresses for the resort license Charter Township of Lyon Board of Trustees August 5, 2019 Page 6 Motion by Cash, second by Hicks To approve resolution for the local Government Approval for Teresita Mexican Grill for the new Class C License be issued under MCL 436.1531(3) to be located at 56300 and 56310 Grand River, New Hudson, MI 48165. Approval of Installment Agreement for Sanitary Sewer Connection Treasurer Carcone felt 15 years was very reasonable and 3% interest is reasonable. She explained she would like to waive the administration fee as well. Motion by O’Neil, second by Carcone To approve the Installment Agreement for Sanitary Sewer Connection between Charter Township of Lyon and Lake Angela Co-Op #6 and the recommendation is for no administrative fee. Voice Vote: Ayes: Unanimous Nays: None MOTION APPROVED D. Sterling Trail (formerly known as Belmont Park) – Special Land Use for an Average Lot Size Residential Development in the R-0.5 District; AP-19-11b Mr. Keesey reviewed the McKenna memo dated June 24, 2019. The Planning Commission recognized the Average Lot Size Development as appropriate in development character for the location and zoning, and subsequently approved the site plan and recommended approval of the special land use. They support this recommendation, finding this development is appropriate in scope for the area and that it meets the standards of special land use approval. Therefore, they recommend the Township Board approve the special land use for an average lot size development in the R-0.5 Zoning District. Trustee O’Neil questioned the parallel plan and its ability to show wetland and overall density. He stated there are 7 lots that are encumbered by wetlands so how do they modify that with the density. Trustee Enlow explained Trotters Point has a boardwalk that extends to the property limits and he wanted to know if there is connection to this boardwalk. Ms. Zawada Charter Township of Lyon Board of Trustees August 5, 2019 Page 7 explained the Planning Commission required connection to the limit of this project not a connection into the City of South Lyon. Trustee Enlow noticed the Boardwalk is not shown on the survey. Treasurer Carcone explained it didn’t go to the north property line at Trotters Point but the Planning Commission did request it to the end of their property Ms. Zawada reviewed the CES memo dated June 25, 2019. She noted the Township Engineering Standards require perimeter watermain extended across the entire frontage of proposed developments. Since there is no Township land to be serviced in the future, they would have no objection to the Township Board waiving this requirement. Mr. Windingland explained they are asking for Special Land Use Approval for Sterling Trail. He provided a power point presentation of the proposed development. He introduced Mr. Pat Keast from Seiber, Keast Engineering. They can extend the water main to the south if the Board wanted that. He did not know what South Lyon’s intention would be. Mr. Windingland stated the parallel plan was not required, for what they are pursuing, it wasn’t something required. Trustee Blades stated it’s important to know we have the right density, she agreed they need to know the density for sure and she didn’t want wetlands to be overlooked in that calculation. Trustee O’Neil stated he didn’t know how they achieve the average lot size plan without a parallel plan. Mr. Windingland stated it seems unfair for him to have gone through consultant review and Planning Commission and gotten their approval on the site plan and then take a step back and provide something that may not be required by ordinance. Mr. Keast explained when they looked at this and it does say under the average lot size. In Article 7 it describes that the parallel plan shall reflect a realistic assessment of wetland use and consider the restraints imposed by MDEQ and the fact that 6,000 square feet is not regulated, they did not count that. They counted the remaining 3.5 acres. The part they filled was 12,000 which is well under the 17,000 that’s permitted. So, the non-regulated wetland was not included. Trustee O’Neil stated if this wasn’t something that was called out in previous reviews then he would question the fairness of pushing it now, if they have some housekeeping to do then they do. Trustee Enlow questioned the boardwalk, and why it’s not on the survey and if there is a possibility to have a connection. It looks like it’s right on the northern border. If it abutted their property line, they would have no choice. Mr. Windingland stated the boardwalk is private property to Trotters Point and it’s in disrepair, he does not have the easement ability to connect to it. Treasurer Carcone explained the Planning Commission discussed this and they all felt it could be a grant opportunity to get the connection and work with the City of South Lyon. Trustee Blades stated she is pleased they spoke with the neighbors and addressed their concerns. She questioned if the project is meeting the intent of the Zoning Ordinance. The site has a grid layout which is clustered, she does not see the originality Charter Township of Lyon Board of Trustees August 5, 2019 Page 8 in the site design. She did not think there is much usable open space, or recreation areas. She did not see a scenic vista. She is concerned with connectivity and is not sure something this size would be a lot of cut through traffic, but she doesn’t know. South Lyon is to the south, and if they are not going to provide the perimeter water main across the entire frontage, she requested that a financial contribution in that amount or slightly less to the sidewalk or pathway fund would be more of a benefit. Mr. Windingland stated he would be willing to make that contribution. Trustee O’Neil felt it is appropriate to put a condition that if the boardwalk reaches their property line then it should be connected. Mr. Windingland stated he is not obligated to pursue easements in another city or subdivision seems difficult. If the boardwalk reaches their property line, then he has no objection. Motion by Dolan, second by Carcone To approve and attach the boardwalk if it’s close enough. Waive the ordinance requirement to run the water main along the entire frontage and make a contribution in the Township’s sidewalk fund in lieu of the extension of the water main in the amount to be determined by the Township Engineer. The water main is being waived because it does not lead to any other communities and it serves no viable purpose. Action Sports & Community Center- Special Land Use; AP-18-69b Mr. Keesey reviewed the July 25, 2019 McKenna memo. He explained they anticipate the proposed recreation use to be less impactful than many other types of industrial occupants that could potentially move into the facility. The proposed uses are supported by the Master Plan Future Land Use Map and should provide desired amenities for the community. The Planning Commission has recommended approval of the special land use and has approved the site plan. They suggested for special land use for indoor recreation, subject to the following conditions: 1. The fire suppression and other public safety concerns of the Building Official and Fire Marshal be addressed to the satisfaction of those officials prior to occupancy. 2. That indoor archery activities be excluded from the approved indoor recreation land uses or require additional review by the Township Board if it is proposed in the future. Charter Township of Lyon Board of Trustees August 5, 2019 Page 9 Mr. Keesey confirmed they are not proposing indoor archery. Ms. Zawada reviewed the CES memo dated July 26, 2019. There are a few water main items but nothing significant. The applicant did submit first round of engineering plans this week. There are a couple of items to address on the plans and then those will be forwarded to DEQ. Supervisor Dolan noted he did not think anyone on the Board is against this use but they are concerned about the safety of the building. Scott Duncan 1276 Buckboard Circle, owner. He agreed safety is good. Supervisor Dolan would like to know if they will get this building fire suppressed. Mr. Duncan stated yes, they are 100%. Mr. Duncan stated the amount of time it takes to get it suppressed can vary to about 3 months. Ms. Zawada stated permitting alone would take about 6 weeks and an EGLE 399 permit is required by State law before they can install the water main. Trustee Blades confirmed there will be a connection to Township water. What would the capacity limit be for this project? Mr. Duncan stated he wasn’t sure what drives that, that is a requirement the Township determines. The hours of operation are 6:00 a.m. to 10 p.m. but that is based on what types of classes come in. There was brief discussion as to the timeline of when Mr. Duncan was made aware that fire suppression is required. Ms. Rosati and Mr. Duncan agreed that the building has to be fire suppressed. Supervisor Dolan suggested a conditional special land use giving them 6 months to fire suppress the building but they can’t have any business going on until it’s a safe building and its fire suppressed. Mr. Duncan felt it was an acceptable solution. Trustee O’Neil asked if there is another temporary measure that can be done so business can continue. If the applicant, Building Official and Fire Chief arrive at some temporary solution, encourage them to have a discussion, occupy the building with certain conditions, if it can then it can and if it can’t then it can’t. Trustee Blades stated she is not in support of having any occupancy until it meets the code. Ms. Rosati stated it doubles the time they think it will take them and if after 6 months it’s not done then the Township could revoke the special land use. Motion by O’Neil, second by Blades To approve the Action Sports & Community Center – Special Land Use; AP- Charter Township of Lyon Board of Trustees August 5, 2019 Page 10 18-69b subject to Planning Commission action to the McKenna memo dated July 25, 2019 and the CES memo dated July 26, 2019 subject to there being no archery activities without amended approval or firearms or shooting activities without further approval. Fire suppression and other public safety concerns are addressed and approved by the Building Official and Fire Marshall prior to occupancy and subject to completion within 6 months and have a status review. Update on Status of 11 Mile Park Ms. Zawada explained after the requirement received from EGLE (DEQ) for conducting the hydraulic analysis on Novi-Lyon Drain and Blackwood Drain, CES provided the Township with the proposal received from Spicer Group for Hydraulic Analysis which was approved by the Township Board on March 20, 2019. Phase 1 is very expensive. There was discussion about using the funds for things that are more universally needed such as pathways. There was also discussion about placing the donated play structure on another site. Mr. Keesey stated it’s an honest conversation they will have to have with the donor. Supervisor Dolan suggested putting this project on hold and talk to the donors and bring it back. Motion by O’Neil, second by Blades To table further discussion on 11 Mile Park until the September meeting. Voice Vote: Ayes: Unanimous Nays: None MOTION APPROVED H. Full-time Fire Department Staffing Proposal Chief Van Sparrentak explained the process for establishing the eligibility list to fulfill 4 full time positions and he noted the applications will be sent to Clerk Cash. There was discussion regarding the stipend for the interview panel and the Captain’s test. Charter Township of Lyon Board of Trustees August 5, 2019 Page 11 Motion by Carcone, second by O’Neil To approve the full-time staffing proposal presented by Chief Van Sparrentak with Items 1, 2 and 3 approved. Replacement of Furnace/AC System for Station 1 Training Room Chief Van Sparrentak explained the HVAC in Station One training room is loud, not energy efficient, and in need of replacement due to normal wear and tear. They received 3 quotes with three different approaches to replace the training room HVAC. The best quote is to work with CJB Mechanical for the cost of $11,819.00. The other two quotes were in excess of $30,000. This repair was approved for the 2019 budget estimated at $35,000. The request will come from Capital Outlay. Motion by Blades, second by Carcone To approve the replacement of furnace/AC system for Station 1 Training Room. Voice Vote: Ayes: Unanimous Nays: None MOTION APPROVED J. Consideration of Watershed Sign Installation to comply with Township MS4 Permit. Motion by O’Neil, second by Carcone To approve the watershed sign installation to comply with Township MS4 Permit. Approval to Move the November 4, 2019 Board of Trustees Meeting to Thursday, November 7, 2019 due to a November election. Motion by Blades, second by Carcone To move the Board meeting to Wednesday, November 6, 2019 due to the Charter Township of Lyon Board of Trustees August 5, 2019 Page 12 election instead of Thursday. Voice Vote: Ayes: Unanimous Nays: None MOTION APPROVED L. Approval of Contract between Oakland County Equalization & the Charter Township of Lyon. Motion by Cash, second by Blades To approve the contract between Oakland County Equalization & the Charter Township of Lyon for years beginning July 2019 to July 1, 2022. Voice Vote: Ayes: Unanimous Nays: None MOTION APPROVED M. Discussion 11 Mile Pathway Ms. Zawada explained with all the rain, the sub-base is wet and she expected some under cuts on this section will be necessary, otherwise the path will be wavy. She wanted to bring this up to them, if the entire section needed a foot undercut that would be 10k in addition to the cost to the project and it’s affecting the residents that live there. Motion by Blades, second by Hicks To approve the change order not to exceed $15,000. Charter Township of Lyon, Oakland County Circuit Case No. 2018-168390-CZ in accordance with the Open Meeting Act, MCL 15.268(e), as an open meeting would have a detrimental financial effect on the litigation or settlement position of the Township.
