Roll called. PRESENT: Gershenson, Gingell, Hoffman, Jackson, Kochenderfer, Kowall, Kuhn, Long, Luebs, Markham, McGillivray, Middleton, Miller, Nelson, Powell, Quarles, Spisz, Taub, Weipert, Woodward, Zack. (21) EXCUSED ABSENCE WITH NOTICE: None. (0) Quorum present. Invocation given by Janet Jackson. Moved by McGillivray seconded by Luebs the minutes of the April 13, 2020 Board Meeting be approved. A sufficient majority having voted in favor, the minutes were approved as printed. Moved by McGillivray seconded by Jackson the agenda be approved as presented. Discussion followed. April 29, 2020 177 Lisa Brown, Oakland County Clerk/Register of Deeds addressed the Board to read a communication from David Woodward, Chairperson, Oakland County Board of Commissioners stating that he has used the authority granted under the provisions Rules of the Board, Section IX.H.(1) to approve the grant application for the State of Michigan Public Assistance Grant Program submitted by the Oakland County Health and Human Services Department/Homeland Security Division. Lisa Brown, Oakland County Clerk/Register of Deeds addressed the Board to read a communication from David Woodward, Chairperson, Oakland County Board of Commissioners appointing Tameka Ramsey to serve on the Oakland County Public Transportation Authority Board for a term ending December 31, 2020. Moved by Long seconded by McGillivray that the communications and presentations be received and filed and the appointment confirmed. A sufficient majority having voted in favor, the communications and presentations were received and filed and the appointment confirmed. DAVID WOODWARD MISCELLANEOUS RESOLUTION #20104 BY: Commissioners Kristen Nelson, District #5; Christine Long, District #7; and Marcia Gershenson, District #13 IN RE: BOARD OF COMMISSIONERS – TRI-PARTY ROAD IMPROVEMENT PROGRAM FISCAL YEAR 2020 APPROPRIATION – CHARTER TOWNSHIP OF WEST BLOOMFIELD – SPREADING OF GRAVEL AND CHLORIDE ON VARIOUS ROADS – PROJECT NO. 55722 To the Oakland County Board of Commissioners: Chairperson, Ladies and Gentlemen: WHEREAS since the 1970s, the Oakland County Board of Commissioners has authorized the Tri-Party Road Improvement Program to assist Oakland County’s cities, villages and townships (CVTs) with the construction, maintenance and repair of roads under the supervision, direction and control of the Road Commission for Oakland County (RCOC); and WHEREAS on December 12, 2019, the Board of Commissioners approved Miscellaneous Resolution #19411 which designated $4,602,324 in fund balance for the Tri-Party Road Improvement Program for projects managed by the RCOC; and Commissioners Minutes Continued. April 29, 2020 178 WHEREAS the Charter Township of West Bloomfield, along with the RCOC, has identified a project and said project is ready to be undertaken immediately; and WHEREAS the RCOC has appropriated its one-third (1/3) share of the funding for the project in the Charter Township of West Bloomfield and said appropriation has been transferred to a project account; and WHEREAS the Charter Township of West Bloomfield has demonstrated that it has authorized its one-third (1/3) share of the funding for the project and has executed a contract for payment with the RCOC; and WHEREAS Oakland County’s one-third (1/3) share of the Fiscal Year 2020 authorized amount of Tri-Party Road Improvement funding for Project No. 55722 in the Charter Township of West Bloomfield is $50,000; and WHEREAS funding is available in the General Fund Assigned Fund Balance for Tri-Party 2020 and prior funding (account #383510) for Project No. 55722 in the amount of $50,000. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners hereby approves the project submitted by the Charter Township of West Bloomfield and authorizes the release of Tri-Party Road Improvement Program funds from the Oakland County Assigned Fund Balance. BE IT FURTHER RESOLVED additional project costs, not greater than 15% from the original agreement, which are consistent with the project as originally approved, will be paid when invoiced and appropriated in the quarterly forecast resolution. BE IT FURTHER RESOLVED that additional project costs exceeding 15% of the original agreement will require a separate resolution. Woodward, Chairperson, Emergency Operations and Oversight Committee IN RE: INFORMATION TECHNOLOGY – COMPREHENSIVE I.T. SERVICES INTERLOCAL AGREEMENTS To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS the State of Michigan has encouraged governm ental entities to share services with each other for efficiency and cost savings; and WHEREAS the Oakland County Department of Information Technology has developed numerous applications to more efficiently conduct governmental operations and is sharing certain applications with other governmental bodies to improve government efficiency and as a means of cost recovery; and WHEREAS the Board of Commissioners, pursuant to Miscellaneous Resolution #12153, approved the Department of Information Technology’s Comprehensive Information Technology Services Agreement enabling the Department to make additional technology services available to public bodies; and WHEREAS the Agreement enables the County to provide up to fifteen I.T. April 29, 2020 189 WHEREAS the existing SCADA system is a complex network of radios, servers, and computers utilized to monitor the operations of the sanitary sewer system; and WHEREAS the SCADA system is designed to provide site-specific alarms to Oakland County’s Safety Dispatch, which is staffed at all times, 24-hours per day, seven days per week; and WHEREAS the existing SCADA system is more than 20 years old having been installed during the 1990s; and WHEREAS the existing SCADA system is dependent on outdated equipment and technology that is no longer supported by the manufacturer; and WHEREAS the Village’s existing SCADA system will be decommissioned in October 2020 and replaced with the new system identical to systems that have been installed in all of the other Oakland County municipalities where the SCADA systems are operated and maintained by the Oakland County Water Resources Commissioner’s office; and WHEREAS the Village’s existing SCADA system must be upgraded to allow uninterrupted and continuing service to its residents; and WHEREAS the cost of upgrading the system is estimated to be $350,800; and WHEREAS the Village of Lake Orion desires to borrow $300,000 from Oakland County’s Long-Term Revolving Fund; and WHEREAS Miscellaneous Resolution No. 02019 authorized that monies be made available for loans to local units for amounts up to $150,000 and exception is being requested to authorize a loan to the Village of Lake Orion for the replacement of its SCADA System in an amount not to exceed $300,000; and WHEREAS Miscellaneous Resolution No. 89276 states that an interest rate no less than the prevailing six- month Treasury Bill rate should be charged. The six-month Treasury Bill rate is quite a bit lower than the average interest rate from the Treasurer’s pooled investments and therefore the rate to be charged will be the last published Treasurer’s pooled investment average monthly rate for the month of February 2020 is 1.784 percent; and WHEREAS the loan will be repaid over a five-year period with funds generated from rates paid by customers of the Village of Lake Orion sewage disposal system; and WHEREAS funding is currently available in the Long-Term Revolving Fund to issue a loan in the not to exceed amount of $300,000 to the Village of Lake Orion. April 29, 2020 197 MISCELLANEOUS RESOLUTION #20125 BY: Commissioner Marcia Gershenson, District #13; Penny Luebs, District #16 IN RE: BOARD OF COMMISSIONERS – REQUEST REPORT FROM ADMINISTRATION WITH RECOMMENDATIONS TO INCREASE CONTACT TRACING CAPACITY TO SUPPORT A COMPREHENSIVE COVID-19 CONTAINMENT STRATEGY IN OAKLAND COUNTY To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS according to World Health Organization (WHO), the best approach to contain, manage, and get through the COVID-19 pandemic is to take the appropriate public health actions that support an assessment and containment strategy; and WHEREAS a containment strategy includes widespread testing, contact tracing, and isolation of new cases to minimize the risks of resurgence while maintaining social distancing measures such as limiting the size of gatherings to reduce the risk of large-scale transmission; and WHEREAS contact tracing is a core disease control measure employed by local and state health department personnel for decades that includes, but is not limited to: tracing and monitoring contacts of infected people and notifying them of exposure, and if necessary quarantine them, to prevent additional transmission of the virus, and the use of technology to trace transmission; and WHEREAS the Center for Disease Control says contact tracing is a key strategy for preventing the further spread of COVID-19. Immediate action is needed. Communities must scale up and train a large contact tracer workforce and work collaboratively across public and private agencies to stop the transmission of COVID-19; and WHEREAS contact tracing, being part of a containment strategy, is especially important before a vaccine becomes widely available; and WHEREAS a thorough containment strategy will allow for a smoother transition of people returning back to work, re-opening Oakland County services, and our local economy; and WHEREAS Oakland County’s Health Division is an expert in contact tracing as evidenced by its successful use off this technique in containing and managing a measles outbreak in March 2019; and WHEREAS the Oakland County Health Division has among the most advanced and trained public health professionals trained to do contract tracing, and is actively exploring how to increase capacity and get to a scale necessary to protect all of Oakland County; and WHEREAS the performance of the Oakland County Health Division has been an exceptional model for how public health departments should respond in a pandemic. NOW THEREFORE BE IT RESOLVED that Oakland County Board of Commissioners acknowledges that increasing contract tracing capacity in Oakland County will support a broader COVID-19 containment strategy and would be the beneficial solution after the “Stay Home, Stay Safe” Executive Order is relaxed or lifted. MISCELLANEOUS RESOLUTION #20126 BY: Commissioner Kristen Nelson, District #5 IN RE: BOARD OF COMMISSIONERS – CALLING ON THE PRESIDENT AND FEDERAL ADMINISTRATORS TO LEAD ON BUILDING ADEQUATE NATIONAL COORDINATED COVID-19 TESTING PROGRAM AND SUPPLIES TO HELP OAKLAND COUNTY RESIDENTS STAY SAFE AND GET BACK TO WORK To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS in the absence of a breakthrough treatment or vaccine, public health experts agree that the widespread availability of COVID-19 testing is a key element for the containment of the virus and the safe and successful re-opening of our economy and the resumption of public life; and WHEREAS according to the Harvard Global Health Institute, states performing at least 152 tests per day per 100,000 residents by May 1, 2020 would be able to re-open their economies; and WHEREAS Oakland County has been rapidly increasing testing capacity with drive-thru COVID-19 sites and other testing efforts; and WHEREAS securing testing supplies and equipment continues to be a challenge in Oakland County’s efforts to have enough testing capacity to adequately manage the large scale, and still growing demand to contain the virus; and WHEREAS Oakland County Executive David Coulter, along with U.S. Congresswoman Elissa Slotkin, and Michigan State Representative Andrea Schroeder wrote a letter to Peter Gaynor, FEMA administrator, and Alex Azar, secretary of the U.S. Department of Health and Human Services declaring the need for additional rapid testing machines, testing kits, and expressed our regions need for rapid testing technology and robust testing capacity; and WHEREAS as reported in Bloomberg News on April 28, 2020, in the article “Virus Test Shortages Undermine Drive to Restart U.S. Economy”, public health experts agree that the lack of leadership and coordination from the federal government on COVID-19 testing has created significant problems, “The consequence of the lack of federal leadership on U.S. testing strategy to date is a free-for-all among states that drives up prices, eats up time, and ultimately dictates how many tests a state can do and how prepared it will be, experts agree.”; and WHEREAS the article further notes that the President and his administration’s approach of encouraging competition rather than coordination among states and localities has reduced potential testing capacity by as much as 50% as crucial supplies like swabs and transport media have been unavailable; and WHEREAS the call for a more active leadership role from the administration on testing has come from governors and municipal leaders from both political parties, including Republican Governors Larry Hogan of Maryland and Mike DeWine of Ohio, and Democratic Governors Andrew Cuomo of New York and Jay Inslee of Washington; and WHEREAS the bipartisan U.S. House Problem Solvers Caucus has recognized that the federal government must take the lead on implementing rapid mass testing for the novel coronavirus, rejecting the position of the President and his administration; and WHEREAS the health, safety and welfare of Oakland County residents as well as the recovery of our economy requires the widespread availability of COVID-19 testing to the public. Leadership from the President and the federal administration for a coordinated, robust national COVID-19 testing program is necessary to deliver the supplies needed to keep Oakland County residents safe and allow our workers to get back on the job. Many cases go unreported and it is critical to act early to save a child’s life; and WHEREAS connecting with child caregivers including family, friends, and neighbors can make a difference in breaking the cycles of abuse by recognizing and addressing challenges while building positive supports; and WHEREAS child abuse prevention is a community responsibility dependent on continual collaboration and advocacy among schools, social service agencies, religious and civic organizations, businesses, and law enforcement; and WHEREAS CARE House of Oakland County unites partnerships to resolve local child abuse issues and applies effective programs to create nurturing environments in the community that improve early identification, treatment and abuse prevention efforts; and WHEREAS Children’s Protective Services saves lives receiving toll-free calls 24/7 at 855-444-3911 to report and prevent further abuse of a child; and WHEREAS together we can build supportive relationships which advocate for all children to grow and thrive in a healthy environment filled with joy, hope, unconditional love and acceptance. MISCELLANEOUS RESOLUTION #20139 BY: Commissioner Shelley Taub, District #12 IN RE: BOARD OF COMMISSIONERS – REALLOCATION OF PLANNED PARENTHOOD FUNDS TO COVID-19 PANDEMIC NEEDS To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS in March of this year, a new strain of the coronavirus, otherwise known as COVID-19, unexpectedly attacked Oakland County and the State of Michigan, causing residents, businesses, governments, and the medical profession to implement reactive measures to address the virus; and WHEREAS COVID-19 and responsive measures have had a devastating and lethal impact on Oakland County families, businesses, and individuals stricken by this virus; and WHEREAS Oakland County has taken sizable steps to protect its residents against this pandemic; and WHEREAS to date the Board of Commissioners has appropriated $16,500,000 as referenced below to support preparedness and response measures to the COVID-19 pandemic public health threat: • $500,000 on March 5, 2020 via Miscellaneous Resolution #20062 • $1,000,000 on March 18, 2020 via Miscellaneous Resolution #20085 • $5,000,000 on March 31, 2020 via Miscellaneous Resolution #20097 • $10,000,000 on April 13, 2020 via Miscellaneous Resolution #20112; and WHEREAS the County Executive has stated there must be significantly more testing, including testing of asymptomatic people, in order to fully re-open the economy; and WHEREAS such testing will require a dramatic increase in supplies, lab expenses, personnel, and other costs; and WHEREAS government revenue will likely be constrained in the future, as unemployment claims have broken records set in the 2007-2009 Great Recession and experts have noted the economy appears to be in free fall; and WHEREAS on December 12, 2019, a majority of the Board of Commissioners voted to set aside $500,000 to give to Planned Parenthood (“Planned Parenthood Funds”) under Miscellaneous Resolution #19411; and WHEREAS Oakland County must now prioritize its expenditures to ensure it is prepared for both known and unknown future needs to address this unpredictable pandemic. (10) A sufficient majority not having voted in favor, the motion to suspend the rules and vote on Miscellaneous Resolution #20140 – Board of Commissioners – Restore the Pride and the Livelihood of Michigan Workers failed. The Chairperson referred the resolution to the Pandemic Response and Economic Recovery Committee. There were no objections. Commissioner McGillivray addressed the Board regarding agenda revisions and the process and timing of introducing resolutions. Discussion followed.
